Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MEETING DATE: AGENDA #: PREPARED BY: JANUARY 3,2006 11B LARRY POPPLER, ASSISTANT CITY ENGINEER CONSIDER APPROVAL OF A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY REPORT FOR IDA CIRCLE, CITY PROJECT #06-011 AGENDA ITEM: DISCUSSION: Introduction The purpose of this Agenda item is to initiate the process for local improvements on Ida Circle in accordance with Minnesota Statutes (M.S.), Chapter 429. History Ida Circle is located in the southwest corner of the City of Prior lake as shown on the attached drawing. Ida Circle was annexed into the City of Prior lake in 2004 as part of the Orderly Annexation Agreement. On September 30, 2005, the City of Prior lake received a public improvement petition that included signatures from 77% of the property owners located on Ida Circle. Attached to this report is the petition for the improvements. Seven of the nine households were represented in the petition. A Developer is proposing a new development currently named Hickory Shores that abuts Ida Circle. As part of their PUD process, the Developer is proposing to remove the Ida Circle access to TH 13 and provide access through the development. Attached is a preliminary drawing showing the proposed access modifications. The City in conjunction with MNDOT and Scott County have worked to limit access points on State and County roadways. New developments offer opportunities to remove or reconfigure access points. The Hickory Shores development is also proposing to construct sewer and water to Ida Circle. The Developer is planning to begin construction on Hickory Shores in the Spring of 2006. Current Circumstances Ida Circle households currently have well and septic facilities. The petition specifically requests the City to provide sewer and water services for the homes on Ida Circle. As a public improvement project the City must follow State of Minnesota Statute 429. Attached to this agenda report is a flowchart of the 429 process. This process applies to all projects that will be financed in whole or part through special assessments or bond proceeds. The first step in the process is for the Council to order preparation of a Feasibility Report for the improvement projects. Once the Feasibility Report has been completed, City Staff would ask the City Council to accept the Feasibility Report and order a Public Hearing for the reconstruction of Ida Circle. City Staff recommends that a minimum of 75% of the benefiting property owners sign a petition and a waiver of assessment appeal for this project or that the Assessment Hearing be conducted prior to construction. ISSUES: As a first time improvement the assessments could be more than $30,000 per property. The residents requesting the project have been notified of the potential costs. The City Council should give direction to Staff as to how the Feasibility Report will be paid. In the past on petition driven projects, City Staff has completed the Feasibility Report without reimbursement from the petitioners. The funds for completion of the Feasibility Report were then encumbered through the general tax levy. However, City Staff believes the costs for completing this study should be borne by the petitioners. The feasibility report is estimated to cost $550.00 per property. FINANCIAL IMPACT: The 2006 budget does not include the Ida Circle reconstruction. The apportioning of the costs should follow the City Assessment Policy in which the residents of the reconstruction area are assessed 100% of improvement costs, since this is a first time improvement. The financial impact of this project will be further analyzed in the Feasibility Report. ALTERNATIVES: The alternatives are as follows: 1. Approve a resolution ordering the preparation of a Feasibility Report for Ida Circle, City Project #06-011. 2. Deny this item for a specific reason and provide Staff with direction. 3. Table this item until some date in the future. The recitals set forth above are incorporated herein. 2. That the proposed improvements be referred to the City Engineer for study and that he is instructed to report to the Council with all convenient speed advising the Council in a preliminary way as to whether the proposed improvements are cost-effective and feasible and as to whether they should best be made as proposed or in connection with other improvements, and the estimated costs for the improvements as recommended.
