PRIOR LAKE PLANNING COMMISSION MINUTES
Monday, July 23, 2018
1. Call to Order and Pledge of Allegiance:
Commissioner Fleming called the Monday, June 23, 2018 Prior Lake Planning Commission meeting to
order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, William Kallberg,
Dan Ringstad, Jason Tschetter, and Liaison Zach Braid. Also present were Planner Jeff Matzke and
Community Development Services Assistant Sandra Woods.
2. Approval of Agenda:
MOTION BY TSCHETTER, SECONDED BY KALLBERG TO APPROVE THE MONDAY, JULY 23, 2018
PRIOR LAKE PLANNING COMMISSION AGENDA.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
3. Approval of Monday, July 9, 2018 Meeting Minutes:
MOTION BY RINGSTAD, SECONDED BY TSCHETTER TO APPROVE THE MONDAY, JULY 9, 2018
PRIOR LAKE PLANNING COMMISSION MEETING MINUTES.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
4. Public Hearings:
A. Ordinance Amendments – Amendments to Part 10, Subdivision Code – Consider Amendments
to Part 10 (Subdivision Code) of the City Ordinance.
Planner Matzke: Introduced an Ordinance Amendment to Part 10, Subdivision Code, and Section 1101,
General Provision, of the Zoning Code. He explained the current circumstances, issues, and
recommended a motion. He presented proposed amendments to the Subdivision Code and Section
1101 of the Zoning Code.
Commission Comments/Questions:
Fleming: Thanked Planner Matzke and his team for reviewal of the manual. He commented on some
word usages and questioned the changes in verbiage, what to expect with future reports versus the
current reports and the information sent to the Commissioners now. He asked if we found these terms
from other municipalities.
Planner Matzke: Explained the changes in verbiage and stated the City Attorney proposed the
recommendation of the changes. He explained how the definitions differ and stated it is to reduce
confusion.
Tschetter: Said he appreciates the time taken to review this information, mentioned it is important to
consolidate and simplify the language, as well as to make references to common definitions. He
commented on the great progress and how it reflects the evolution of our city and where we were
seventeen years ago compared to today.
Ringstad: Questioned the Section 1002; signage in subdivision and commented on published and mailed
notifications not be read or reviewed while most would read a sign. He stated he likes the verbiage of
“may install a sign”; however, shared questioned how much ownership it would put on the City if the
verbiage was changed to “will install a sign” instead of “may install a sign”.
Planner Matzke: Explained the ownership to the City of changing the verbiage to “will install a sign”
instead of “may install a sign”. He commented on the difficulty of installing a sign in the inclement weather
in Minnesota and explained how the word “may” would help everyone understand that it is not a statutory
requirement; however, he would talk with Public Works staff to see if they could meet the suggested
obligation and commented on timeline of installing the signs.
Ringstad: Agreed with the reference to inclement weather and the expectations of a sign being installed.
He said he is comfortable with the current verbiage and has faith the signs will be installed.

Tieman: Stated he has no changes, everything looks good, it is a nice addition, and the changes make
sense. He said good job by you and your staff.
Kallberg: Asked if his submitted changes were shared with the other Commissioners.
Planner Matzke: Said he didn’t share his comment submission, as it was mostly clarification of grammar
or moving of graphics. He said he would be glad to share these updates with the Commissioners though.
Kallberg: Stated there was nothing that would change the Commissioners decision making. He
commented on the monumental effort staff put into these changes to eliminate inconsistenc y between
different verbiage. He said he has no issues with the changes.
Fleming: Clarified there is no public attendance in the Chamber.

MOTION BY TSCHETTER, SECONDED BY KALLBERG, TO CLOSE THE PUBLIC HEARING ON 4A
AT 6:26 P.M.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
MOTION BY RINGSTAD, SECONDED BY KALLBERG TO RECOMMEND AMENDMENTS TO PART
10 (SUBDIVISION CODE) AND SECTION 1101 OF THE ZONING CODE (GENERAL PROVISION) TO
THE CITY COUNCIL.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.
B. Ordinance Amendment – Amendments to Section 1106 (Planned Unit Developments) – Consider
Amendments to Section 1106 (Planned Unit Developments, PUDs) of the Zoning Ordinance
related to Planned Unit Development public hearing procedures.
Planner Matzke: Introduced consideration of a request to recommend amendments to Section 1106,
Planned Unit Developments of the City Code. He explained the current circumstances, issues, and
recommended a motion. He presented proposed amendments to Section 1106 (Planned Unit
Developments) of the City Code.
Commission Comments/Questions:
Fleming: Asked what affect the change in the report regarding the Final PUD Plan application timelines
will have on the approval process.
Planner Matzke: Explained timelines regarding submissions of the preliminary and final plat being
difficult to achieve by applicants and developers. He commented on the timelines for submittal date,
practices, industry standards and the number of requests for exceptions to this rule. He stated eliminating
that step was the outcome as there is not any anticipated conflict by eliminating that step.
Fleming: Asked if there would be any unintended consequences of developers creating timing issues for
the rest of the process.
Planner Matzke Replied not really and explained the timeframes and certain action items that take place
at the City Council and/or Planning Commission level. He commented on plats and/or PUD resolution
timeframes and how they could become null and void after a said date. He explained the checks and
balances set elsewhere; ordinance with allowances being reversed by the City Council and the outcome
of the reversal.
Fleming: Stated that satisfies his question and clarified he likes to consider unattended consequences.
Tschetter: Shared that he thinks many residents might recoil if we are talking about taking away public
hearings; however, there is clear criteria, so it is applicable. He commented on the unnecessary step of

having a public hearing on a final when there have been no changes since the preliminary. He thanked
Planner Matzke for the explanation and thought process that has gone into this subject.

MOTION BY TSCHETTER, SECONDED BY RINGSTAD TO RECOMMEND APPROVAL OF THE
AMENDMENTS TO SECTION 1106 (PLANNED UNIT DEVELOPMENTS) TO THE CITY COUNCIL.
VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad and Tschetter. The Motion carried.

Fleming: Asked for clarification on the extension for the comp plan submittal date of July 2019.
Planner Matzke: Explained the package can be submitted at any time prior to the month of July. He
mentioned the reason for the timeline.
