Because of the larger size it can not be located where the present control building is. Because of the need to have access our electrical equipment and the larger size of the building it can only be located in the present fenced area as indicated but it will not meet the 25ft. set back requirement. The building will be situated in an area that will not impair an adequate supply of light or air to the adjacent property, cause congestion on the public street, increase the danger of fire or endanger public safety. The need for the variance is related to a request to MVEC to sell 50ft on the south side of its property for a City Street in March of 1984. The lack of a deck does not meet the hardship criteria outside unusual circumstances. Ringstad: . The hardship criteria are brought to us by the State and must meet all nine requirements. This clearly does not meet all. . It looks like there might have been some confusion with the flipping of the building plans. But the survey indicates the plans were to be set on correctly. . Deny request. MOTION BY CRIEGO, SECOND BY RINGSTAD, ADOPTING RESOLUTION 03- 08PC DENYING A 13 FOOT VARIANCE FROM THE REQUIRED 25 FOOT REAR YARD SETBACK FOR THE CONSTRUCTION OF A DECK ADDITION. Vote taken indicated ayes by Criego, Ringstad and Stamson. Lemke voted nay. MOTION CARRIED. Stamson explained the appeal process. C. #03-79 Minnesota Valley Electric Cooperative is requesting a 7 foot variance from the required 25 foot front yard setback for the construction of a control building at 14024 Commerce Avenue NE. Planner Cynthia Kirchoff presented the Planning Report dated July 28,2003, on file in the office of the City Planning Department. Minnesota Valley Electric Cooperative (MVEC) is requesting a variance from the zoning ordinance for the construction of a 15 foot by 21 foot (315 square foot) control building for an electric substation on property zoned R-l (Low Density Residential) and SD (Shoreland Overlay District) and located at 14024 Commerce Avenue NE (NE 14 ofthe NE 14 of Section 30). In order to construct the control building a 7 foot variance from the required 25 foot rear yard setback (Section 1102.405 (3)). Existing exceptional conditions on the property, including the location of the transmission lines, create practical difficulties for the location of a new control building. Therefore, staff supports the front yard setback variance. Comments from the public: Dennis Wolf, representing Minnesota Valley Electric Coop, explained they are trying to work in the confines of the fenced area. They are installing new equipment to accommodate present and future needs. The hardship is that they need all the space within the fenced in space. They are not expanding over the area. The streets have been reconfigured restricting their property and setbacks. They will also be improving the integrity of the fenced in area. Wolf explained it would and the process. The building will be larger. The building was built in the mid-50's and falling apart. It is designed for storage of the equipment. Criego asked where the entrance would be. Wolf said it would be on the south side. There will be no fencing but the door will be secured. Wolf explained the need for 2 doors. There was no public comment and the hearing was closed at 7:38 p.m. Comments from the Commissioners: Lemke: . We need to make sure there is an adequate supply of electricity to the City. . Not quite sure from the presentation why it's necessary for the large building. It is 6 times the size. Overall, it does not seem to be a problem at this site. . Does not share the security concerns. Ringstad: . Agreed - There are existing exception conditions with respect to the property. . Approve the request. Criego: . Agreed with staff. Stamson: . Concurred. The applicant has demonstrated this is necessary for providing the use that is there. It is not strictly convenience, it is critical to the community. . Support staffs recommendation to approve. The granting of the setback variance is necessary for the preservation and enjoyment of a substantial property right. The property is guided Urban Low/Medium Density Residential in the 2020 Comprehensive Plan. In order to construct the control building shown on Attachment 3, the following variance is required: 1. A 7 foot variance from the required 25 foot rear yard setback (Section 1102.405 (3)). BACKGROUND: The subject property is utilized for a Minnesota Valley Electric Cooperative substation. A non- conforming 7 foot tall chain link fence encompasses an 8.5 foot by 10 foot l 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. (952) 447-4230 / Fax (952) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER (85 square feet) control building and transmission line power poles. The fence is non-conforming because chain link fences are prohibited in the front yard. DISCUSSION: The applicant would like to replace the existing control building with a larger 15 foot by 21 foot (315 square feet) building to accommodate new equipment. The building is proposed to be constructed of face brick with a standing seam metal roof. The Zoning Ordinance requires a 25 foot front yard setback on properties located in the R-1 use district. The proposed control building is 18 feet from the property line abutting Commerce Avenue, so a 7 foot variance is required. It is contended by the applicant that the proposed building cannot be located in the same position as the existing because it is larger and access to it will be impeded by the existing transmission lines. VARIANCE HARDSHIP FINDINGS Section 1108.400 states that the Board of Adjustment may grant a Variance from the strict application of the provisions of the Zoning Ordinance, provided that: 1. Where by reason of narrowness, shallowness, or shape of a lot, or where by reason of exceptional topographical or water conditions or other extraordinary and exceptional conditions of such lot, the strict application of the terms of this Ordinance would result in peculiar and practical difficulties or exceptional or undue hardship upon the owner of such lot in developing or using such lot in a manner customary and legally permissible within the Use District in which said lot is located. The existing transmission lines act as an exceptional condition on this property. For safety reasons, the proposed control building must be separated from the existing transmission lines. Thus, the strict application of the 25 foot front yard setback and the existing location of the transmission lines result in a practical difficulty. 2. Conditions applying to the structure or land in question are peculiar to the property or immediately adjoining property, and do not apply, generally, to other land or structures in the Use District in which the land is located. The granting of the proposed Variance is necessary for the preservation and enjoyment of a substantial property right of the owner. The granting of the setback variance is necessary for the preservation and enjoyment of a substantial property right. The new control building cannot be accommodated within the buildable area. 4. The granting of the proposed Variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion in the public streets, increase the danger of fire, or endanger the public safety. It does not appear as though a front yard setback variance will impair an adequate supply of light and air to adjacent property or negatively impact public safety. 5. The granting of the Variance will not unreasonably impact on the character and development of the neighborhood, unreasonably diminish or impair established property values in the surrounding area, or in any other way impair the health, safety, and comfort of the area. Relief from the setback provisions of the zoning ordinance will not unreasonably impact the character of the neighborhood. The proposed control building will be located within the existing fenced area. 6. The granting of the proposed Variance will not be contrary to the intent of this Ordinance and the Comprehensive Plan. One purpose of the zoning ordinance is to "protect the residential, business, industrial, and public areas of the community and maintain their stability." A variance from the zoning ordinance to allow for the installation of a new control building is consistent with that provision. 7. The granting of the Variance will not merely serve as a convenience to the applicant but is necessary to alleviate a demonstrable undue hardship or difficulty. The requested setback variance is a not convenience. There are no other safe options available for the location of a control building. 8. The hardship results from the application of the provisions of this Ordinance to the affected property and does not result from actions of the owners of the property. Increased development or construction costs or economic hardship alone shall not be grounds for granting a Variance. Increased development costs are not the basis for the variance requests. CONCLUSION: The applicant would like to construct a 15 foot by 21 foot (315 square feet) control building on property zoned R-1 and SD. In order to do such, a front yard setback variance is required. Existing exceptional conditions on the property, including the location of the transmission lines, create practical difficulties for the location of a new control building. Therefore, staff supports the front yard setback variance. AL TERNA liVES: 1. Approve the variance requested by the applicant, or approve any variance the Planning Commission deems appropriate in the circumstances. 2. Table or continue discussion of the item for specific purpose. 3. Deny the application because the Planning Commission finds a lack of demonstrated hardship under the zoning code criteria. SURVEY City of Prior Lake Zoning/Land use Application Variance RE: Reduce the required set back from the property line from 25Ft to 18FT Description of the Proposed Project Replace the present Control/Metering Building, because of General Aging conditions and size limitations to install new equipment, with a new larger modular building. Because of the larger size it can not be located where the present control building is. Because of the need to have access our electrical equipment and the larger size of the building it can only be located in the present fenced area as indicated but it will not meet the 25ft. set back requirement. The building will be situated in an area that will not impair an adequate supply oflight or air to the adjacent property, cause congestion on the public street, increase the danger of fIre or endanger public safety. The need for the variance is related to a request to MVEC to sell 50ft on the south side of its property for a City Street in March of 1984. If the property had remained whole the set back requirement would have been met and the variance would not be needed. However, the depth of a front yard shall not be less than 20 feet or be required to exceed 50 feet. (5) Through lots and comer lots shall have a required front yard on each street. (6) The width of the side yard setback abutting a building wall shall be increased 2 inches for each 1 foot the length of the building wall exceeds 50 feet. The additional setback will not be applied if there is a break in the building wall equal to 10% of the entire length of the wall. For the purpose of this subsection, a wall includes any building wall within 10 degrees of being parallel to and abutting the side lot line of a lot.
