Prior Lake, MN 55372-1714 AGENDA ITEM: OCTOBER 17, 2005 51 DANETTE MOORE, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1160 (GREYS TONE INDUSTRIAL CONDOMINIUM) CIC PLAT MEETING DATE: AGENDA #: PREPARED BY: DISCUSSION: Historv: In August of 2005 a 3-unit building known as the Greystone Industrial facility was built in the Deerfield Industrial Park. Since that time, the building has been under single ownership with rental units. Current Circumstances: The current owner of the building, 169 Industrial Park Development Co., LLC, is requesting approval of a Common Interest Community (CIC) plat. The purpose of a CIC plat is to allow for the subdivision ofthe 3-unit building into lots for each individual unit. These lots may be sold to individual owners, or be rented. Essentially, the plat creates a lot around the four walls of an individual unit. The CIC plat does not change the site plan or number of units within the building. The Issues: CIC plats do not require a development contract. The required developer improvements were included under a previous final plat, so no Letter of Credit is necessary. In addition, the City fees normally associated with a final plat have been collected under the previous Development Contracts. Conclusion: A copy of the CIC plat is attached to this report. Staff will be available to discuss the details of this plat with the Council. FISCAL IMPACT: BudJ!et Impact: There are no budget impacts with the approval of this CIC plat since the building has already been built. ALTERNATIVES: The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1160 (Greystone Industrial Condominium) CIC Plat. 2. Deny the resolution approving the CIC plat. 3. A motion and second to adopt a resolution approving the Common Interest Community Number 1160 (Greystone Industrial Condominium) CIC Plat and authorizing the Mayor and City Manager to sign the CIe plat documents. 1:\05 files\05 subdivision\05 cic\greystone industrial condos\cc report. doc Page 2 16200 Eagle Creek Avenue ~~OLUTION OS-XX Prior Lake, MN 55372-1714 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1160 (GREYSTONE INDUSTRIAL CONDOMINIUM) CIC PLAT MOTION BY: SECOND BY: WHEREAS: The Greystone Industrial facility was built in August of 2005 as a 3-unit building; and WHEREAS: the Greystone Industrial building is located on an existing, platted lot; and WHEREAS: The City Council has found that the Common Interest Community Number 1160 (Greystone Industrial Condominium) CIC Plat is in compliance with the existing building and does not change the site plan or number of units within the building; and WHEREAS: The City Council has approved the Common Interest Community Number 1160 (Greystone Industrial Condominium) CIC Plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and recording of said plat: 1. The recitals set forth above are incorporated herein as if fully setforth. 2. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by December 17, 2005, will render the CIC plat null and void. 3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
