Prior Lake, MN 55372-1714 RESOLUTION 05-173A RESOLUTION APPROVING AN AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR THE GOODLUND PROPERTY LOCATED NORTH OF 180TM STREET, EAST OF FAIRLAWN SHORES, WEST OF RICE LAKE, AND SOUTH OF TH 13 MOTION BY: Petersen SECOND BY: LeMair WHEREAS, RECITALS Tollefson Development has submitted an application for an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map to include property on the 2020 Comprehensive Plan Land Use Map and to designate the property as R-L/MD (Low to Medium Density Residential) for the property legally described as follows: Legal Description: The North 225.00 feet of the South 475.0 feet (as measured at right angles) of the Southeast Quarter of the Southwest Quarter of Section 10, Township 114, Range 22, Scott County, Minnesota, lying Westerly of the driveway as located thereon. The center line of said driveway being described as follows: Beginning at a point in the South line of said Southeast Quarter of the Southwest Quarter distant 594.67 feet East of the southwest corner thereof; thence North 12 degrees 29 minutes 45 seconds West a distance of 486.52 feet and there terminating. Together with: That part of the Southeast Quarter of the Southwest Quarter of Section 10, Township 114, Range 22, Scott County, Minnesota described as follows: Beginning at a point in the South line of said Southeast Quarter of the Southwest Quarter distant 436.0 feet East of the southwest corner thereof; thence East along said South line a distance of 158.67 feet; thence North 12 degrees 29 minutes 45 seconds West along the centerline of a driveway distance of 256.06 feet to the intersection with a line that is parallel with and distant 250.0 feet (as measured at right angles) North of said South line; thence West along said line a distance of 103.26 feet to the intersection with a line which bears North from the point beginning; thence South a distance of 250.0 feet to the point of beginning; Together with: That part of the Southeast Quarter of the Southwest Quarter, Section 10, Township 114, Range 22, Scott County, Minnesota described as follows: Beginning at the southwest corner of said Southeast Quarter of the Southwest Quarter, thence East along the South line thereof a distance of 436.0 feet; thence at right angles to the North a distance of 250.0 feet; thence West, parallel to said South line, to the intersection with the West line of said Southeast Quarter of the Southwest Quarter; thence Southerly along said West line 250.0 feet more or less to the point of beginning. and rAresoluti\planres\O5-173a amend 2020 comp plan (goodlund).d.o.c r · , . www.c~ryorpnonaKe.com Page 1 Phone 952.447.4230 / Fax 952.447.4245 WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, The Planning Commission conducted a public hearing on September 26, 2005, for those interested in this request to present their views; and WHEREAS, On September 26, 2005, the Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the R-L/MD designation is consistent with the goals and objectives of the Comprehensive Plan; and WHEREAS, On October 17, 2005, the Prior Lake City Council considered the proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property to the R-L/MD designation and; WHEREAS, The City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports and the minutes of the Planning Commission meeting; and WHEREAS, The City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are incorporated herein as if fully set forth. 2. The proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property as R-L/MD (Low to Medium Density Residential) is hereby approved. 3. Approval of this amendment is subject to the approval of the Metropolitan Council.
