. Agreed that this is in the public interest and supported.
MOTION BY ATWOOD, SECOND BY RINGSTAD, TO RECOMMEND CITY
COUNCIL APPROVE THE VACATION, SUBJECT TO THE CONDITION THE
RESOLUTION NOT BE RECORDED UNTIL AFTER THE FINAL PLAT
APPROVAL.
Vote taken indicated ayes by all. MOTION CARRIED.
This matter will go before the City Council for public hearing on July 7, 2003.
C. Case #03-57 Patrick Jolitz, 3235 Kent Street SW, is requesting to vacate the
north 8' of the 16' wide platted alley adjacent to Lot 1, and the East ~ of Lot 2,
Block 30, Spring Lake Townsite.
Planning Coordinator Jane Kansier presented the Planning Report dated June 23, 2003,
on file in the office of the City Planning Department.
Patrick Jolitz has filed an application to vacate the north 8' of the 16' wide platted alley
located adjacent to the south property line of the property at 3235 Kent Street. There is
an existing home on this property. The alley is currently unimproved. The applicant is
proposing to rebuild the existing garage and requires the additional lot area to meet the
maximum impervious surface requirements.
The alley right-of-way was originally dedicated as part of the Spring Lake Townsite plat
many years ago. The alley right-of-way is 16' wide. There are utilities located with the
alley right-of-way including a gas main, telephone cable and electric lines.
The vacation of this alley will impede access to the existing utilities and is thus
inconsistent with the goals and objectives of the Comprehensive Plan. Therefore, the
staff recommended denial of the request.
Comments from the Commissioners:
Atwood:
. Supported staffs recommendation, unless the applicant is ready to relocate the
utilities.
. Deny the request.
Ringstad:
. Quoted the vacation statute for public interest. This vacation is not in the best
public interest.
. Support denial.

. The utilities are in the right-of-way and access has to be protected and that
overrides any other benefit.
. Recommend to City Council to deny the request.

COUNCIL THE DENIAL OF THE VACATION OF RIGHT -OF- WAY AS
PROPOSED.

8. Announcements and Correspondence:
Kansier explained the averaging of residential front yard setback problems. Staff is
asking the Commissioners to give a verbal consent to go a head and direct staff to bring
the issue forward. The Commissioners indicated to go forward.
The second issue is the common public area between the lakeshore and property owners
and asked for consent to review the ordinance and bring back to discuss.
Reminder of the Annual Surf and Turf tour on June 30th.

Consider Approval of a Resolution Denying a Request to Vacate a Portion of the Erie Avenue Right-of-Way Located
Adjacent to 3235 Kent Street {Jolitz- Case File #03-O57}.
Kirchoff: Reviewed the agenda item in connection with the staff report.
Z1eska: Asked if the proposed garage was to be built over right-of-way. Also asked if the vacation was not approved, could
the applicant request a variance to the impervious surface requirement.
Kirchoff: Advised that her understanding is that the request for the vacation is to add lot area and the vacated alley would
be only for more green space. Noted that a variance could be requested, but it appears that other impervious surface on the
site could be removed and the property owner could comply with the 30% impervious surface requirement.

Zleska: Recalled previous action by Council where a railroad right-of-way green space area was included in an impervious
surface calculation. Suggested this type of calculation rather than vacating.
Rye: Stated that the instance referred to was a right-of-way that had been vacated and subsequently reverted to the
property.
Bovles: Redirected that the question before the Council is whether the request meets the criteria for a vacation of a public
easement.
Mayor Haugen opened the public hearing.
Patrick Jolltz (3235 Kent Stree~: Commented that the current garage existed when he purchased the property in 1997. He
always anticipated improving the garage. Did not know there was an alley behind his property, and that City staff had
suggested a vacation might be possible. The property is on a comer and during this process it was determined that he did
not own 15 feet on one side. He only learned tonight that a vacation had to be in the public interest. Suggested that his best
step seems to be to remove concrete or apply for a variance.
MOTION BY PETERSEN, SECOND BY BLOMBERG TO CLOSE THE PUBLIC HEARING.
VOTE: Ayes by Haugen, Blomberg, Petersen, Zieska and LeMair, the motion carried.
LeMalr: Commented that it does not appear that a vacation meets the public interest, but that the property owner is more
clear on what his options are to make the project worit
Zleska: Noted that the primary issue is whether the vacation is in the public interest. Since utilities are running through the
easement, did not feel a vacation was prudent. The applicant has other alternatives. Not in favor of the vacation.

A petition for the vacation of an 8' wide strip of the alley right-of-way adjacent to the property
located at 3235 Kent Street, has been duly presented to the City of Prior Lake, signed by the
owners of the property abutting the following described right-of-way situated in the City of
Prior Lake, Scott County, Minnesota to wit:
Legal Description:
That part of the north half of the 16 feet wide alley as platted in Block 30, SPRINGLAKE
TOWNSITE, according to the recorded plat thereof, Scott County, Minnesota, which lies
easterly of the southerly extension of the west line of the east half of Lot 2, said Block 3 and
which lies westerly of the southerly extension of the east line of Lot 1, said Block 30,
SPRINGLAKE TOWNSITE, Scott County, Minnesota.
Notice of the hearing has been duly published and posted in accordance with the applicable
Minnesota Statutes, and
A Public Hearing was held on said petition on Monday, July 7, 2003, at 7:00 p.m. in the
Council Chambers at the Prior Lake Fire Station #1; and
The City Council then proceeded to hear all persons interested in said petition and persons
interested afforded the opportunity to present their views and objections to the granting of said
petition; and
The existing right-of-way is not necessary for the maintenance of public utilities as long as a
drainage and utility easement is maintained over this area; and
The City Council of Prior Lake has determined that the vacation of said right-of-way would not
be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:
1. The above recitals are herein fully incorporated herein as set forth above.
2. Pursuant to Minnesota Statues 412.851, the City Council has determined the requested vacation is not in the
public interest.

INTRODUCTION
Patrick Jolitz has filed an application to vacate the north 8' of the 16' wide platted
alley located adjacent to the south property line of the property at 3235 Kent
Street. There is an existing home on this property. The alley is currently
unimproved. The applicant is proposing to rebuild the existing garage and
requires the additional lot area to meet the maximum impervious surface
requirements.
As required by State Statute 462.356 Subd.2, the Planning Commission is
required to make a recommendation to the City Council regarding the disposal or
acquisition of public lands as it relates to compliance with the Comprehensive
Plan.
Upon proper notification, State Statute 412.851 allows the Council to vacate
easement or right-of-way by resolution. The statute also states "no such
vacation shall be made unless it appears to be in the public interest to do so".
DISCUSSION
The alley right-of-way was originally dedicated as part of the Spring Lake
Townsite plat many years ago. The alley right-of-way 16' wide. There are
utilities located within the alley right-of-way, including a gas main, telephone
cable and electric lines.
The Planning Commission must make two determinations. Does the vacation of
the existing easement comply with the Comprehensive Plan and is there a public
need or anticipated future need for the dedicated property?

Comprehensive Plan Review
The Comprehensive Plan does not specifically discuss utility easements, other
than as a function of ensuring access to public utilities. The vacation of this alley
may impede access to the existing utilities and is thus inconsistent with the goals
and objectives of the Comprehensive Plan.
Public Need
As noted above, there are existing utilities located within the alley right-of-way.
The area proposed to be vacated includes these utilities.
RECOMMENDATION
Based on the information submitted thus far, there is a public need for the alley
right-of-way. The Planning staff therefore recommends denial of this request. If
the right-of-way is vacated, a condition requiring an easement over the entire 8'
must be included as part of the vacation.
ALTERNATIVES:
1. Recommend the City Council approve the proposed vacation of the right-
of-way as presented or with changes recommended by the Commission.
2. Continue the discussion to a date and time certain to allow the staff to
provide additional information specifically requested by the Planning
Commission.
3. Based upon expressed findings of fact, recommend the City Council deny
part or all of the applications based upon inconsistency of the proposal
with specific regulations of the Zoning and Subdivision Ordinances and/or
specific policies of the Comprehensive Plan.
RECOMMENDATION:
The staff recommends Alternative #3.
ACTION REQUIRED:
Motion and second to recommend the City Council deny the vacation of the right-
of-way as proposed.

Dear Ms. Kansier:
With reference to the proposed alley vacation mentioned above, CenterPoint Energy
Minnegasco does have an existing natural gas main in that portion of the alley
proposed to be vacated.
Since this gas main is necessary to serve all of the homes on this block, we must
object to this proposed vacation unless suitable easement rights are reserved to
CenterPoint Energy Minnegasco, pursuant to MnSta 160.29 & MnRule 7819.3200.
Please reserve an easement to CenterPoint Energy Minnegasco, created
by and within the document establishing the street vacation and filed with
the Scott County Recorders office, over all of the area of the alley
proposed to be vacated.
We may consider removing our objection should the petitioner wish to reimburse
CenterPoint Energy Minnegasco the cost of relocating the existing gas main. To
discuss this and any other options that may be available please have the petitioner
contact Rick Pilon, Senior Administration Engineer, at 612-321-5426.

submitted the attached letter objecting to the vacation ofthe right-of-
way unless a permanent drainage and utility easement is maintained
over the right-of-way.
Current Circumstances: The Planning Commission reviewed this
vacation request on June 23,2003. The Planning Commission
recommended denial of the proposed vacation on the basis that it is not
in the public interest.
The Issues: Minnesota Statutes 412.851 allows the Council to vacate
easements or right-of-way by resolution. The statute states, "no such
vacation shall be made unless it appears to be in the public interest to
do so." The Comprehensive Plan does not specifically discuss utility
easements, other than as a function of ensuring access to public
utilities. The vacation of this alley may impede access to the existing
utility easements and is thus inconsistent with the goals and objectives
of the Comprehensive Plan.

Conclusion: The Planning Commission and the staff recommend

A petition for the vacation of an 8' wide strip of the alley right-of-way adjacent to the
property located at 3235 Kent Street, has been duly presented to the City of Prior
Lake, signed by the owners of the property abutting the following described right-of-
way situated in the City of Prior Lake, Scott County, Minnesota to wit:
Legal Description:
That part of the north half of the 16 feet wide alley as platted in Block 30,
SPRINGLAKE TOWNSITE, according to the recorded plat thereof, Scott County,
Minnesota, which lies easterly of the southerly extension of the west line of the east half
of Lot 2, said Block 3 and which lies westerly of the southerly extension of the east line
of Lot 1, said Block 30, SPRINGLAKE TOWNSITE, Scott County, Minnesota.
Notice of the hearing has been duly published and posted in accordance with the
applicable Minnesota Statutes, and
A Public Hearing was held on said petition on Monday, July 7, 2003, at 7:00 p.m. in
the Council Chambers at the Prior Lake Fire Station #1; and
The City Council then proceeded to hear all persons interested in said petition and
persons interested afforded the opportunity to present their views and objections to
the granting of said petition; and
The existing right-of-way is not necessary for the maintenance of public utilities as
long as a drainage and utility easement is maintained over this area; and
The City Council of Prior Lake has determined that the vacation of said right-of-way
would not be in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that:

Dear Ms. Kansier:
With reference to the proposed alley vacation mentioned above, CenterPoint Energy
Minnegasco does have an existing natural gas main in that portion of the alley
proposed to be vacated.
Since this gas main is necessary to serve all of the homes on this block, we must
object to this proposed vacation unless suitable easement rights are reserved to
CenterPoint Energy Minnegasco, pursuant to MnSta 160.29 & MnRule 7819.3200.
Please reserve an easement to CenterPoint Energy Minnegasco, created
by and within the document establishing the street vacation and filed with
the Scott County Recorders office, over all of the area of the alley
proposed to be vacated.
We may consider removing our objection should the petitioner wish to reimburse
CenterPoint Energy Minnegasco the cost of relocating the existing gas main. To
discuss this and any other options that may be available please have the petitioner
contact Rick Pilon, Senior Administration Engineer, at 612-321-5426.
