CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING THE
CONVEYANCE OF WETLAND IN THE STEMMER RIDGE DEVELOPMENT
TO SCOTT COUNTY IN CONNECTION WITH THE ACQUISITION OF
SPRING LAKE REGIONAL PARK PROPERTY.
Introduction: The purpose of this agenda item is to authorize the Mayor and
City Manager to execute a Quit Claim Deed that would convey an
approximately 13-acre wetland within the Stemmer Ridge development to
Scott County. This conveyance is proposed in accordance with the terms of an
Option Agreement dated April 2005.
History: In 1997, a Park & Library Referendum was approved which called for
the City to acquire 80 acres of land for community play field purposes in
addition to the property acquired for Lakefront Park. For a variety of reasons,
the City was only able to acquire the Kop property for Lakefront Park, and the
38.4 acre parcel now known as Thomas Ryan Memorial Park. This left a
shortfall of approximately 41.6 acres not addressed with Referendum funding.
In 2004, Ingraham and Associates completed a park needs study to update
the Park and Trail portion of the Comprehensive Plan. The study confirmed a
deficiency in community playfields. According to the study, the City is short
approximately 80 acres for community play field purposes today without
considering future needs.
In response to this need, the City worked with Scott County and Three Rivers
Park District to enter into a purchase agreement and an option agreement that
would enable the City to acquire 39 acres in the northwest corner of Spring
Lake Park, while still addressing the concerns of the Met Council and Scott
County that there be no net loss of regional park land, and that the park land
be used to its best advantage.
In April of 2005, the City Council authorized the City to enter into a purchase
agreement and option agreement that would accomplish the following:
1. The City would acquire approximately 36 acres of cropped park land and 3
acres of wetland in the northwest corner of Spring Lake Park at a purchase
price of $866,400.00 for future development as community play fields.
2. Approximately 51 acres of wetland would be transferred to the County for
incorporation into Spring Lake Regional Park as the City acquired the
adjacent wetlands through development and the park dedication process.
The County would pay the City $800 per acre for the wetlands as they
became available as a result of development.

This transaction is intended to be a "win-win" from all perspectives.
· The City has acquired nearly 39 acres of more or less flat cropland to be
used for future community play fields - a need that was identified in 1997.
· The venture is consistent with the 2030 Vision and Strategic Plan by taking
steps to address the growing demands for community play fields, by
increasing the acres of park land, and by partnering to develop an
agreement that met the needs of all parties.
· The Met Council is satisfied that exchanging the cropped park land to be
developed as active recreation area, for more desirable wetland areas
uses the land to its best advantage and actually adds to the amount of land
preserved for park purposes.
· The County will ultimately receive a net increase in park land, and was
able to purchase an additional 80 acres for Doyle-Kennefick Regional Park
with the proceeds of this sale.
· The residents who purchase homes in these subdivisions can be assured
that the wetland will remain part of this regional park.
Current Circumstances: With the development of the Stemmer Ridge property
adjacent to Spring Lake Regional Park, the City has acquired the first of the
three wetlands targeted to be added to the Spring Lake Regional Park as
development surrounding it occurs. The wetland is approximately 13.6 acres.
Under the terms of the Option Agreement, the County would like to exercise its
option to purchase the wetland from the City at $800 per acre, or $10,880.
Conclusion: The terms and conditions of this conveyance are set out in the
Purchase Agreement and Option Agreement dated April 2005 and previously
approved by the City Council. Staff is asking the Council to formally authorize
the Mayor and City Manager to convey the property under the terms of those
agreements.
ISSUES:
The City acquired the wetland property through park dedication from Arcon
Development. Traditionally, land received through park dedication is used to
provide smaller neighborhood parks within developments to preserve open
space for passive and active recreation. In this case, the dedicated land will be
preserved as part of a regional facility, and maintenance and planning for the
area will be under the direction of the County and the Metropolitan Parks and
Open Space Commission. Since the property will still be preserved as park
land, and the Stemmer Ridge development borders the park, staff believes
that conveying the property will have no detrimental affect on the new
neighborhood, or their ability to have easy access public park areas.
FINANCIAL
IMPACT:
The terms of the Option Agreement provide that the County pay $800 per acre
for the wetland. In this case, the total cost of the land is $10,880. Because
Capital Park Fund dollars were used to acquire the 39 park land to be
developed for play fields, and because the wetland was acquired through park
dedication, it is appropriate that these funds be allocated back to the Capital
Park Fund.

RESOLUTION 06-XX
A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO CONVEY A 13.6 ACRE
WETLAND TO SCOTT COUNTY IN CONNECTION WITH THE OPTION AGREEMENT ENTERED
INTO AS PART OF THE ACQUISITION OF 39 ACRES WITHIN SPRING LAKE PARK.

WHEREAS, the County owns Spring Lake Regional Park ("Park") within Scott County which consists of
approximately 345 acres; and
WHEREAS, in April 2005, City entered into a purchase agreement and option agreement in order to obtain
approximately thirty-nine (39) acres of cropped park land in the northwest corner of the Park from
the County to address a deficiency in active recreational area for community play fields identified in a
2004 study by Ingraham and Associates; and
WHEREAS, as part of the consideration for the County transferring a portion of Spring Lake Park to the City, the
County desires to obtain an option to purchase approximately three (3) wetland areas containing
approximately 51 acres adjacent to the Park as those wetlands are acquired by the City through
development; and
WHEREAS, the City has acquired a 13.6 acre wetland from Arcon Development adjacent to Spring Lake Park
along its easterly boundary; and
WHEREAS, the County wishes to exercise its option to purchase the wetland; and
WHEREAS, the transaction will not create any net loss of park land in the area, or less opportunity for the
development to access public parks and open spaces.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA that:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are hereby authorized to convey the 13.6 acre wetland within the Stemmer Ridge
development to Scott County by Quit Claim Deed under the terms and conditions of the Option Agreement
dated April 2005.
3. Funds acquired from this transaction shall be allocated to the Capital Park Fund.
