PROCEDURE FOR AN APPLICATION FOR SITE PLAN APPROVAL
Overview: The site plan review procedure is an administrative review performed by City staff for uses
which, because of their nature, operation and location in relation to other uses, require a more thorough
,review procedure. The purpose of this procedure is to identify all relevant issues and permit requirements
prior to the application for a building permit.
Pre-Application Procedure: Prior to submitting an application for Site Plan approval, applicants are
encouraged to meet with the Planning Staff to discuss the following:
. City Plans and policies that might relate to or affect the property.
. Preliminary development or building plans for the property.
The applicant is responsible for understandine the requirements of the City Zonine Ordinance,
including setbacks, landscaping, parking, required improvements, submittal requirements, signs, and so
on. The Planning Staff will also advise you of other potential governmental jurisdiction involvement.
The following must be brought to the pre-application meeting:
. The location of the property; and
. Any preliminary plans developed for the property.
If a decision is made to proceed after the advisory meeting or meetings, a formal application is made.
Process: Within ten (10) business days of submission of the application, the applicant will receive
formal, written notice from the City about whether the application is complete. The Planning Department
will refer the application to City Departments and to other interested parties. The Planning Department
will then review the proposed development for compliance with the provisions of the Zoning Ordinance,
the Subdivision Ordinance and other applicable ordinances. Within 60 days of receipt of a complete
application, the Planning staffwill take action to approve or deny the application.

307.100:
DEFINITIONS:
Outdoor Event means any gathering of fifty (50) people or more in one outdoor
location where sound amplification is used to listen to a concert or some type of
entertainment.
Person means an individual, partnership, association, corporation or other
organizational entity.
307,200: LICENSING: No person, unless otherwise exempted herein, shall conduct an
outdoor event without first obtaining a license from the City Manager. A person
seeking a license shall make application on a form supplied by the City Manager.
The license application shall be submitted to the City thirty (30) days prior to the
date of the event, and shall include:
(1) The full name, date of birth, address, work and home phone numbers of the person
responsible for organizing or sponsoring the event whether on behalf of themselves
or a group or entity sponsoring the event.
(2) The full name, date of birth, address, work and home phone numbers of the
person(s) performing at the event.
(3) The number of persons who will perform at the event.
(4) The date and time of the event.

(5) The steps taken to minimiZe noise and nuisances, including parking plans to
accommodate the number of individuals expected to atterd the event.
(6) The full name, date of birth, address, work and home phone numbers of the sound
technician who will operate the sound panel controlling the loudness if the event is
to be electronically amplified.
307.201 Exception: Outdoor sporting events do not require an outdoor event license.
307,300: LIMITATION ON LICENSES: Except as provided herein, (1) no person may receive
a license for more than two outdoor events within any calendar year; and (2) no
location within the City may be used four times within any calendar year as a venue
for an outdoor event.
307.301 Exception: The limitation to two events in one calendar year shall not apply to (1)
Lakefront Park, Memorial Park or Sand Pointe Park; or (2) Prior Lake School
District property.
307,400: ADDITIONAL REQUIREMENTS:
307.401 All license applications for an outdoor event license shall be accompanied by the
written consent of the property owner and tenant of property sought to be used for
the outdoor event. No license shall be granted wthout such consent being filed. All
outdoor event activities must be contained on the approved event site. Except as
provided for in Section 307.301, no outdoor event shall be allowed on City-owned
property or public streets.
307.402 All speakers used to amplify any activity at the event are to be set up at ground
level. Any deviation from ground level amplification must have prior approval by the
City Manager as part of the application process.
307.403 All license applications shall be accompanied by evidence satisfactory to the City
that the City is protected under an insurance policy against all liability or claims
which might arise out of. the holding of the event.
307.404 All license applications shall be accompanied by a written agreement by the person
or organization seeking the license that the person or organization will defend, hold
harmless and indemnify the City, its employees, agents and officers against all
claims, demands, actions or causes of actions of whatsoever nature or character
arising out of or by reason of the conduct of the outdoor event, which agreement
shall also provide for the repair of or payment for damages to public property.
307.405 All license applications submitted to the City for approval shall be accompanied by
payment of such license fees as determined by the City Gouncil. All license

applications submitted to the City for approval shall also be accompanied by such
deposits as determined by the City Manager to cover cleanup costs and direct
police costs incurred by the City in connection with the event. Any balance
remaining after payment of cleanup costs and direct police costs incurred by the
City shall be refunded to the license applicant.
ApPEALS: In the event the City Manager denies a license to an awlicant, the
applicant may appeal the denial of the license to the City Council. The City Council
may, in its discretion, grant or refuse to grant the issuance of the license subject to
such conditions as it may deem necessary and expedient for the protection of the
health, safety and general welfare of the City.
DECIBEL LEVEL: Outdoor events shall not exceed a decibel level of sixty-five
(65) decibels at a distance of one hundred feet (100') from the event site. The Prior
Lake Police Department may monitor the decibel level. In the event the maximum
decibel level is exceeded, the Prior Lake Police Department shall revoke the
license, and the person shall immediately discontinue the event.
HOURS: No outdoor eventshall commence before eight o'clock a.m. (8:00am) nor
continue after ten o'clock p.rn. (10pm) Sunday through Friday. The outdoor event
application should clearly identify the hours requested for the event.
Exception: Events held on a Friday or Saturday may, at tt-e discretion of the City
Manager, be extended until 12:00 a.m. In determining whether to extend the event
held on a Friday or Saturday until 12:00a.m., the City Manager may consider
circumstances including, but not limited to, the location of the property relative to
residential property, type of amplification equipment used, noise mitigation efforts to --
be undertaken, presence of on-site police personnel, previous experience with
applicant, and the extent to which the event is designed to appeal to all or a large
percentage of City residents.
CLEANUP: All applicants must cleanup the outdoor event area and the immediate
surrounding area as soon as possible after the outdoor event has concluded.
(Cleanup includes picking up and disposal of all plastic cups, glasses, plates,
napkins, garbage and other incidentals.)
The City official inspecting the outdoor event site shall check the outdoor event
area and immediate surrounding area to determine compliance with the cleanup
requirement. The City offidal inspecting the outdoor event site will advise the City
Manager that 'the cleanup requirement has been met or assign a cleanup crew. If a
cleanup crew is assigned, the cleanup costs incurred by the City in connection with
the event shall be deducted from the applicant's deposit.

307,900: SECURITY: The applicant shall hire security personnel and shall provide such
hired security personnel with proper attire so as to be immediately identified as
event security by all present at the outdoor event. The number of security
personnel shall be determined by the City Manager or his/her assigned
representative.
307,1000: NOTIFICATION To NEIGHBORS: At least two (2) weeks prior to the scheduled
outdoor event, the applicant shail notify, in writing, all residents within five hundred
feet (500') of the event location. The notification shall include the name of the
sponsoring organization, or person, the date, time and hours of the event and the
name of a contact person, including address and phone numbers, for the neighbors
to contact if there are any questions. The applicant shall provide the City Manager
with proof that said notification has been made. Failure to notify all residents within
five hundred feet (500') may be cause for revocation of the Icense prior to the
event.
307,1100: FUTURE EVENTS: Any person who had previously been licensed pursuant to the
provisions of this Section may be denied a license for a subsequent outdoorevent if
violations of the provisions of this Section occurred at previous outdoor events
sponsored or held by the same person(s~ The City Manager may approve the
license with modifications and conditions as he deems appropriate to protect the
health, safety or welfare of the public.
Any person who had been denied a license by the City Manager based upon prior
violations of the Section at a previously licensed outdoor event, may appeal the City
Manager's decision to the City Council.
307,1200 : PENALTY: Any person who violates any provision of this Section or who violates
any condition or requirement of a license issued pursuant to this Section shall be
informed that they must immediately discontinue theevent and the license shall be
revoked. Any person who violates the provisions of this Section shall be guily of a
misdemeanor.

Jane, the owners ofT.J. Hooligans and the renter from Hollywood inquired about an outdoor permit
event to conduct an outdoor concert between the two. I wonder if this is a reincarnation of the same
thing. My first question is whether these are outdoor events? Bill what do you think? If they are, they
need to submit our Outdoor Event Application to Bill. Applications are available from Janet. It is hard
to say how many cars, where they will be, whether liquor will be available outdoors and the like. Any
approvals we give should be limited to one weekend so we can re-evaluate and make revisions as

PM. The classic cars would be parked in the mall parking lot adjacent to TH 13. Other parking
would be on the southwest side of the mall. Other activities would include food, drinks and
music. See the attached flier for more information.
The applicants would like their permit this week. Please let me know of any comments or
concerns you might have, or of any conditions that should be attached to the permit, by
Thursday, June 12th.

Subject: RE: Priordale Mall Car Show
I spoke with Mr. Keith Hoime about the car show, and specifically your questions. He stated that:
(1) the music was just a stereo hook-up; he would use the microphone to announce the car show trophy
winners; and (2) food is limited to chips, pop and hot dogs or burgers There will be no alcoholic
beverages.
I told Mr. Hoime he would not be able to have the music, but that he could use the microphone to
announce the trophies, since that would be a limited time and use. I suggest we issue the permit with
this condition and a condition that no alcohol be served outside of the buildings. We can also attach a

Jane....the question as to whether or not these would be considered "Outdoor Events" and
therefore subject to that ordinance leads to two questions. 1) Where do they intend on having the
'food, drinks and music'. Must be incompliance with Outdoor Event Ordinance IF OUTDOORS,
as well as the applicable Liquor license requirements. 2) Is there sound amplification used
outdoors, and if so will there be 50 or more people in attendance......IF SO, the Outdoor Event
Ordinance applies.

T.J. Hooligans and the owners of the Priordale Mall have submitted an application for a
temporary use permit for a classic car show at the Mall on the 2nd and 4th Sundays of
the month, beginning on June 8th and ending on September 28th. The show would be
from 2:00 PM to 7:00 PM. The classic cars would be parked in the mall parking lot
adjacent to TH 13. Other parking would be on the southwest side of the mall. Other
activities would include food, drinks and music. See the attached flier for more
information.
The applicants would like their permit this week. Please let me know of any comments or
concerns you might have, or of any conditions that should be attached to the permit, by
Thursday, June 12th.

The City of Prior Lake has completed its review of the above referenced site plan
application. This letter serves as the official notice of approval of the site plan for
this addition. Attached is an approved set of plans for your files. Approval of this
site plan is subject to the following conditions:
1. The parking area shall be set up as shown on the approved plans.

6. The City of Prior Lake reserves the right to review the use on a weekly
basis. If the City determines the use creates a hazard to the health,
safety and welfare of the public, the permit will be revoked and you must
discontinue the car show at this location. The City will provide you with
two weeks notice of the revocation of the permit. Any new location within
the City must be approved by the City.
7. The location of any signs must be approved by the City and, where
necessary, permits must be obtained.
8. This permit is good through September 28, 2003. A new permit must be
approved to reestablish the use in 2004.
