What has Happened
•Street impact fees
•VOIDED by Supreme Court
•Cities eliminate fees from their fee schedules
•Cities seek joint legislative solution or go it alone
•Affordable housing
•Housing Affordable Institute issues report
•Eight cities targeted
•Cities respond by letter to report inaccuracies
Prior Lake Actions to Date
•Worked with SCALE, LMC and MC to adopt legislative platforms supporting the
Infrastructure Development Fees
•Working with Lakeville, Dayton and others to assemble data and respond to claims
•Approved study by SRF to verify funding required (due in April)
•Tried to garner legislator support for the fee
•Prepared resolution supporting legislation for consideration tonight
•Prepared letter to Housing First questioning their study
•Two columns appeared in PLA
Alternative Actions
•Do nothing and hope for legislation
•Continue to push for legislation
•Initiate a moratorium after talking with local developers/builders
•Use moratorium to examine affordable housing as well
Moratorium Pros
•Pros
•Is consistent with leg. policies of SCALE, LMC, MC
•Inexpensive since study has been authorized
•Little risk financially and developmentally if short lived
•Provides city staff with time to study ordinance and alternatives
•Validates fees and process
•Underscores importance of fees to city
•Consistent with “Development Pays for Itself” philosophy
Moratorium Cons
•Could send the wrong message to developers/builders
•Is not a state wide Legislative solution
•Could result in forgone city revenues if moratorium long lived
Council Direction
