Encourage Development and Preservation of Quality Life-Cycle Residential Housing Options. DISCUSSION: Introduction St. Paul’s Lutheran Church has applied for the approval of a registered land survey on approximately 8.2 acres of land to subdivide the church/school property into 2 properties. The property is located at 5634 Luther Road south of Hwy 13 Street and north of Woodside Road. History The church structure was constructed in the 1960s and the parsonage home added to the property in the 1980s. The Planning Commission held a public hearing on October 8, 2018 (no public comments were made) and recommended approval of the Registered Land Survey request. Current Circumstances The applicant proposes to designate the two properties as a registered land survey. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS: Total Site Area: The total site area consists of 8.2 acres. The current property contains one single family home and a church/school facility. Wetlands: No wetlands are located on the properties. Access: Access to the property is currently from Woodside Road and Luther Avenue. 2030 Comprehensive Plan Designation: The property is designated R-LD for Urban Low Density Residential uses on the 2030 Comprehensive Plan Land Use Map. Zoning: The property is located within the R-1 Zoning District (Low Density Residential). The R-1 district is consistent with the proposed R-LD designation. This district permits a maximum density of 4.0 units per acre. Shoreland: The properties are located within the Shoreland District of Prior Lake and are subject to the City’s Shoreland Ordinance. PROPOSED PLAN Lots: The proposed registered land survey consists of 2 lots. Tract A is 12,936 square feet and contains the existing house; Tract B is 347,141 square feet and contains the existing church/school. The minimum required lot size for the R-1 District is 12,000 square feet. Streets: The proposed lots have frontage on existing Woodside Road and Luther Road. No new streets are proposed. Sanitary Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in place for all the properties. Shoreland Ordinance: The proposed registered land survey is located within the Shoreland District for Prior Lake and therefore the properties are required to meet the requirements of the Shoreland Ordinance including but not limited to a maximum impervious surface area of no more than 30% of the total lot area. The two properties are proposed at 29.6% and 25.4% impervious surface respectively. ISSUES: Conclusion The applicant has proposed to subdivide the church/school property into two properties so that the single-family home property may be sold separately. All the properties will meet the City lot area and width requirements for the R-1 Zoning District. Separate utility services are in place for properties. The proposed registered land survey will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. Therefore, City Staff recommends approval of registered land survey subject to the outlined condition. City Staff recommend approval of the registered land survey with the following conditions of approval: 1. The registered land survey shall be recorded at Scott County within 90 days of approval by the City Council. FINANCIAL IMPACT: Approval of the registered land survey will allow the property to be subdivided and the separate sale of the existing single-family dwelling would be possible. ALTERNATIVES: 1.Motion and second as part of the consent agenda to approve a resolution approving the registered land survey subject to conditions set forth in this staff report. 2.Motion and second to remove this item from the consent agenda for additional discussion. RECOMMENDED MOTION: Alternative #1 EXHIBITS: 1.Location Map 2.Proposed Registered Land Survey Plans 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 18-___ A RESOLUTION APPROVING A REGISTERED LAND SURVEY AT 5634 LUTHER ROAD Motion By: Second By: WHEREAS, The Prior Lake Planning Commission conducted a public hearing on October 8, 2018, to consider a registered land survey application from St. Paul’s Lutheran Church; and WHEREAS, Notice of the public hearing on said registered land survey has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and WHEREAS, All persons interested in this issue were afforded the opportunity to present their views and objections related to the registered land survey for the record at the public hearing conducted by the Planning Commission; and WHEREAS, The Planning Commission and City Council have reviewed the registered land survey according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said registered land survey to be consistent with the provisions of said ordinances; and WHEREAS, The Prior Lake City Council considered an application for such registered land survey on October 15, 2018; and WHEREAS, The City Council has the authority to impose reasonable conditions on a registered land survey. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The registered land survey is approved at the property located at 5634 Luther Road subject to the conditions set forth in this resolution: a. The registered land survey shall be recorded at Scott County within 90 days of approval by the City Council. Failure to record the documents by January 13, 2018 will render the registered land survey null and void. Passed and adopted by the Prior Lake City Council this 15th day of October 2018.
