AND CITY MANAGER TO EXECUTE A LIMITED USE PERMIT WITH THE
STATE OF MINNESOTA DEPARTMENT OF TRANSPORTATION FOR THE
TH13/CSAH42 CITY MONUMENT SIGN, CITY PROJECT #TRN 17-000001

Introduction
The City Council is being asked to authorize a limited use permit with the State of
Minnesota Department of Transportation for the City’s monument sign located at
the southwest corner of TH13/CSAH42. This permit is necessary to construct
and maintain the monument sign in State right-of-way.
History
As part of the construction for the current CSAH42 improvements it was necessary
to temporarily remove the City’s monument sign that was located in the southwest
corner of TH13/CSAH42 to facilitate the construction of a retaining wall and ac-
commodate changes to the grades in that location.
Current Circumstances
The CSAH42 improvements are nearing completion and it is now appropriate to
reinstall the City’s monument sign. The location of the sign is within the TH13
right-of-way, so City staff contacted MnDOT to confirm what permission was
needed to reinstall the sign. It was discovered that there was not a current per-
mit in place for the original sign. It is therefore necessary to enter into a Limited
Use Permit for the installation of the City’s monument sign within MnDOT’s right-
of -way.
Conclusion
Staff recommends approval of the limited use permit as shown in the attached
resolution.
ISSUES: The limited use permit is a standard document which should have been in place
previously to allow for its location within MnDOT’s right-of-way.
FINANCIAL
IMPACT:
The monument sign will be maintained by the City similar to the other monument
signs located throughout the City. No unusual fiscal impact is expected for the
sign maintenance.

The installation of the sign will be completed by City staff, so no outside costs will
be incurred for this work.
ALTERNATIVES: 1.Consider Approval of a Resolution as Part of the Consent Agenda
Authorizing a Limited Use Permit with the State of Minnesota Department of
Transportation for the TH13/CSAH42 Mon-ument Sign, City Project No.
TRN17-000001.
2.Remove this item from the consent agenda for further discussion.

RESOLUTION NO 18-___
CITY OF PRIOR LAKE LIMITED USE PERMIT
WITH THE STATE OF MINNESOTA
DEPARTMENT OF TRANSPORTATION
FOR A MUNICIPAL IDENTIFICATION ENTRANCE SIGN IN THE RIGHT- OF-WAY OF
TRUNK HIGHWAY 13 AT CSAH42
WHEREAS, the City of Prior Lake is a political subdivision, organized and existing under
the laws of the State of Minnesota; and,
WHEREAS, the City Council of the City of Prior Lake has approved a plan to construct a
municipal identification entrance sign (sign) in the right-of way of Trunk Highway 13 to promote
the orderly and safe crossing of the highway; and,
WHEREAS, the State of Minnesota, Department of Transportation requires a Limited Use
Permit for the construction and utilization of said sign.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Prior Lake hereby
enters into a Limited Use Permit with the State of Minnesota, Department of Transportation for
the following purposes:
To construct, operate and maintain a sign within the right- of- way of Trunk Highway 13
(TH 13 = 117) of the State of Minnesota along CSAH42 (Egan Dr.). The City of Prior Lake
shall construct, operate and maintain said sign in accordance with the Limited Use Permit
granted by the Minnesota Department of Transportation.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Mayor and the City Manager are
authorized to execute the Limited Use Permit and any amendments to the Permit.

Council of the City of Prior Lake at an authorized meeting held on the 5th day of November 2018,
