CITY PROJECT #TRN19-000002 GOAL AREA AND OBJECTIVE: Transportation & Mobility 1. Maintain quality local street system based on a financially stable plan that meets Overall Condition targets. DISCUSSION: Introduction The purpose of this agenda item is to initiate the process for local improvements set forth in the 2019 portion of the 2019-2028 Capital Improvement Program in ac- cordance with Minnesota Statutes (M.S.), Chapter 475. History The City uses the Five Year Capital Improvement Program to plan its infrastruc- ture improvements and the financing for capital improvements. The 2019 Im- provement Project proposes to provide a full depth pavement reclamation with spot curb replacement and will not include pipe work. The City intends to utilize Street Reconstruction bonds. The use of Street Recon- struction bonds is outlined in State Statute 475. The use of Street Reconstruction bonds does not require any percentage of the project cost to be assessed, but it does not preclude the use of assessments. The alternative would be to follow the State Statute 429 process. That process requires the City to assess a minimum of 20% of the improvement cost. We do not anticipate being able to reach the 20% threshold for this project so that is why we are following the State Statute 475 pro- cess. Even though we are proposing to finance the project utilizing the process outlined in M.S. Chapter 475, we still propose to follow the public involvement process out- lined in M.S. Chapter 429. The first step in the M.S. 429 process is for the Council to order the preparation of a Feasibility Report for the improvement projects. The Feasibility Report will address options and costs for the reconstruction of the streets. City assessment policy will be applied to the preliminary assessment cal- culation which is completed as a part of the Feasibility Reports. 2 Current Circumstances The project is in the Capital Improvement Program designated for improvement in 2019. The project funding is proposed to include special assessments and financ- ing through bond proceeds, and therefore requires the City to follow the require- ments of M.S. Chapter 475. The primary purpose for proceeding with this project is to upgrade the street and curb conditions. The pavement condition is poor and requires a full depth recla- mation in accordance with the city’s desire to maintain high Overall Condition In- dex ratings on its roadways. At their October 1, 2018 meeting, the city council directed that the staff place dis- cussion of this project on the work session agenda preceding this meeting. The council appeared to be concerned about two factors: bonding and inconvenience to motorists and pedestrians. If this item has not been removed from the consent agenda, it means the city council is willing to reconsider this item tonight to receive the best bids it is important that the city proceed with the feasibility report as soon as possible. Conclusion Ordering the Feasibility Reports is the first step in the reconstruction process. The Feasibility Report will provide the details needed for the City to make decisions on how to proceed. ISSUES: The Feasibility Report will determine the estimated costs of improvements and methods of financing. The preparation of the Feasibility Report is only the first step in the public improve- ment project process. Following receipt of the Feasibility Report, the Council will direct City staff to abandon or proceed with the improvement project. If the project proceeds, the Council can then schedule a Public Hearing to consider resident feedback on the project. Following a Public Hearing, the Council will consider whether to move forward by authorizing the preparation of plans and specifica- tions. Once completed, the City Council will be asked to approve the plans and specifications, authorize advertisement for bids and then award the contract. FINANCIAL IMPACT: The financial impact the project will be further analyzed in the Feasibility Report in- cluding the preparation of preliminary assessment calculations. The CIP estimate for the Fish Point Road Improvement is $636,000. ALTERNATIVES: 1. Motion and a second as part of the consent agenda approving a resolution or- dering the preparation of a Feasibility Report for the Fish Point Road (County Road 21 to Fawn Meadow Curve) Improvement Project. 2. Motion and a second to remove this item from the consent agenda for addi- tional discussion. RECOMMENDED MOTION: Alternative #1. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 18-___ A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR THE FISH POINT ROAD (COUNTY RD 21 TO FAWN MEADOW CURVE) IMPROVEMENT PROJECT, CITY PROJECT #TRN19-000002 Motion By:Second By: WHEREAS, The 2019-2028 Capital Improvement Program identifies the improvement of Fish Point Road (County Rd 21 to Fawn Meadow Curve) in 2019; and WHEREAS, It is necessary to determine the feasibility of undertaking the construction of said improvements within this project area including full depth pavement reclamation and spot curb replacement and appurtenant work; and WHEREAS, It is proposed to assess the benefited property for all or a portion of the cost of the improvements, pursuant to Minnesota Statutes, Chapter 429. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1.The recitals set forth above are incorporated herein. 2.That the proposed improvements be referred to the City Engineer for study and that the City Engineer is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvements are necessary, cost-effective and feasible and as to whether they should best be made as proposed or in connection with other improvements, and the estimated costs for the improvements as recommended.
