ACRES TO BE DESIGNATED R-LIMD (LOW TO MEDIUM DENSITY RESIDENTIAL) DESIGNATION (BARBERI GOODLUND) Historv: Tollefson Development has applied for two amendments to the 2020 Comprehensive Plan Land Use Plan Map to add approximately 10.5 total acres to the City of Prior Land Use Plan Map and to designate the properties as R-L/MD (Low to Medium Density Residential). The area consists of two properties referred to as the Barber property (5.42 acres) and Goodlund property (5.08 acres). The properties are proposed to be developed with single family residences as part of the Maple Glen 3rd Addition. The properties are located north of 180th Street, east of Fairlawn Shores, west of Rice Lake, and south of TH 13. The subject properties were annexed by the City on July 18, 2005 and currently do not have a Comprehensive Plan designation. The Planning Commission considered these requests at a public hearing on September 26, 2005. The Planning Commission voted to recommend approval of these requests. Phvsical Site Characteristics: Topoe:raphv: Topography of the sites varies slightly, with elevations ranging from 990' MSL at the eastern end to 960' MSL at the western end of the site. Vee:etation: Much of these sites have historically been used as farmland. There are small stands of trees located both at the far northern and southern ends of the sites. Wetlands: The Barber property has no wetland area. The Goodlund property has a wetland located on the western side of the site, therefore, a wetland delineation will be required as part of the L:\05 FILES\05 COMP AMEND\Goodlund\C~fpriorlake.com Phone 952.447.4230 / Fax 952.447.4245 Preliminary Plat application for the Maple Glen 3rd Addition Development. Access: Current access to the Barber property is from Wedgewood Lane and access to the Goodlund property is currently from 180th Street. 2020 Comprehensive Plan Desie:nation: As stated before, due to their recent annexations the properties are not designated for any use on the 2020 Comprehensive Plan and are currently zoned R-I (Low Density Residential). Utilities: Utilities consisting of sewer and water services will be extended from the north through the Maple Glen 2nd Addition development. The developer will be responsible for the cost of extending services to the site. Adiacent Land Use and ZoniDe:: To the north of this site is the Maple Glen 2nd Addition development, which is zoned R-I (Low Density Residential). To the north of the site is land recently annexed and designated R-L/MD (Low to Medium Density Residential). To the west is an existing rural residential lot and wetland located in Spring Lake Township. To the east is an existing dwelling on a large lot within the township. To the south is 180th Street SE and another existing dwelling on a large lot within the township. ISSUES: The applicant is proposing to develop these sites with single family residences as the proposed Maple Glen 3rd Addition. The R-L/MD designation is consistent with this development. The Comprehensive Plan goals and objectives that are applicable to this request are as follows: GOAL: SUITABLE HOUSING AND ENVIRONMENT OBJECTIVE No.1: Provide opportunities for a variety of affordable high quality housing. OBJECTIVE No.2: Maintain a choice of and encourage development of quality residential developments. OBJECTIVE No.3: Provide suitable passive open space for the preservation of the natural environment and enjoyment of residents. The City of Prior Lake 2030 Vision and Strategic Plan includes a vision element entitled Quality Community Growth. The primary policy under this element is to "Assure that urban expansion occurs in a well-planned and orderly manner and that annexed property is developed in accordance with the City's planning and zoning requirements." L:\05 FILES\05 COMP AMEND\Goodlund\CC report. doc 2 CONCLUSION: FISCAL IMPACTS: ALTERNATIVES: RECOMMENDED MOTION: When considering a Comprehensive Plan amendment, the applicant generally has the burden of establishing that the amendment is necessary because of mistakes in the original designation or significant changes in conditions affecting the subject property. In this case, these rules do not apply because there is no guiding of the properties. The objective here is to establish what the proper designation of the properties should be. While annexation could be considered a significant change in conditions, in this case it signals the need to designate the properties under the City's Comprehensive Plan and not the County's. Designation of these properties for Low to Medium Density Residential (R-L/MD) would seem to be the appropriate, given the nature of existing and proposed developments in contact with, or in close proximity to, the subject property. There is no budget impact as a result of this action. Approval of these projects will facilitate the development of the area and increase the City tax base. The City Council has three alternatives for action on the application: . 1. Adopt the resolutions approving the amendments to the Comprehensive Plan to designate these properties as R-L/MD. 2. Deny the Comprehensive Plan amendments on the basis that they are inconsistent with the purpose and intent of the Comprehensive Plan. In this case, the Council should direct the staff to prepare resolutions with findings of fact based in the record for the denial of these requests. 3. Defer consideration of these items and provide staff with specific direction. The Planning Commission and staff recommend Alternative # 1. This action requires the following motion: .
