Maintain quality local street system based on a financially stable plan that meets Overall Condition targets. DISCUSSION: Introduction The purpose of this agenda item is to accept the Feasibility Report and schedule a Public Hearing to be held on January 22, 2019 for the 2019 Mill and Overlay Project. History Each year the City mills and overlays street segments that are part of its Capital Improvement Program (CIP). The City uses the CIP and its Pavement Management Program to plan for infrastructure improvements and the financing for capital improvements. Special assessments were planned to be part of the financing for this project. Minnesota Statute Chapter 429 identifies a process that applies to all projects that will be financed in whole or in part through special assessments or bond proceeds. At its November 5, 2018 meeting the City Council adopted Resolution 18-173 authorizing staff to prepare a Feasibility Report for the 2019 Mill and Overlay Project. The next step for the Council is to accept the feasibility study and call for the Improvement Hearing. At the Improvement Hearing, interested persons may voice their concerns, whether or not they are in the proposed assessment area. A reasonable methodology used to calculate individual assessments for the affected parcels must be available at the hearing. Current Circumstances The 2019 Street Improvement Project affects approximately 2.84 miles of roadway throughout the City. Proposed roadways to be improved are shown on the Location Map provided in the feasibility study and include Pike Lake Trail from CSAH 42 south to Carriage Hills Parkway, Fountain 2 Hills Drive, Fountain Hills Court, Robin Drive, Hummingbird Trail, Bluebird Trail, Partridge Court, Seagull Circle, and Hummingbird Court. The proposed work type for 2019 is slightly different that was has been done historically. In the past the City has performed a mill and overlay where the bituminous pavement is edge milled and a layer of pavement, typically 1.5” thick, is placed. Unfortunately, the streets that are of age and needing an overlay are streets that were constructed in the 1990’s, prior to the City’s design requirements of including a two-foot sand subgrade beneath the streets. Since these streets do not have the sand subgrade they are more susceptible to movement due to the ground beneath them freezing and thawing which makes them crack. Therefore, when the City completes a mill and overlay of the street the cracks reflect from beneath the street up through the new pavement. This has raised concerns from residents who are being assessed for a new street surface and they see cracks appear within a year of the mill and overlay being completed. To address this concern staff is recommending modifying the construction methods for 2019. Rather than doing an edge mill, a full width mill of the entire street from curb to curb will be completed. Then prior to paving the new bituminous surface a chip seal will be performed on the underlying pavement. The chip seal acts as an elastic buffer between the older pavement beneath and the new pavement above. This is called an underseal and has been used by a number of surrounding communities and Scott County. The City of Eden Prairie uses this method and they have seen great success in minimizing the amount of reflective cracking coming up through their mill and overlay projects. Replacement of the curb and gutter will still occur where there is cracked or damaged curb and in locations to improve drainage. The feasibility report provides additional detail on the project and explores the necessity of rehabilitating the roadways as part of the City’s ongoing Street Improvement program. Conclusion In summary, the project is feasible, necessary and cost-effective to maintain the City’s road system. Approval of the Feasibility Report is the next step in the 429 process and does not grant final approval of the project. If the Council accepts the Feasibility Report, the Chapter 429 special assessment statute requires the Improvement Hearing be conducted before the City Council considers ordering the project. A public hearing is proposed for January 22, 2019. At that meeting, the proposed improvements, project schedule and assessments will be presented to the residents. ISSUES: The City’s assessment policy is being followed for this project. The policy was updated in 2016 to include assessments for mill and overlay projects and a per lot amount was set as part of the City’s fee schedule. The 3 Single Family Assessment Rate for a mill and overlay was recently updated based on the Construction Cost Index and is set at $1,266 per single family lot for 2019 (0.8 or $1013 for multifamily lots). The assessment repayment period is five (5) years or $253/$203 each year plus financing costs per the assessment policy. FINANCIAL IMPACT: The 2019 Mill and Overlay Project is proposed to be financed by Special Assessments and the Street portion of the General Fund. Revenue will come from two sources, the tax levy and special assessments. The 2019 budget anticipated at total cost of $700,000. The project as shown in the feasibility study is estimated at $800,000. The addition of the underseal adds $54,700 to the total cost. Staff recommends moving forward with the project as presented. Once bids are received and the actual costs are known, street segments can be eliminated from the project to stay within the $700,000 budget. The City Council can reduce the scope of the project at the time of award but it is not possible to add street segments due to the notification requirements outlined in state statute 429. ALTERNATIVES: 1. Approve a Resolution accepting the Feasibility Report and establishing a Public Hearing Date as part of the consent agenda. 2. Remove this item from the consent agenda for additional discussion. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council hereby accepts the Feasibility Report as submitted. 3. The Council will consider the improvement of such streets and areas in accordance with the Report and the assessment of property as described in the Report for all or a portion of the cost of improvements pursuant to Minnesota Statutes Chapter 429 at an estimated cost of the improvements of $800,000. 4. A Public Hearing shall be held on such proposed improvements on the 22nd of January 2019 at Prior Lake City Hall, with the address of 4646 Dakota St SE, City of Prior Lake, Minnesota at 7:00 p.m. statutory notice and publication requirements shall be followed. Proposed roadways to be improved are shown on the Location Map provided in the appendix and include Jeffers Pass to Fairway Heights, Regal Pass, Majestic Lane from Jeffers Pass to current terminus, Pike Lake Trail, Fountain Hills Drive, Fountain Hills Court, Robin Drive, Hummingbird Trail, Bluebird Trail, Partridge Court, Seagull Circle, and Hummingbird Court . The proposed work type is a mill and overlay where the bituminous pavement is milled from curb to curb and a layer of pavement, typically 1.5” thick, is placed. Prior to the new pavement being installed, an under seal will be completed to help minimize reflective cracking. Performing mill and overlays provides a smooth pavement surface as well as providing a new structural layer to the roadway. Replacement of the curb and gutter will occur where there is cracked or damaged curb and in locations to improve drainage. This report explores the necessity of rehabilitating the roadways within the developments as part of the City’s ongoing Street Improvement program. The cost for the proposed improvement, including the 10% contingency is $796,253.89. Project Location The 2019 Mill & Overlay Project is located in multiple locations throughout the City including Section 01, Township 114, Range 22; Section 34, Township 115, Range 22; Section 26, Township 115, Range 22 in the City of Prior Lake, Scott County, Minnesota. Project History On November 5, 2018, the City Council ordered the preparation of a feasibility study for the 2019 Mill & Overlay Project (Street Project STR19-0000001). The feasibility study is necessary because a portion of the funding for this project is proposed to come from special asse ssments. State Statutes dictate that a feasibility study can either be initiated by a petition of the affected property owners, or at the direction of the City Council. This project was initiated at the direction of the City Council. This report is intended to consider the areas listed below. Identification of these areas is a result of the City’s ongoing Pavement Management Program. The program was implemented to maximize the useful life of the City’s streets. Streets are generally recommended for mill & overlay when their Overall Condition Index (OCI) is between 45 and 65 on a scale of 0 to 100. In addition to the OCI rating, the streets recommended for the 2019 project were field inspected to confirm if a mill & overlay was appropriate as part of the feasibility study. That is why some streets included in the 2019 project have ratings above 65. For mill & overlay, approximately 1.5- inch of the existing bituminous surface for the entire street width from curb to curb will be milled and removed from site. Then an under seal will be installed on top of the remaining existing pavement. The under seal is similar to the chip seals the City performs on the surface of existing streets. The under seal acts as a flexible barrier between the older pavement beneath it and the new pavement that will be installed on top of it. This is done to help minimize reflective cracking. Finally, a new layer of bituminous pavement will be placed over the entire roadway width to provide a smooth surface and new structural layer. Existing curb and gutter will remain in place except sections of damaged curb and gutter, and areas that do not drain properly. City staff will inspect the curb and gutter for cracking and/or settlement and the actual quantity of curb replacement will be marked for replacement pri or to the project start. The Contractor would be responsible for restoring any disturbed areas behind the curb after replacement. This restoration may include seed, sod, driveway pavement and/or landscaping. Right-of-Way and Easements No additional right of way or easements are required for this project. If any issues arise, requiring access outside of the existing right-of-way and easements, staff will handle these on a case-by-case basis and work with the affected property owner to obtain right of entry. Private Utilities Staff will work with all private utility companies to identify, locate, and avoid damaging the existing service lines in the area. Staff will also work with residents to have the resident locate their sprinkler systems, landscaping and any underground fencing. Permits and Approvals The majority of the work proposed is within the City’s right-of-way. Since the proposed improvements consist of a mill and overlay, no additional permits are anticipated. Operational Issues and Costs No unusual maintenance concerns or costs are expected due to the construction . The work is scheduled to occur during the summer before school begins. Opinion of Probable Cost Included in the Appendix of this report is an opinion of probable co sts. The costs are estimated based on recent construction projects in the City of Prior Lake and assume the installation of 6 the improvements will be completed in 2019. The costs in the appendix are based on the proposed mill and overlay. Following is a summary of estimated project costs: Estimated Construction Cost $723,867.18 Construction Contingencies (10%) $72,386.72 Total Estimated Construction Cost $800,000 Proposed Funding As reflected in this funding allocation, staff anticipates a single project in 2019 using the Permanent Improvement Revolving Fund. Revenue will come from two sources, the tax levy and special assessments. The total amount proposed to be assessed is $439,900. The remaining funding of will come from the tax levy. Proposed Assessments The City’s assessment policy is being followed for this project. The policy was updated in 2016 to include assessments for mill and overlay type projects and a per lot amount was set as part of the City’s fee schedule at the end of 2016. As this project involves only a basic mill & overlay, it is unlikely benefit appraisals will be required; ordering of benefit appraisals will be at the discretion of the City Attorney. The Single-Family Assessment Rate for a mill & overlay was set at $1,266 per lot for 2019. The assessment repayment period is five (5) years per the assessment policy. Per the preliminary assessment roll attached, there are 293 properties proposed to be assessed making up 347 assessment units based on the Assessment Policy adjustments for property types. Single family and townhome lots are assessed for 1 unit. Condominium units are assessed for 0.8 units. There are six commercial properties and one church included in the project area. Those properties were converted to equivalent residential units by multiplying the acreage of the property by 2.2 units per acre. This is consistent with the methodology that was used in previous years. A typical single-family subdivision generates 2.2 units per acre therefore that is the formula that is used to convert non-residential properties to equivalent residential units. 7 Proposed Project Schedule The proposed schedule for the project is as follows: Feasibility The project is feasible, necessary and cost-effective to maintain the City’s road system. Recommendations Staff recommends the City proceed with the improvements as proposed in the report.
