CONSIDER APPROVAL OF A RESOLUTION APPROVING AN
AMENDMENT TO THE COOPERATIVE AGREEMENT BETWEEN THE CITY
OF PRIOR LAKE AND SCOTT COUNTY FOR CR 12 SAP 70-612-09
Introduction
The purpose of this agenda item is for the City Council to approve an
amendment to the Cooperative Agreement for the realignment segment of CR
12 currently under construction related to power line relocation (The portion of
the road currently being realigned in Spring Lake Park as shown on the
attached exhibit).
History
On June 6, 2005, the City of Prior Lake and Scott County entered into a
Cooperative Agreement for the reconstruction of CR 12 phase 1. This
segment is currently under construction from the eastern edge of Spring Lake
Park to the Spring Lake Estates Development.
As part of the Cooperative Agreement, the Developer of Spring Lake Estates
is contributing approximately $868,080 to the reconstruction of CR 12. The
City and County will contribute an estimated $90,619 and $411,968
respectively to roadway construction. By having the developer complete the
improvements, the City and County are saving a substantial amount of money.
The estimated savings to the City and its taxpayers for utility and roadway
construction will be in excess of $300,000.
The project began in fall of 2005 and will be completed in the summer of 2006.
Current Circumstances
Because of the roadway realignment, the existing overhead power lines need
to be relocated to the new roadway. The County pursued having Xcel move
these lines at their own cost, however based on easement information
provided by Xcel they are not obligated to move the lines at their sole cost.
The County and City have worked with Xcel and the project developer to reach
a cost sharing agreement for the overhead power relocation. The estimated
total cost of relocating approximately 2,700 feet of power lines is $25,000 to
the City, County and Developer. The City's cost is $6,250 based on the
proposed formula. The cost shares to the County and the Developer are
$6,250 and $12,500 respectively. The attached amendment was approved by
the County on November 29, 2005 and details the cost participation for the
amendment.

The City and County also investigated the viability of burying the overhead
power in CR 12 as part of negotiations with Xcel. The costs for burying the
power are estimated to be between $75,000 and $100,000. Additionally
because the overhead power is 3-phase and a vital connection to the west,
Xcel is reluctant to bury this segment. Burying small segments of important
transmission facilities is not recommended because it increases maintenance
issues and decreases system reliability.
ISSUES:
The only issue related to this agenda item is whether the City feels the
relocation of overhead lines out of the park along the lakeshore is necessary.
In the future as the park is developed these lines will most likely need to be
relocated to facilitate restoration of the shoreline. Construction costs will be
higher in the future due to normal increases and the fact that the work will
need to be done under traffic of the new roadway.
FINANCIAL
IMPACT:
The City Council has previously approved funding for the CR 12 realignment.
The additional funding required is available in the street oversize fund as this is
required as part of the CR 12 project.
ALTERNATIVES:
1. Approve a resolution approving an amendment to the Cooperative
Agreement between the City of Prior Lake and Scott County for CR 12
SAP 70-612-09.
2. Deny this agenda item for a specific reason and provide staff with
direction.
3. Table this item to a certain date in the future.

WHEREAS, The Prior Lake City Council approved the Cooperative Agreement for CR 12 SAP 70-
612-09 on June 6,2005; and
WHEREAS, The existing overhead power lines need to be relocated as part of the project; and
WHEREAS, Relocation of the power lines will cost less to complete now than in the future; and
WHEREAS, A cost share agreement allocating 25% of the cost to the City of Prior Lake, 25% to
Scott County and 50% to the Developer has been negotiated: and
WHEREAS, The estimated cost of $6,250.00 is available in the Street Oversize Fund for the project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are authorized execute the Amendment to the Cooperative
Agreement.

AMENDMENT NO.1
TO
CONSTRUCTION COOPERATIVE AGREEMENT
Recitals of the AGREEMENT made and entered into by and between Scott County, "County" and the
City of Prior Lake, "City", The County and the City have been negotiating to bring about the improvement of
County State Aid Highway 12 (CSAH 12) from 0.55 miles east ofCSAH 17 to 1.44 miles west ofTH 13 in the
City of Prior Lake, the below authorized representatives of the County and City agree to the following
amendment to the Agreement:
1. The County and City further agree to share in the cost of the relocation of the Xcel Energy utility
line together with the Developer, along the segment of CSAH 12 relocated under this project.
Cost sharing is agreed to and shall be twenty-five percent (25%) City; twenty-five percent (25%)
County; and fifty percent (50%) Developer. Xcel Energy has estimated the total cost for this
work to be twenty-five thousand dollars ($25,000.00). Xcel Energy will invoice the City of Prior
Lake upon completion of work and documentation of actual costs.
All other terms and conditions of the original Agreement between the parties hereto not specifically
amended herein shall continue in full force and effect.
IN WITNESS WHEREOF, the County and the City by their authorized partner or officer have hereunto
subscribed their names in duplicate.
