The City has received a renewal request from Baseball Association 191 for a pull tab premise permit for O'Malley's On Main. The Issues Baseball Association has provided the City with the required documents and has paid the $100.00 renewal fee. The Prior Lake Police Department has completed its investigation of this organization and has found no reason to deny this permit renewal request. As a condition of the initial approval of this permit, Baseball Association 191 had to agree to make a contribution to the Laker Athletic Booster Club. Rich VanderLaan, the gambling manager for Baseball Association 191 has verified that a contribution to LABC has been made. The City Council has the following alternatives: 1. Adopt the proposed premise permit resolution. 2. Deny the premise permit renewal request. Staff recommends Council approve the renewal of premise permit for Baseball Association 191 for O'Malley's On Main. Prior Lake, MN 55372-1714 RESOLUTION OS-XX RESOLUTION APPROVING THE PREMISE PERMIT RENEWAL APPLICATIONS FOR LAWFUL GAMBLING OF BASEBALL ASSOCIATION 191 MOTION BY: SECOND BY: WHEREAS, the State of Minnesota requires that a municipality adopt a resolution in support of an organization to conduct lawful gambling at a particular premise, and WHEREAS, Baseball Association 191 is requesting renewal of their lawful gambling permit, and WHEREAS, Baseball Association 191 has been conducting lawful gambling at the premises of O'Malley's on Main, 16211 Main Avenue SE, and WHEREAS, Baseball Association 191's previous gambling licenses will expire. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE AS FOLLOWS: 1. The recitals set forth above are incorporated herein. 2. Baseball Association 191 is hereby approved to conduct lawful gambling at the premise of O'Malley's On Main, 16211 Main Avenue SE, for a period of two years effective upon approval by the Gambling Control Division of the State of Minnesota. Passed and adopted this 7th day of November, 2005.
