EP 05-197 Prior Lake Spring Lake Watershed District has submitted an application for a conditional use permit for the grading and excavation to be done as part of the Prior Lake-Spring Lake Watershed District's Outlet Channel Restoration and Enhancement Project on the Jeffers Pond property. Call to Order: Commissioner Lemke called the October 10, 2005, Planning Commission meeting to order at 6:30 p.m. Those present were Commissioners Billington, Lemke, Perez and Ringstad, Planning Director Jane Kansier, Planning Coordinator Danette Moore, Assistant City Engineer Larry Poppler and Recording Secretary Connie Carlson. 2. Approval of Minutes: The Minutes from the September 26, 2005, Planning Commission meeting were approved as presented. 4. Consent: None 5. Public Hearings: Commissioner Lemke read the Public Hearing Statement and opened the meeting. A. Shepherd ofthe Lake Lutheran Church is requesting an ameudment to the Comprehensive Plan to designate approximately 5 acres ofthe Shepherd's Path development as C-CC (Community Retail Shopping). This property is located on the north side of CSAH 42, east and west of McKenna Road. Planning Coordinator Danette Moore presented the Planning Report dated October 10, 2005, on file in the office of the City Planning Department. Shepherd of the Lake Lutheran Church is requesting an amendment to the Comprehensive Plan Land Use Map for approximately 5 acres of land located north of CSAH 42 and west, east, and south of McKenna Road. The proposed amendment would re-designate the subject areas of the property from R-HD (Urban High Density Residential) to C-CC (Community Retail Shopping). The two subject areas are a 1.26 acre and 3.51 acre portion of the approximate 71 acre Shepherd ofthe Lake property. In August of 2004 the Planning Commission reviewed the concept plan for the Shepherd ofthe Lake property (Shepherds Path). The concept plan includes a mix of senior housing units, a YMCA facility, an athletic dome, a youth L:\05 FILES\OS PLAN COMMISSIONl05 MINUTESIMNIOIOOS.doc I Planning Commission Meeting October 10, 2005 center, and companion uses to the existing church (meeting areas, daycare, and retreat center). The applicant is proposing the amendment to the 2020 Comprehensive Plan in order to allow for a designation that would also facilitate banking or retail uses, along with a clinic/medical office component. ! The proposed C-CC designation is consistent with the Comprehensive Plan goals. The McComb Study identifies the need for an additional 62 acres of commercial area. The proposed amendment is consistent with this recommendation therefore, staff recommended approval of the request. Comments from the Public: Kermit Mahlum of Shepherd of the Lake Lutheran Church explained the two parcel commercial designations. One ofthe missions of the Church was to create a health and wellness center and this rezoning should help. The public hearing closed at 6:38 p.m. Comments from the Commissioners: Ringstad: . I like the change. The rezone meets the goals of the Comprehensive Plan. . Additionally the McComb Study identified the need for additional space. This meets the goals. Support the change. Billington: . It is a reasonable adjustment. It will accommodate the objectives of the Plan. . Will there be substantial additional traffic as a result of the project and what are the ramifications? Moore explained the change in traffic pattern with the new McKenna Road. The preliminary plat and PUD will identify those issues, which will come before the Commissioners in a month or so. The roadways were anticipated to generate traffic. Reasonable request - support. Perez: . I look at these as nice amenities for this plan. It is needed and works well with the PUD. Support. Lemke: . Agreed with fellow Commissioners - staff has laid out the goals and objectives of the Comprehensive Plan. It will be a nice addition - support. MOTION BY BILLINGTON, SECOND BY RINGSTAD, RECOMMENDING APPROVAL OF AMENDMENT TO THE COMPREHENSIVE LAND USE PLAN MAP REDESIGNATING THE SUBJECT AREAS OF THE PROPERTY FROM R-HD TO CoCCo L:IOS FILESIOS PLAN COMMISSIONlOS MINUTESIMNIOIO05.doc 2 Planning Commission Meeting October 10, 2005 Votes taken indicates ayes by all. MOTION CARRIED. This item will go before the City Council on November 7, 2005. B. EP 05-197 Prior Lake Spring Lake Watershed District has submitted an application for a conditional use permit for the grading and excavation to be done as part of the Prior Lake-Spring Lake Watershed District's Outlet Channel Restoration and Enhancement Project on the Jeffers Pond property. This segment of the project runs through the Jeffers Pond property, located on the south side of CSAH 42, directly west of CSAH 21. Planning Coordinator Danette Moore presented the Planning Report dated October 10, 2005, on file in the office ofthe City Planning Department. The Prior Lake-Spring Lake Watershed District (PLSLWD) has applied for a conditional I use permit to allow grading and excavation as part of an Outlet Channel project to restore and enhance the Prior Lake outlet system. The project segment will run through the Jeffers Pond property, located on the south side of CSAH 42, directly west of CSAH 21. Section 1101.509 of the Zoning Ordinance states that grading, filling land reclamation, and excavation requires a Conditional Use Permit for excavation of more than 400 cubic yards. The project will be constructed in several phases over the next five to seven years. Each phase will be constructed according to the Conceptual Plan for the outlet channel, which was developed with the Prior Lake Outlet Channel and Lake Volume Management Study completed in May 2003. This Conditional Use Permit application is specifically related to Segment I of the channel in the City of Prior Lake. The subject area for Segment 1 will extend from the outfall of the outlet pipe just west of County Road 21 to the culvert under County Road 42. The channel will flow through several wetlands including the Upper and Lower Jeffers Pond. Staffrecommended approval of the conditional use permit request, subject to the following conditions: 1. The excavation must be done according to the approved plans. 2. The clean up of fill material as a result of spills or general transportation of fill on any public road shall be the responsibility of the applicant. 3. The applicant shall record the Conditional Use Permit at Scott County no later than 60 days after approval. 4. The applicant must provide a Storm Water Pollution Prevention Plan. 5. The applicant must provide signed detailed and complete project plans. 6. Prior to any grading on the site, the applicant must obtain a temporary access permit from Scott County and an NPDES permit. 7. Prior to any grading on the site, the applicant must meet all requirements as set forth by the City Engineering Department. Watering for dust control shall be done on an as needed basis or within 24 hours written notice from the City. Such notice shall be transmitted by facsimile to the applicant. Dust control includes the entire project area and is not limited to roadways. Water for dust control shall be provided from an off-site source. 9. The CUP is valid for one year, but is revocable at any time for noncompliance with any condition contained herein. At the expiration of its one (1) year term, the property owner may make application to the City to renew the CUP. The initial approval of this CUP does not create any right, in law or equity, to the renewal thereof. Comments from the Public: Shannon Lotthanuner, District Administrator from the Prior Lake Spring Lake Watershed District gave an overall view ofthe project. Some of her comments included: . Stabilize channel banks to accept current and future flows. . Prevention of future erosion. . Improve efficiency of the system. . Enhance habitat along the channel. . Improve the channel aesthetics. . Design features to prevent erosion and stabilize channel banks. . Replacement of culverts. . Added blends (meanders) in channel to improve long-term stability. . New "overflow" wetland on north end to improve water quality. . Staging - begin construction in December. . Partners will be the Cities of Prior Lake, Shakopee and the Shakopee Mdewakanton Sioux Community. The DNR is also included in the review of the restoration. Bill Schmokel, 4151 Grainwood Circle, a board member of the Prior Lake Spring Lake Watershed District, explained the long range plan with the DNR. Without this outlet the Prior Lake would be severely restricted as Prior Lake is a landlocked body. It is a milestone to work a joint powers agreement with the agencies to pay for this system. Lemke questioned the outlet reconstruction itself. Schmokel explained they are working with property owners on easements at this time. The Watershed would like to construct a larger structure allowing a greater flow. They have to work with the property owners in that specific area so we don't hinder their property. Safety has to be a prime factor in this project as well. Good thorough presentation. It is prudent to move this project forward. Obviously the partners involved see the seriousness of this. . Important to be proactive to minimize issues in the future. . The project meets the criteria for the CUP as stated in the staff report. . Support. Billington: . It appears to be well organized and professionally engineered. . With staffs recommendations in terms of the plan, I will support. Ringstad: . Support as well. Looks like an excellent joint partnership. . Agree with fellow Commissioners it is a well thought out project. . Will vote yes. Lemke: . Agree - the conditions of the CUP have been met. . Support. Perez: . Questioned the work hours for the site. Poppler responded work hours are normally 7 a.m. to 7 p.m. MOTION BY PEREZ, SECOND BY BILLINGTON, APPROVING RESOLUTION 05- 18PC A CONDITIONAL USE PERMIT TO ALLOW GRADING AND EXCAVATION OF MORE THAN 400 CUBIC YARDS.
