Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT NOVEMBER 21, 2005 SF JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1168 (PRIOR LAKE PROFESSIONAL BUILDING) CIC PLAT I ntrod uction Nova Praha Leasing Company, LLC, is requesting approval of a Common Interest Condominium plat for the 3 unit office building located at 14120 Commerce Avenue. This building houses the Hines/Puffer optometric clinic and dentist office. The staff recommends approval of this CIC plat as part of the consent agenda. Historv Construction on this office building began in 2004 and was completed in 2005. The building was constructed on Lot 2, Block 1, James 151 Addition, a platted lot of record. Current Circumstances The purpose of a CIC plat is to allow the subdivision of a building into lots for each individual unit for sale to individual owners. Essentially, the plat creates a lot around the four walls of an individual unit. CIC plats are typically done following the actual construction of the buildings in question, and usually for residential properties. However, this practice is becoming more common for commercial buildings also. This CIC plat includes 3 units. It does not change the configuration or the permitted uses in the building. Staff has reviewed the CIC plat and finds it generally consistent with the approved preliminary and final plat. The CIC plat must be revised to include a signature line for the City. CIC plats do not require a development contract. The required developer improvements were included under a previous final plat, so a Letter of Credit is not necessary. In addition, the City fees normally associated with a final plat were collected with the original plat. There are no budget impacts with the approval of this CIC plat since the building has already been built. The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1168 (Prior Lake Professional Building) CIC Plat, subject to the listed conditions. 2. RECOMMENDED MOTION: A motion and second to adopt a resolution approving the Common Interest Community Number 1168 (Prior Lake Professional Building) CIC Plat, subject to the listed condition, and authorizing the Mayor and City Manager to sign the CIC plat documents is required. 16200 Eagle Creek Avenue S.E. Prior Lake, MN 55372-1714 RESOLUTION 05-xx A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN THE COMMON INTEREST COMMUNITY NUMBER 1168 (PRIOR LAKE PROFESSIONAL BUILDING) CIC PLAT Motion By: Second By: WHEREAS, On May 4, 1981, the City Council approved the final plat of James First Addition; and WHEREAS, In 2005, construction of the building known as the Prior Lake Professional Building was completed; and WHEREAS, The City Council has found that the Common Interest Community Number 1168 (Prior Lake Professional Building) CIC Plat is in substantial compliance with the approved final plat for James First Addition. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council approves the Common Interest Community Number 1168 (Prior Lake Professional Building) CIC Plat, subject to the condition that the plat be revised to include a signature line for the City of Prior Lake. 3. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by January 21, 2006, will render the CIC plat null and void. 4. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
