Prior Lake, MN 55372-1714 RESOLUTION 05-173B RESOLUTION APPROVING AN AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR THE BARBER PROPERTY LOCATED NORTH OF 180TM STREET, EAST OF FAIRLAWN SHORES, WEST OF RICE LAKE, AND SOUTH OF TH 13 MOTION BY: Petersen SECOND BY: LeMair WHEREAS, RECITALS Tollefson Development has submitted an application for an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map to include property on the 2020 Comprehensive Plan Land Use Map and to designate the property as R-L/MD (Low to Medium Density Residential) for the property legally described as follows: Legal Description: That part of the Southeast ¼ of the Southwest ¼ of Section 10, Township 114, Range 22, Scott County, Minnesota, described as follows: Commencing at a point on the Southerly line of the Southeast ¼ of the Southwest ¼ distance 640 feet Easterly of the Southwest corner thereof; thence Northerly at right angles to said Southerly line a distance of 620 feet to the point of beginning of the tract of land to be described; thence continuing Northerly along the last described line 543 feet; thence Easterly parallel to the North line of the Southeast ¼ of the Southwest ¼ to the intersection of a line drawn 330 feet West of and parallel to the Easterly line of the Southwest %; thence Southerly along a line parallel to and 330 feet West of the Easterly line of the Southwest ¼ to its intersection with a line drawn 726 feet North of the South line of the Southeast ¼ of the Southwest ¼; thence Easterly along said line to the East line of the Southwest ¼; thence Southerly along said East line a distance to 66 feet thence Westerly parallel with the Southerly line of said Southwest ¼ a distance of 330 feet; thence Southerly parallel with the East line of said Southwest ¼ a distance of 39.40 feet; thence Westerly to the point of beginning. and WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, The Planning Commission conducted a public hearing on September 26th, 2005, for those interested in this request to present their views; and WHEREAS, On September 26, 2005, the Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the R-L/MD designation is consistent with the goals and objectives of the Comprehensive Plan; and WHEREAS, On October 17, 2005, the Prior Lake City Council considered the proposed amendment R:\RESOLUTI\PLANRES\05-173B Amend 2020 Comp Plan fBarber)DOC wv)w.city'ofpriorlake.corn Page 1 Phone 952.447.4230 / Fax 952.447.4245 to the 2020 Comprehensive Plan Land Use Map to designate the above described property to the R-L/MD designation and; WHEREAS, The City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports and the minutes of the Planning Commission meeting; and WHEREAS, The City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are incorporated herein as if fully set forth. 2. The proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the 'above described property as R-L/MD (Low to Medium Density Residential) is hereby approved. 3. Approval of this amendment is subject to the approval of the Metropolitan Council. Passed and adopted this 17'th day of October, 2005.
