Integrate trails to link neighborhoods with city and regional assets. 5. Focus on key corridors that take advantage of collaboration with state and county projects. DISCUSSION: Introduction The City Council is being asked to consider approval of a resolution authorizing the Mayor and City Manager to execute a permit with MnDOT for utilizing the City’s existing drainage and utility easement along TH13 as part of the drainage improvements associated with the trail construction from Duluth Avenue to Anna Trail. History As part of the 2019 TH13 Reclamation Project a new pedestrian trail will be constructed along the west side of TH13 from Five Hawks Avenue north to Anna Trail. This includes construction of the trail adjacent to several existing commercial properties including Subway, Honest-1 Auto Care, and Klein Bank. Each of these businesses currently discharges surface storm water runoff from their parking lots through openings in their curb and into the existing ditch along TH13. With the construction of the new trail between these parking lots and the ditch along TH13, it was necessary to incorporate storm water improvements to prevent the storm water runoff from flowing across the surface of the new trail and causing long term maintenance issues. The improvements include constructing catch basins in the respective parking lots and directing the storm water runoff into storm sewer pipes that will be installed beneath the new trail and outlet into the ditch along TH13. The construction of the catch basins and storm sewer on these properties requires temporary easements to accommodate the construction on private property. City staff worked with the owners of all three properties to obtain the necessary easements. All three property owners were very cooperative and agreed to provide the temporary easements at no cost to the City. Current Circumstances Two of the three affected properties are platted lots. As part of the platting process 10-foot drainage and utility easements were dedicated to the City along the property lines of both the Subway and Honest-1 Auto Care properties. The City therefore has the right to utilize those existing easements for utility purposes which includes storm sewer improvements. The Klein Bank property is not a platted lot, so the City had to obtain a permanent drainage and utility easement for the proposed storm sewer improvements. The TH13 project is being contracted and managed by MnDOT. Since the drainage and utility easements are dedicated to the City of Prior Lake, MnDOT is requesting approval of a zero dollar permit to construct the new storm water improvements within the City’s easements. A copy of the proposed permit is attached to this memo. ISSUES: The impacted property owners are aware of the proposed storm sewer improvements and have agreed to the work. This permit with MnDOT is a technical requirement that is being done at the request of MnDOT to allow them to work within the existing easements that are dedicated to the City. FINANCIAL IMPACT: The requested permit from MnDOT is a zero dollar permit, so there is no financial consideration associated with this permit. ALTERNATIVES: 1. Motion and a second as part of the consent agenda approving a resolution authorizing the Mayor and City Manager to execute a zero dollar permit to MnDOT to temporarily utilize a drainage and utility easement for storm sewer improvements associated with the TH13 Reclamation Project. 2. Motion and a second to remove this item from the consent agenda for additional discussion. RECOMMENDED MOTION: Alternative #1 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 18-___ A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO EXECUTE A ZERO DOLLAR PERMIT TO MNDOT TO TEMPORARILY UTILIZE DRAINAGE AND UTILITY EASEMENTS FOR STORM SEWER IMPROVEMENTS ASSOCIATED WITH THE TH13 IMPROVEMENT PROJECT Motion By: Second By: WHEREAS, the City of Prior Lake has interest in property described as: Parcel 217 per Control Section 701 (13=117) 901; and WHEREAS, the Minnesota Department of Transportation (MnDOT) will need to temporarily utilize said real property to construct, maintain, and operate the Trunk Highway 13; and WHEREAS, a zero dollar permit to construct was drafted by MnDOT; and WHEREAS, the City of Prior Lake agreed to the terms of the zero dollar permit to construct. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City of Prior Lake hereby approves and authorized temporary easement by permit to the Minnesota Department of Transportation. 3. The City of Prior Lake Council hereby authorizes the Mayor and City Manager to sign the Zero Dollar Permit to Construct.
