Bob an I I met with representatives of Tri-City Restaurants, who are now managing the operations at Captain
Jack's t, , discuss the building projects on the site. They have told us there was a structure in the area the new
"shed" s going. Bob and I will be visiting the site tomorrow morning to verify this. Assuming this is a
replace nent structure, we have advised them as follows:
I, . 'hey can rebuild the structure as long as it does not exceed the original size. They tell me it is a smaller

2, ~ 'he new structure must be floodproofed. This means using flood resistant materials, raising any electrical
outlets, and not storing food in the building.
3. ' 'hey must provide plans and obtain a building permit for the structure.
4. ','hey must get MN Health Department approval.
5. ,\n outside bar will not be allowed,
6. . 'hey can utilize a retractable awning over the existing deck.
7, ','hey will replace the existing cedar fence that falls down every year, with a new vinyl fence that looks like

The rep ,esentatives were very positive and seemed willing to work with the City. They seemed to understand

operate a deep frier on the lower deck without first installing
vent. I understand that the lower kitchen will be held to the
codes of the Minnesota Department of Health.
I am planning to run the lower kitchen full time as soon as you
have approved the architects drawing for a sink and gas hook-up.

RE: Site plan review for Captain Jacks parking lot
Following are the results of the preliminary Site plan review for Captain Jack's parking
lot. Our review was based on the Minnesota State Building Code (MSBC) which adopted
with amendments the 2000 International Building Code (IBC) with handicap regulations
of the Minnesota Accessibility Code Chapter 1341.

I have been reviewing active files and I noted that I had yet to send you the letter we discussed
last summer regardlny the zoning status of the remodeling project of the Green Heights Tavern
formerly known as McWillies, The letter is comparable to the one sent to Jan Ballard in 1993. It
is the rec~gnition that the City found your development proposal and changes to be generally
consistent with the condllional use permit originally issued to Mr. Fred Schweich on December
15,1986.

The letter is to advise you that your development Plans for which the building permit was issued
last summer constitute the only change to the adopted framework for the expansion of the
establishment. The work you have undertaken is the last pre-approved e'panslon available to
this restaurant. Any future expansions or additions will require a new application for
amendment to the conditional use permit or for a new conditional use permit depending upon
the nature of the use.
,I wish to reiterate my compliments to you and your associates for undertaking the remodeling
-"and upgrading of this facility. Your investment and work represent a rejuvenation of this area

Three building permits were issued to Dan O'Keefe, (BP94-178, BP94-387, and BP94-576) that allowed
for the build out of the project, according to the approvals of CU84-06, and subsequent amendments
thereto. The last phase of the development consisted of a 329 square foot addition to the east side of the
building. The interior of the building was remodeled. The exterior of the building was re-sided and re-
roofed. Any future additions or alterations of the use of the property will require a new conditional use
permit hearing process and approval by the Prior Lake City Council.
The conditional use permit granted in 1984 and subsequent amendments run with the land, unless
specifically terminated by a sunset clause provision. In the event that the structure is destroyed, the
restaurant could be rebuilt according to the conditions outlined in CU84-06 as amended. A new structure
would be subject to current Zoning and Code requirements. Therefore, to rebuild may require a future
applicant to file for certain variances for setback etc. The underlying property is zoned R-I/S-D. As such,
a future land use for the site would have to conform to the Zoning district requirements in effect at that
time. In the event the structure is destroyed, and the owner does not desire to rebuild according to the
Conditional Use permits on file, the property would have to be developed with residential building(s)
compliant to the provisions of the Zoning Ordinance.
