CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING
THE MAYOR AND CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH THE METROPOLITAN COUNCIL
ENVIRONMENTAL SERVICES FOR RECONVEYANCE THE
MET COUNCIL INTERCEPTOR AND LIFT STATION
Introduction
The purpose of this agenda item is to authorize the Mayor and
City Manager to enter into an agreement with the Metropolitan
Council Environmental Services (MCES) for the reconveyance of
interceptor 7120 from County Highway 82 to Lift Station lS58.
The attached exhibit shows the segment interceptor to be
reconveyed.
History
In accordance with State Statute 473.5111, the MCES has
determined that the portion of the sanitary sewer interceptor
system from Manhole 70 (MH 70) at the intersection of County
Highway 82 and County Highway 21 to, and including, the lift
station (l58) adjacent to the old maintenance facility at CH 21 and
Adelmann St. is no longer of regional benefit. In other words, this
segment of line only serves Prior lake and no other communities.
The MCES is proposing to "turn back" this segment of pipe in
much the same manner as the County or State turns back a
roadway that no longer serves a regional purpose. From MH 70
northerly along the CH 21 alignment, the interceptor still provides
a benefit to the Shakopee Mdewakanton Sioux Community
(SMSC), so that portion would still be owned and operated by the
MCES. At some time in the future when the SMSC Sewage
Treatment Plant is on-line and has been permitted, the MCES
may consider the reconveyance of the remainder of the
interceptor from CR 82 to the northerly City limits.

The City Council reviewed the MCES request at your March 31,
2005, meeting and gave staff direction to respond with the
following conditions to the MCES for reconveyance:
1. The MCES include a full ten-year warranty for the reconveyed
interceptor.
2. The MCES, at its cost, reconstruct Lift Station No. 58 to match
the City Standardized Lift Station Design.
3. The MCES, at its cost, repairs the lines the City identified
during our inspection of video.
4. That when the MCES reconveys the interceptor segment north
of CR 82 which includes the SMSC, the MCES credits the City
the SAC units already paid and committed for the line, which
follows your current policy.
5. The MCES, at its cost, televise the line again in ten years at
the end of the warranty period.
City and MCES staff met in June and discussed the above issues.
On July 15, the MCES responded in writing and agreed to
conditions #2 and #3. Two required repairs were identified by the
City in our review of the interceptor. MCES has initiated projects
to make these repairs by next spring. The MCES also indicated
they would work with our staff on condition #5. The MCES did not
agree to condition #1 and has reiterated that a sliding ten-year
warranty which is standard reconveyance policy is sufficient. This
means that in 2006 the MCES would cover 100% of the cost of
any required repairs and in 2015 the last year of the warranty they
would cover 10% of any repair costs. Condition #4 will be part of
any reconveyance agreement negotiations for that segment of
interceptor.
Current Circumstances
The MCES has requested that the City act formally on the
proposed conditions for the interceptor and lift station
reconveyance. The City has very little latitude under the statute.
The law does not provide for the City to reject the proposed turn
back.
City staff recommends recognizing that the long-term ownership of
this line could be at significant cost to the City in maintenance and
replacement. It was constructed in the 1970's and could last over
one hundred years without major repair. However, if a failure
does take place in the line, a repair could cost well into the
hundreds of thousands of dollars.

Conclusion
Staff is recommending that the Council authorize the Mayor and
City Manager to enter into an agreement with the MCES for the
reconveyance of a segment of the interceptor to the City and
upgrade to lift station 58. Based on meetings and negotiations,
City staff feels these are agreeable terms and the most favorable
for the City.
Authorizing the agreement will not have any immediate financial
impact for the City. However, with the added infrastructure to the
City's inventory, the potential for significant costs in the long term
are increased if any maintenance and repairs are needed.
Because there will be a sliding warranty for the next ten years, the
City should consider setting aside funds over that period for future
emergency repairs.
The alternatives are as follows:
1. Approve a resolution authorizing the Mayor and City Manager
to enter into an agreement with the MCES for the
reconveyance of a segment of the interceptor to the City and
upgrade to lift station 58, and direct staff to propose funding of
an emergency account as part of the 2006-2010 CIP process.
2. Table this item for a specific reason.
3. Deny this agenda item for a specific reason and provide staff
with direction.
Staff recommends alternative number 1.

WHEREAS, The MCES is requesting that the City of Prior Lake take ownership of
interceptor 7120 (from MH 70 to LS 58) since no other communities
benefit from this segment; and
WHEREAS, City staff and the MCES have met and agreed upon acceptable
conditions for the turn back, including MCES upgrading lift station 58 to
city standards and a ten-year sliding scale warranty for the cost of future
repairs; and
WHEREAS, City staff reviewed the condition of the pipe with our consultant and have
found it to be in good condition; and
WHEREAS, City staff recommends accepting the terms of the agreement as agreed
with the MCES.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA, that:
1. The recitals set forth above are incorporated herein.
2. The City Council authorizes the Mayor and City Manager to enter into an agreement with
the MCES for the reconveyance of interceptor 7120 (from MH 70 to LS 58) to the City and
an upgrade to lift station 58 to City standards at MCES expense.

SUBJECT: Interceptor MSB 7120 and Lift Station 58
Dear Mr. Boyles,
On June 2,2005 I met with you and several of your staff to discuss reconveyance issues
associated with warranty and Lift Station 58. In regard to the City's request for a full ten
year warranty I explained that the Council only provides a ten year sliding scale wmanty
on facilities that are reconveyed. In the matter of Lift Station 58, I agreed that
Environmental Services staff would work with your staff to refurbish the station and in
doing so would ensure that the station communications would be compatible with the
City's current stations. The refurbishing work would be done as a cooperative
construction and reconveyance agreement.
We would like to move forward with the reconveyance process. Accordingly, Mr.

RE: City of Prior Lake comments on the Prior Lake Interceptor Reconveyance
Dear Mr. Moore:
Thank you for the opportunity to provide our input on the MCES's proposed decision to
reconvey a segment of the Prior Lake interceptor to the City. At the March 21, 2005 City
Council meeting, the issue of objecting to the MCES determination that the pipe in question
has no local.significance was discussed. The City Council also discussed whether to accept
the reconveyance subject to certain conditions. The City Council will agree to the
reconveyance if the following conditions are met by the MCES:
· That the MCES include a full I 0 year warranty for the reconveyed interceptor.
. That the MCES, at its cost, reconstruct Lift Station No. 58 to match the City Standardized
Lift Station design.
· That the MCES, at its cost, repair the line as we have found in our inspection of your video
tapes. (inspection report attached)
. That when the MCES reconveys the segment of the interceptor north of CH 82, which
would include the Shakopee Mdewakanton Sioux Community.f1ows, the MCES credit the
City the SAC units alreaclypaid and committed for the line, which follows your current
policy.
· That the MCES, at its cost, televise the line again in 10 years at the end of the warranty
period. .
