Prior Lake, MN 55372-1714 RESOLUTION 05-181 WHEREAS, Motion By: Fleming Second By: Petersen on July 18, 2005, the City Council approved the preliminary plat known as The Wilds Ridge North, subject to conditions identified by Resolution 05-129; and WHEREAS, The City Council has found that the final plat of "The Wilds Ridge North" is in substantial compliance with the approved preliminary plat for The Wilds Ridge North; and WHEREAS, The City Council has approved the final plat of "The Wilds Ridge North." NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The final plat of "The Wilds Ridge North" is approved subject to the conditions set forth in this resolution. a) The final plat of "The Wilds Ridge North" is subject to the following conditions, which shall be met prior to release of and recording of the final plat: b) A current title opinion or commitment of title insurance that is acceptable to the City Attorney must be submitted. c) Payment of all fees prior to release of the final.plat mylars. d) Reductions of the entire final plat be submitted, to the following scales: 1" = 200'; and one reduction at no scale which fits onto an 81/2" x 11" sheet of paper. e) Four mylar sets of the final plat with all required signatures must be submitted. f) The developer must provide financial security, acceptable to the City Engineer prior to release of the final plat mylars. g) The final plat and all pertinent documents must be filed ~ith Scott County within 90 days from the date of final plat approval. Failure to record the documents by February 7, 2006, will render the final plat null and void. 3. hereby authorized to execute the Development Contract on The Mayor and City Manager are behalf of the City. Prior Lake, MN 55372-1714 RESOLUTION 05-182 RESOLUTION APPROVING A PROPOSED AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR THE PROPERTY LOCATED NORTH OF CSAH 42, EAST OF CSAH 83, AND WEST OF CSAH 21 MOTION BY: Fleming SECOND BY: Petersen WHEREAS RECITALS Shepherd of the Lake Lutheran Church submitted an application for an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map to change the designation of the following described property from the R-HD (High Density Residential) designation to the C-CC (Commercial Retail Shopping) designation: That part of the Southwest Quarter of the Southeast Quarter and the East one-half of the Southeast Quarter of the Southwest Quarter of Section 22, Township 115, Range 22, Scott County, Minnesota, described as commencing at the south quarter of said Section 22; thence North 1 degree 08 minutes 56 seconds East, assumed bearing, along the north-south quarter line of said Section 22, a distance of 132.08 feet to a point on the northerly right of way line of County Road No. 42 (140th Street), the point of beginning of the tract to be described; thence South 89 degrees 10 minutes 17 seconds West, along said northerly right of way line, a distance of 5.33 feet; thence South 88 degrees 30 minutes 00 seconds West, along said northerly right of way line, a distance of 115.86 feet; thence North 1 degree 30 minutes 00 seconds West a distance of 99.10 feet; thence northerly a distance of 67.42 feet along a tangential curve, concave to the west, having a radius of 1165.00 feet and a central angle of 3 degrees 18 minutes 57 seconds; thence northerly a distance of 102.77 feet, along a reverse curve, concave to the east, having a radius of 1085.00 feet and a central angle of 5 degrees 25 minutes 38 seconds; thence North 86 degrees 32 minutes 33 seconds East, not tangent to said curve, a distance of 110.68 feet; thence South 60 degrees 39 minutes 05 seconds East a distance of 127.62 feet; thence South 0 degrees 55 minutes 09 seconds West a distance of 208.82 feet to said northerly right of way line; thence south 89 degrees 10 minutes 17 seconds West, along said northerly right of way line, a distance of 87.16 feet to the point of beginning. WHEREAS Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS The Planning Commission conducted a public hearing on October 10, 2005, for those interested in this request to present their views; and WHEREAS On October 10, 2005, the Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the C-CC designation is consistent with the goals and objectives of the Comprehensive Plan; and WHEREAS On November 7, 2005, the Prior Lake City Council considered the proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property to the C-CC designation and; WHEREAS The City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports; and WHEREAS The City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: The above recitals are herein fully incorporated herein as set forth above. The proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property as C-CC (Commercial Retail Shopping) is hereby approved. Approval of this amendment is subject to the approval of the Metropolitan Council.
