I ave now had a chance to collect the Information you requested at oue ~Iovemoer 9,2004 meeting, Here are

1, The City will provide you with an allowance as shown below for the blacktop, On the Village Lake Drive
si e, no more than one to two feet behind the sidewalk are city property, The remaining property is yours and
w s disturbed by the new parking lot work, To compensate for the blacktop and the small amount of black dirt
a d sod I have asked the finance department to issue a check to Bealmake for $5000,
2, The triangular parcel was included in the calculation for the parking lot variance, So any development of
th t lot would require variances and a joint use parking agreement We can work with you if you have some
c ncepts you would like to explore
3, Fantastic Sam's, We have received the building permit My research shows that consistent with our long
ti e practice, neither the liquor store nor the grocery store were charged for any metro or city SAC, WAC or
r lated development fees, This is because the Metropolitan Council concluded that now new sewer fiow is
c eated by these remodels since they take the place of identical uses of more or less identical sizes that were
o iginally part of the building,
antastic Sam's on the other hand does create two additional SAC units based upon the Metropolitan Council
d termination dated November 9,2004, As you know the city holds 11 SAC credits as a result of the closure of
t e Laundromat We will apply\twolof these units to Fantastic Sam's building permit which means the only
c arges they will have on their permit are the permit fee and the plan check fee, In other words none of the fees
w discussed on November 9 will be charged on the Fantastic Sam's permit
F r future reference, as long as these credits remain, it is staffs practice to apply them as outlined above, If all
c edits become used up then all development related fees will apply including but not limited to Metro and city
S C and WAC, Park Dedication, Water Tower, etc, If, once the building is completely renovated any SAC credits
r main they may not be converted to cash as set forth in Metropolitan Council Policy,
B rnie and Marty, I thought the SAC units might be included under our bUSiness subsidy policy which would
i clude and application and time delay to get the item on the city council agenda, But my reading of the definition
o business subsidy does not in my opinion include SAC Credits, I am pleased we are able to get this resolved
q ickly, I have Instructed my Building Inspection Department to proceed as outlined above with the Fantastic
S m's buiiding permit so it can be promptly processed and another new bUSiness can become part of South Lake
V lIage, Based upon what I have heard people love Village Market and are flocking there now that it is open I
a confident that the liquor store, salon and sandwich shop will experience the same fervor,
