RE: Development potential for property located at 15411 Breezy Point Road
Gregg:
The City of Prior Lake Planning Department has reviewed the potential for future
development of a single family dwelling on the property located at 15411 Breezy Point
Road. Based on the most recent property survey completed on June 25, 2003, the lot
area is 6,188 sq. ft. with an existing cabin structure. As this lot size is a legal
nonconformity according to the current Zoning Ordinance, any new construction on the
lot will likely require variances from the Zoning Ordinance. Due to the short depth of the
lot (street to the lake) the most likely warranted variances appear to be the building
setback from the lakeshore (min. 75 ft.) and front property line (min. 25 ft.). Also, as
part of the redevelopment of the lot, the existing small shed would need to be placed a
minimum 10 feet from the ordinary high water mark of the lake (904 elevation). It
appears that for redevelopment of the lot all other Zoning Ordinance regulations could
be met including side yard setbacks and the minimum allowed impervious surface
requirement. I have included the various ordinance requirements for your review.
All variances from the Zoning Ordinance require a public hearing before the Planning
Commission. The process to obtain a variance(s) usually takes 1 Y2 - 2 months followed
by the building permit process. No variances can be guaranteed by staff, as the
Planning Commission is the governing body who make determinations on all variances.
I have included a copy of a variance application for your reference.
In regards to the possibility of vacating the triangular area of right-of-way located
between the property and Breezy Point Road, this would involve a very detailed legal
process for the property owner. Because the road right-of-way was platted under the
Breezy Point Plat and the property at 15411 Breezy Point was not platted, the owner
would need to pursue a court process to add the land to the adjacent residential lot.

VARIANCE APPLICATION CHECKLIST
1. A complete Zoning/Land Use Application form, signed by the applicant
and the fee owner of the property.
2. A radius map and a list and 2 sets of labels of the names and addresses
of the owners of property located within 350' of the subject site. These
shall be obtained from and certified by an abstract company.
3. The required filing fee of $150.00.
4. A cedificate of survey of the properly showing the existing and proposed
development in relation to:

Dear Mr. & Mrs. Christian:
The City of Prior Lake has conferred with the City Attorney on your above referenced
request to determine which property the vacated portion would revert to in the event the
vacation is approved. Furthermore, the Planning Department referred your request to
other City departments as well as outside agencies.
After receiving comments from the City Attorney and other departments, it is
recommended that you withdraw your petition. As you are aware, the City will be
reconstructing Breezy Point Road in 2004, and thus does not wish to vacate any portion
of that right-of-way until the project is completely designed. This letter does not preclude
a future petition, however, at this time, the City does not want to vacate any portion of
the right-of-way. In the interim, you should have a title policy prepared to trace the chain
of title to determine which proper'b/is entitled to the vacated portion of Breezy Point
Road. With the complete design of the project and the title information in hand, any
obstacle to the proposed vacation will be identified in advance.
Should you choose to withdraw your request, please do so in writing to the Planning
Department. Once we have received your written request, we will refund your
application fee.

September 15, 2003, at 7:00 p.m. or as soon thereafter as possible.

time, you are tentatively scheduled for the August 25, 2003, Planning
