PRIOR LAKE PLANNING COMMISSION MINUTES
Monday, July 9, 2018
1. Call to Order and Pledge of Allegiance:
Commissioner Fleming called the Monday, June 9, 2018 Prior Lake Planning Commission meeting to
order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, William Kallberg,
Dan Ringstad, Jason Tschetter, and Liaison Zach Braid. Also present were Planner Jeff Matzke, Planner
Amanda Schwabe, Project Engineer Nick Monserud, Community Development Director Casey McCabe,
and Community Development Services Assistant Sandra Woods.
2. Approval of Agenda:

3. Approval of Monday, June 25, 2018 Meeting Minutes:

4. Public Hearings:
A. PDEV18-000025 – 5516 and 5570 180th Street E – Preliminary Plat and Variance – Keyland
Homes is proposing a preliminary plat consisting of 48 single-family homes to be known as
Meadows at Cleary Lake as well as requesting a variance to the minimum front building setback
to extend Prairie Way to the east. The Subject property is located at 5516 and 5570 180th Street
East. PID’s: 119120021 & 119120025.
Planner Matzke: Keyland Homes, on behalf of the property owners, have applied for approval of a
Preliminary Plat to be known as Meadows of Cleary Lake to be developed as a 48-lot residential
subdivision as well as a variance for the existing house lot to be incorporated into the new development.
The subject site is located north of 180th Street, west of Revere Way (Hwy 87), and south of Trailhead
Lane. He explained the history, current circumstances, issues, and recommended a motion. He
presented a location map, development plans dated June 7, 2018, Engineering/Public Works/WSB
memorandum dated June 29, 2018, Community Development Department memorandum dated July 2,
2018 and a resolution.
Commission Comments/Questions:
Tschetter: Questioned the utility compacity, downstream, wastewater or anything additional.
Project Engineer Monserud: Replied the sewer study that was completed 5 to 6 years ago for this entire
area. He explained the process took so all improvements have been made; therefore, leaving compacity
for city sewer and water in this area.
Tschetter: Asked if it is sufficient for the expected future expansion into the adjacent parcel as well.
Project Engineer Monserud: Responded, yes it was improved all the way to Revere Way.
Tschetter: Questioned if lot 14 on the 5-foot adjustment in the street alignment still yields sufficient from
the square footage perspective, but is it still a buildable lot for a home typical in this development.
Planner Matzke: Explained the size of the lot and stated it does meet all our requirements for a corner
lot that would be in this development, even if the house was not there.

Tschetter: Asked if given the setback requirements for corner lots, would there still be able to have
enough of a footprint within the setback dimensions.
Planner Matzke: Replied, correct for a new home and explained the situation if the house was removed.
Tschetter: Questioned if the variance is primarily for atheistic or finance reasons or both?
Planner Matzke: Replied it is for the alignment of the road and the shifting of the radius curve of the road
and sidewalk.
Project Engineer Monserud: explained the allowance of the variance is to soften the horizontal curve
of the road, assists the flow and allows the grading to fit in better with what is existing today.
Tschetter: Mentioned the perspective of the radius is hard to imagine from the pictures and what that
would mean from a maintenance perspective.
Ringstad: Asked how the wetlands exist in the property right now; is this handled from wetland credits
and is it purchased or required within the same district.
Project Engineer Monserud: Responded, yes typically what we see now with impacts to wetlands,
wetland credits are purchased or have the option to mitigate on site and stated that is all reviewed by the
wetland conservation act process.
Applicant
Rod Just: Resides at 5100 Condons Street SE in Prior Lake. He expressed excitement of putting the
neighborhood together, explained how many lots there will be and the average price points of the lots.
He offered plan pictures and explained other locations and homes he has built in the past.
Fleming: Asked how many trees are being replaced.
Applicant Just: Replied they would follow the city requirements in removing and replacing trees.
Tschetter: Asked what their plan is on approaching the neighbors’ concerns as they proceed with the
development.
Applicant Just: Explained the communication they have had with the neighborhoods, stating they have
not had conversations with all of the other neighbors yet; however, said it has always been their goal to
be a good neighbor and if anything arises in the process they would be more than happy to address it.
Tschetter: Asked for examples of how they have addressed construction concerns.
Applicant Just: Explained the engineering team usually addresses these types of concerns.
Ringstad: Asked if Keyland Homes would be the sole builder in this development.
Applicant Just: Responded they plan to be the sole builder and commented on how the market changes.
Tieman: Asked upon approval when do you plan to start development.
Applicant Just: Replied as soon as possible as the market is good and changes are not guaranteed.
He stated a comment from his dad and said they would like to get going this year, start building homes
with the hopes of having a model by the end of spring 2019.
Kallberg: Questioned the comments from neighbors on the other side of 180th Street and the Enclave at
Cleary Lake regarding screening. He said this preliminary plat does not show any landscaping; but, what
will the backyard layout look like.
Applicant Just: Replied we don’t have the landscape plans yet and commented on the trail along 180th
Street, trees on the south side of the neighborhood, drainage and requirements they will need to adhere
to. He said they have no additional plans at this point; however, are open to suggestions.
Fleming: Asked for further conversation regarding community engagement. He stated we strongly value
community engagement and suggested that the applicant take active steps to be in touch with neighbors
prior to significant events happening.
Applicant Just: Replied, yes.

Public Comment:

Sherieda Bender: Resides at 5651 180th Street East; neighbor to the south. She shared concerns
regarding traffic, her livestock, safety, assessments, water drainage on 180th, culvert, traffic on 180th with
only two access points, traffic study, property values, sewer and water, limited options upon sale of house,
screening and trees. She asked that the developer be required to have a landscape plan that reflexes
the needs of the neighbors south of the road.
Kathleen Shaver: Resides at 5591 180th Street East; another neighbor to the south. She concurs with
her neighbor Sherieda Bender comments and added additional concerns of pets, privacy, new properties,
promises from prior developers, enjoyment/fulfillment of life styles, driveway issues, and road washouts.
She explained the outcome of a personal traffic study prepared on 180th Street. She objects to all the
additional traffic and specified the reasonings to her objection. She asked for help from the Planning
Commission and the city with traffic, safety, road holding up under additional traffic, scenic trees, berming,
Enclave Development having water in basements with constant sump pumps running, and the water
table.
Fleming: Asked staff at what point in the process will the traffic study be commissioned and reviewed.
Project Engineer Monserud: Said traffic counts were performed last week and offered to review them.
Fleming: Suggested to reserve the comments on traffic counts until after the public comments are heard.
Lee Shimek: Resides at 17944 Revere Way; property on the southeast corner. She commented on
progress being a reality and shared concerns of the culvert on 180th street being buried and how the
drainage flow comes into her property. She asked if the buried culvert is being taken into consideration
and how that will affect their property. She questioned if the single-family homes would be immediately
behind her property, verification of map direction and road information.
Planner Matzke: Pointed out the direction on the map, the location of homes backing up to their property,
a house on the corner and the intersection on 180th that is being proposed.
Shimek: Asked about the 10-foot setback.
Planner Matzke: explained the house setback and mentioned that corner lots have larger spacing.
Shimek: Shared concerns of the traffic, assessments, traffic flow to be reviewal for safety and asked how
the heavy traffic would get dealt with.
Konrad Gastony: Resides at 5475 180th Street E; west to the previous owners that spoke. He shared
concerns regarding further investigating the traffic flow with safety being his primary concern. He
questioned feasibility of having a “T” intersection coming out of a neighborhood on a 50-mph speed limit
road and many existing traffic flows that are already in place.
Fleming: Asked staff for some commentary on traffic study counts.
Project Engineer Monserud: Said traffic counts started on 180th Street last week and he explained how
they calculated the daily traffic, where the counters are located and the total traffic counts. He stated this
is a very low traffic count area and explained how many cars this location can handle. He said adding
the traffic flow from the new development (approximately ten trips a day per household) would still be
under what the road is capable of handling.
Fleming: Asked what is the peak windows of time for traffic.
Project Engineer Monserud: Explained the time of the peak volumes of traffic according to the report
as 9:30am to 9:45am at 15 cars in 15 minutes and again 4:45pm to 5:00pm at 19 cars.
Fleming: Asked the number of cars monitored, how many of those cars were speeding.
Project Engineer Monserud: Explained the traffic percentage of speeding vehicles.

Commissioners Comments:
Kallberg: Commented on how often traffic concerns arise and other options of connectivity may not help
traffic flow. He suggested traffic calming devices.
Tieman: Said he shares a lot of concerns from the audience. He mentioned he would like to see the
landscape plan properly executed as it moves forward. He said he does not see issues with preliminary

plat or one variance in this proposal; however, does feel items need to be followed up on as the project
goes forward.
Fleming: Stated he is in support of the proposal; however, would like to underscore for the developer
how important it is that we have proactive intentional community engagement, particularly around
significant events. He said he was glad that staff had the traffic study and would like the residents’
concerns and comments that were lifted up for us to be integrated in the thinking in the development
moving forward as the developer is moving forward with the property.
Ringstad: Said he agrees with everything his fellow Commissioners have said and mentioned the
benefits of having a local developer that is within the community. He stated he likes the fact that we are
looking at a conforming development where all the lots are 12,000 square feet or greater, as often times
we don’t see that. He commented on the layout being well thought out and considering that the
annexation process goes smoothly as it will be a nice addition to the city.
Tschetter: Asked staff if there will be future discussion on the culvert and the impact of this development
to the water table.
Project Engineer Monserud: Replied that will get reviewed in depth again. He stated it has been looked
at quite a bit and right now they are showing the existing culvert that is in question as remaining in place.
Tschetter: Stated he would then echo Commissioner Ringstad’s points as he believes there are two
sides to any situation; we have our urban city lifestyle meeting a rural lifestyle and that is a change, but
the benefits of the city’s resources and engagement also come with and is hopeful that we can all be
good neighbors. He said he is in support of the plat and the proposed variance.
MOTION BY TSCHETTER, SECONDED BY RINGSTAD TO RECOMMEND APPROVAL OF A
PRELIMINARY PLAT FOR THE MEADOWS OF CLEARY LAKE SUBJECT TO THE LISTED
CONDITIONS.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
MOTION BY TIEMAN, SECONDED BY TSCHETTER TO APPROVE A RESOLUTION APPROVING
THE VARIANCE REQUESTED FOR LOT 14, BLOCK 6 WITH THE LISTED CONDITIONS.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
B. PDEV18-000027 – 6018 150th Street SE – Variance – The property owner, Cory Haugen, is
requesting a variance to enlarge an existing, non-conforming structure for a major remodel
including the addition of an attached garage and living space on the street side of the house. PID:
251170030.
Planner Schwabe: Introduced a consideration of an approval for a resolution approving a variance
request from the property owner, Cory Haugen to allow a major remodel of a non-conforming
structure on property located at 6018 150th Street SE. The property is located along the
northeastern shores of Lower Prior Lake, east of Pixie Point Circle SE in the R-1 SD (Low Density
Shoreland) Zoning District. The property contains a single-family home (single-story basement
walkout) and a detached garage. She presented a resolution, location map, proposed survey dated
June 20, 2018, floor plans dated May 13, 2018 and an applicant narrative.
Commission Comments/Questions:

Cory Haugen: Resides at 6018 150th Street SE. He thanked Planner Schwabe for her presentation and
has nothing further to add. He also thanked the Commissioners for their considerations.

Commissioners Comments:
Tschetter: Said this is a reasonable investment in our community and he appreciates the effort of the
staff and homeowners to maintain the lake side setback and find reasonable compromises while
continuing investment in the community. He said the lot is difficult as it is long and skinny.
Ringstad: Stated he agrees with Commissioner Tschetter’s assessment and said he will be supporting
this agenda item.
Fleming: Said he will be supporting this proposal as it does meet the 5-point criteria threshold 1108.400.
He said it makes good sense.
Tieman: Stated he does support this variance. He commented that he walks by this area often and he
feels it makes total sense.
Kallberg: Said the only issue is the existing structure and the addition is reasonable and appropriate. He
said we face this issue over and over with 1947 plats; with the 1967 current structure. He supports this
agenda item.
MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE A RESOLUTION APPROVING
THE VARIANCES REQUESTED FOR 6018 – 150TH STREET SE WITH THE LISTED CONDITIONS.

C. PDEV17-001036 – 5035 Beach Street NE – Conditional Use Permit (CUP) – Cindy Langer is
requesting a Conditional Use Permit to add approximately 30,000 cubic yards of fill to various low
spots that are susceptible to flooding on a property in the R-1 (Low Density Residential) Zoning
District located northwest shores of Lower Prior Lake; west of Beach Street NE. PID: 251350050.
Planner Matzke: Introduced a consideration to approve a resolution approving a request for a
Conditional Use Permit to allow grading and land reclamation in excess of 400 cubic yards at 5035
Beach Street. The site is located on the Northwest shores of Lower Prior Lake, South of County
Hwy 82. The project call for the importing of up to 30,000 cubic yards of fill to the site. He
presented a draft resolution, a location map and a project plan dated April 3, 2018.
Commission Comments/Questions:
Planner Matzke: Mentioned a comment from a resident residing at 4979 Beach Street (JC Huang). The
resident stated he didn’t object to the project; rather, thought it to be wonderful news and liked the thought
that the hauling route was going to be from the east and not a long Beach Street and did have comments
on the quality of the fill that was coming into the site and wanted to make sure it was not contaminated
soil. He said that he advised the resident that it would be the applicants best intentions to bring in clean
fill because there are requirements based on future housing foundations that would have to be met for
soil types and compacted soil types, so bringing in a certain amount of fill that is not contaminated or bad
would be a wasted project for their future intensions maybe for the site.
Fleming: Commented on impact of loads on roadways and contamination of soil and asked what checks
and balances of what is being hauled is of acceptable quality.
Project Engineer Monserud: Replied once the applicant finds a fill source; typically, they provide a soil
report and we could request a copy of that to review, then they lock in the source of soil to bring onto the
site.

Tschetter: commented on this being a full regrade of this property all the way down to the lake and asked
what potential impact this will have on lake water quality, as if we take out what appears to be more less
the natural infiltration point.
Project Engineer Monserud: Responded it would provide more runoff to the lake, as they are removing
a depression lower than the lake level but as part of their state permit (NPDS permit) they must maintain
erosion, stabilize, and once everything is established it would create a buffer, which would clean the
water that would go to the lake. He said when they are all done he doesn’t foresee any problems as far
as pollution.
Tschetter: Asked if it is fair to say that this will infiltrate the way it would on any other lake property around
the lake; we are not changing anything around the lake to this area of the shoreline or any of this area of
the lake.
Project Engineer Monserud: Replied that is fair for what we see on all the other houses.
Planner Matzke: Added in the future if they did bring a subdivision project in future housing pads, future
streets would be managed through storm water regulations, and a stormwater system into the pipes of
our storm water system as well, if there are future impervious surface types that is not proposed with this
project they would be managed to not drain towards the lake, more of the stormwater system for a lot of
that area.
Tschetter: Said within the flood year (2013/2014) much of this property is under the 904 line and even
access into the home would have been severely impacted; is that arcuate? As the driveway itself is under
the 904 line.
Planner Matzke: said yes, the applicant could probably tell you some stories regarding the drainage and
the flood of that year.
Ringstad: Said his questions have been answered and the Carriage Hills Parkway route seems to make
all the sense in the world compared to Beach Street and is glad that was addressed in the report.
Kallberg: Asked if Carriage Hills Parkway was supposed to be graded and built through this year.
Planner Matzke: replied yes, that is correct and it is still proposed for that. He said the application is in
here for that project, but has not been approved by City Council yet, and Pulte Homes has brought in
their application for the second phase of the development.
Kallberg: Said this has been brought up many times and asked if the renewal is for a greater amount
then the prior Conditional Use Permit requests and approval. He asked if it was a new application not a
renewal.
Planner Matzke: Replied correct, it is a brand-new application because it is for a larger amount and the
previous approvals did expire.
Kallberg: Said he noticed the proposed new driveway is class 5 which is crushed limestone; and asked
if driveways are required to be no longer allowed for crushed rock driveways.
Planner Matzke: Replied yes, that is one of the comments that we have is that the driveway needs to be
paved to the residential home.
Applicant
Eric Beazley: Resides at 995 Evans Way, Minnetrista, MN. He said he is the civil engineer working with
the applicants on this project. He said he is here to answer any questions or provide any additional input.
Tschetter: Asked about the storm water runoff plan and any lake water quality issues.
Beazley: Confirmed the comments by Project Engineer Monserud regarding the approval from the MPDS
permitted coarse and explained they have an erosion control plan and a storm water pollution plan. He
explained each plan stating there will be silt fencing, erosion control blankets, ditch blocks/checks. He
explained the design for the ditch blocks/checks.
Kallberg: Asked if this would be a buildable area with anticipation of some subdivision of property soon.
Beazley: Replied, correct in the next year or so.

Commissioners Comments:
Tschetter: Stated he is impressed by the scale of this project and is interested in this not being a repeat;
but is in favor of proceeding.
Ringstad: Agrees with Commissioner Tschetter’s comments and cannot imagine the local and non-local
permitting tied to this so is comfortable with all checks and balances being met with that amount of fil
coming in. He stated he will be approving this agenda item tonight.
Fleming: Stated he too will be approving the proposal and complimented Project Manager Monserud on
an excellent report on soil quality and complimented Planner Matzke on the comments and good work
for the applicant and staff had done to make sure moving the soil in a way that least impacts our
roadways. He said for the record the CUP requirements 8-point threshold is met and is very confident
that the 8 additional conditions will be met as well.
Tieman: Said he supports this CUP, thinks it is a good thing and is hopeful that it gets done this time.
Kallberg: Said he cannot imagine how many truckloads of fill this will take and mentioned it is triple the
amount of the previous application but is a good thing to do. He said he also is hopeful it will get
completed and he stated he does support this agenda item.

A CONDITIONAL USE PERMIT SUBJECT TO THE LISTED CONDITIONS TO ALLOW GRADING AND
LAND RECLAMATION IN EXCESS OF 400 CUBIC YARDS AT 5035 BEACH STREET NE IN THE R-1
SD (LOW DENISTY RESIDENTIAL SHORELAND) ZONING DISTRICT.
