PREPARATION OF A FEASIBILITY STUDY FOR THE 2019 MILL AND
OVERLAY IMPROVEMENT PROJECT

Introduction
The purpose of this agenda item is to initiate the process for the 2019
Street Overlay project in accordance with Minnesota Statutes (M.S.),
Chapter 429
History
The City’s goal is to annually complete 3.5-4.0 miles of mill and overlay
type improvement projects. The 2019 project anticipates the use of
assessments to finance a portion of the project costs. The M.S. Chapter
429 process applies to all projects that will be financed in whole or part
through special assessments or bond proceeds.
Current Circumstances
The first step in the process is for the Council to order the preparation of
a Feasibility Report for the improvement project.
The Feasibility Report will identify the improvements to be made,
estimated project costs, and a project financing summary. Similar to
2017 and 2018, it is proposed that the project will include assessments
consistent with the City’s 2019 Fee Schedule.
The 2019 Overlay Project proposes to improve Pike Lake Trail from
CSAH 42 south to Carriage Hills Parkway, Fountain Hills Drive, Fountain
Hills Court, Robin Drive, Hummingbird Trail, Bluebird Trail, Partridge
Court, Seagull Circle, and Hummingbird Court. The total length of streets
proposed to be overlaid is 3.26 miles.

Conclusion
Ordering the Feasibility Report is the first step in the M.S. 429 process.
The Feasibility Report will provide the details needed for the City to make
decisions on how to proceed.
ISSUES: The City is required to assess a minimum of 20% of the cost of public
improvement projects completed through the Chapter 429 process. The
Feasibility Report will determine the estimated costs of improvements and
methods of financing. The Feasibility Report will also determine if the
assessment will meet the minimum requirement as set forth in the
Chapter 429 process.
The preparation of the Feasibility Report is only the first step in the public
improvement project process. Following the receipt of the Feasibility
Report, the Council will direct City staff to abandon or proceed with the
improvement project, depending upon whether the requirements for the
Chapter 429 process are being met. If the Chapter 429 process is to
proceed, the Council can then schedule a Public Hearing to consider
resident feedback on the project. Following a Public Hearing, the Council
will consider whether to move forward by authorizing the preparation of
plans and specifications. Once completed, the City Council will be asked
to approve the plans and specifications, authorize advertisement for bids
and then award the contract.
FINANCIAL
IMPACT:
The Feasibility Report will be completed by City staff. The financial
impact of the project will be further analyzed in the Feasibility Report
including the preparation of the preliminary assessment roll. There is
currently $700,000 included in the draft budget for the Public
Improvement Revolving fund in 2019 for this project.
ALTERNATIVES: 1. Motion and second to approve a resolution as part of the consent
agenda ordering the preparation of a Feasibility Report for the
2019 Overlay Project
2. Remove this item from the consent agenda for further discussion.

A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR THE
2019 MILL AND OVERLAY IMPROVEMENT PROJECT

WHEREAS, The 2019 Public Improvement Revolving fund allots funding for annual mill and overlay
improvements identified to be Pike Lake Trail, Fountain Hills Drive, Fountin Hills Court, Robin
Drive, Hummingbird Trail, Bluebird Trail, Partridge Court, Seagull Circle, Hummingbird Court;
and
WHEREAS, It is necessary to determine the feasibility of undertaking the construction of said
improvements within this project area including partial depth milling of the pavement surface,
spot subgrade corrections, underseal and an overlay of the streets with a new bituminous
layer; and
WHEREAS, It is proposed to assess the benefited property for all or a portion of the cost of the
improvements, pursuant to Minnesota Statutes, Chapter 429 and;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. That the proposed improvements be referred to the Public Works Director for study and that the Public
Works Director is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are necessary, cost effective and feasible
and as to whether they should best be made as proposed or in connection with other improvements,
and the estimated costs for the improvements as recommended.
