Renewal Applications. Enclosed is a copy of a
memorandum from Laurie Davis to the City
Council relating to the Refuse Hauler's
application information. The deadline for
receipt of all documentation is June 10, 1992
and the final agenda information is incomplete
as of the writing of this agenda report. A
new memorandum will be distributed at the
conclusion of the deadline updating the City
Council on the status of the applications and
fees paid. Staff will either report verbally
on the status of the applications or
distribute the new memorandum prior to the
meeting. A motion as part of the consent
agenda to approve the Refuse Hauler's License
Applications will requested at the meeting.

Consider Approval of 3.2 Non-Intoxicating
Liquor License for Lakefront Days. Attached is
a co~y of a memorandum and information from
Laurie Davis, License Clerk. The Lions Club
has requested permission to sell beer during
the Lakefront Days celebration in front of
City Hall. The hours will be from 10:00 A.M.
to 10:00 P.M. Motion as part of the consent
agenda to approve the 3.2 beer permit for the
Prior Lake Lions Club and to waive the $10.00
application fee is in order. It has been
customary ?olicy to waive the application fee
for community events or festivals.

Consider Approval of 1992-93 Liquor License Renewal
Applications. Attached is a copy of a memo from
Laurie Davis, License Clerk, to the City Council.
The information contains the licenses applied for,
amount of revenue received and specific payments of
the individual establishments. The Liquor Committee
will meet at 6:30 p.m. on Monday, June 15 to make
recommendations on the applications. All necessary
paperwork has been received from the applicants, or
will be received prior to the meeting. The Liquor
Committee will be submitting information, details
and their recommendation at the Council meeting.
Consider Term Limit Policy for Committee/Commission
Positions. At the Monday, June 1 City Council
meeting, staff was directed to distribute a copy of
the draft Term Limit Policy to all volunteer
Committee and Commission members. On June 3, City
Manager Unmacht forwarded a copy of the draft
Policy with a cover letter to members of the
Planning Commission, Parks Advisory Committee,
Economic Development Committee and Lake Advisory
Committee. Within the letter, encouragement was
provided to the recipients to contact the City
Council for comments and input on the proposed
draft Policy. (Enclosed is a copy of responses
received from Jim Hill and Dave Wu·liner). Council
further directed staff to place the Term Limit
Policy on the agenda for the June 15 meeting.
The purpose of this agenda item is to evaluate the
input provided by appointed officials, and to
discuss the draft Term Limit Policy. Several
appointed position terms will expire in the near
future. Staff recommends that the City Council
adopt a Term Limit Policy acceptable to ~ou, or
rovide alternative direction to staff prior to
ncluding the appointments or reappointments on a
Council agenda in July.

6. Other Business:

Consider Establishing Date For Council
#orkshop. On several occasions within the past
few months the City Council halo suggested
estgblishin~ a workshop date discuss
various issues· This past week,
Superintendent Les Sonnabend, has contacted
city staff to request a joint Council/School
Board workshop to discuss several issues. The
purpose of this agenda item is to ascertain
the interest of the City Council in
establishing a workshop, and to determine your
interest in meeting with the School Board. I
requested that Les provide topics for
discussion and he has suggested the following
list:
Tax Increment Financing Districts
Developers and density issues (number of
school age students per household)
Updates on time frames for referendums
and status of any building plans
The purpose is more informational than it is
action oriented. I am discussing with Les
more specifics on his items. The School
District is requesting a proposed date of
Monday, June 29, preferably at 5:00 p.m. (or
7:00 p.m.). If you are interested in meeting
with the School Board, it is appropriate for
the City to request certain topics of
discussion as well.
Staff is interested in discussing at least two
issues at a Council workshop:
Water quality planning and management
Business/Office Park
I know that Councilmembers have other topics
of interest which may also be applicable to a
workshop. Staff's idea would be to
incorporate the entire discussion into one
workshop which may possibly include a meal.
Perhaps a time frame from 5:00 to 8:00 p.m.
which would incorporate the school district
discussions and matters of Council business
could work. Please consider this information
and staff will elaborate further at the
meeting.

June 1, 1992
The Common Council of the City of Prior Lake met in regular
session on Monday, June 1, 1992 at 7:30 p.m. in the City Council
Chambers. Present were Mayor Andren, Councilmembers Fitzgerald,
Kedrowski, Scott, White, City Manager Unmacht, Assistant city
Manager Schmudlach, City Planner Graser, Associate Planner
Lucast, Parks and Recreation Director Mangan, Public Works
Director Anderson, City Attorney Kessel and Recording Secretary
Birch.
Mayor Andren called the meeting to order and asked everyone

The next order of business was: Consider First Draft of
Ordinance 92-06 Amending City Code Section 9-2-3 (C). Parks and
Recreation Director Mangan addressed the Council with the reasons
for the ordinance amendment and stated that the amended ordinance
will allow for the legal consumption of alcoholic beverages in
local parks during normal park hours (5:00 A.M. to 10:00 P.M.).
This ordinance will make the consumption of alcoholic beverage
hours consistent with the park hours of operation. Council
concurred with this amendment and instructed staff to place
Ordinance 92-06 on the June 15, 1992 consent agenda for action.
Item # 5 Second Consideration of Restrictive Covenant Agreement
with Dave and Dorothy Watzl had been removed from the agenda due
to the fact that all necessary documentation had not been
received from the Watzl's attorney.
The next order of business was: Consider Approval of Community
Opportunity Program. Assistant City Manager Schmudlach commented
on the publication which will be created for the purpose of
assisting individuals, organizations and corporations in
designating funds for donations. Discussion occurred on the
format of the publication, anticipated publication date and plans
for updating the publication on an annual basis. Ms. Schmudlach
noted that staff will be soliciting help from Councilmembers
during the marketing and selling aspect of the Community
Opportunity Program.

As it was not yet 8:00 p.m. (the designated time for a public
hearing on the Intoxicating Liquor License Fee), Council took up
agenda item #8: Presentation of Staff Report on Mineral
Extraction. Associate Planner Lucast presented his report on the
availability of land within the City of Prior Lake that could be
considere4 favorable for mineral extraction and the pros and cons
of establishing a gravel mining operation within the city limits.
D%s?ussi?n occurred on the possibility of a request for gravel
mining In the future and whether the Council should consider an
ordinance on this issue. Discussion occurred on the information
presented by Lucast.

The next order of business was: Conduct Public Hearing on the
On-Sale Intoxicating Liquor License Fee. Mayor Andren called
the public hearing to order at 8:10 p.m. City Manager Unmacht
commented on staff's proposal for an increase in the On-Sale
Intoxicating Liquor License Fees which was discussed during the
1992 budgeting process. Unmacht also referred to a letter
dated December 20, 1991 received from the licensees protesting
the specified increase but agreeing to negotiate a new fee.
Discussion occurred on the proposed three year fee rate plan
agreed to in negotiations between staff and the representatives
of the licensees. Mayor Andren opened the m~eting to the
audience for comment, however, there was no one in the audience
who came forward to speak on the issue. Councilmember Kedrowski
withdrew from discussion due to a possible conflict of interest.
A short discussion occurred.

Due to the early hour the next agenda item was not discussed,
therefore, the following topics were discussed under Other
Business:
Staff Update On Industrial Park Informational Meeting.
Public Works Director Anderson reported on the informational
meeting held earlier in the evening, and comments he received
from the participants on the infrastructure improvement
project for the Industrial Park to the north side of County
Highway 21. Eleven out of sixteen property owners were at
the meeting but only one person s~oke publicly in favor of
the development at the meeting. Anderson requested
clarification from Council as to whether or not this project
should originate via a ~etition from the property owners.
After discussion, Council concurred and directed staff to
inform the prope, rty owners that they should present a
petition for the Improvements if they want the project to
occur.
Update on Centennial Plaza Dedication Plan. Assistant City
Manager Schmudlach announced that the brick factory who is
provldin9 the signature br}cks for the project has closed
temporarily due to production difficulties and that this will
delay the Plaza dedication until sometime in late July or
early August.

The meeting reconvened at 8:25 p.m.
The next order of business was: Second Consideration of
Preliminary Plat Approval of Carriage Hills. City Manager
Unmacht reviewed the results of the May 18 meeting at which time
council requested the developer to study and consider a redesign
of the western portion of the development to eliminate the long,
straight streets and to consider other aspects of the subdivision
which neighbors and Council discussed at the meeting. Unmacht
then outlined the procedure to be followed during the hearing.
Developer, Warren Israelson, presented a sketch of the redesigned
plat and explained the changes which included three additional
cul-de-sacs, one more access to the park, proposed sidewalks and
brick pavers at the park entrances. City Planner Graser
addressed the Council and explained that the major issues and
primary concerns of the long streets, landscaping and berm
treatment of the easements along CR 21, park access, parkland
dedication, wetland treatment and density issues had been
addressed satisfactorily to staff. Graser also stated that the
Metropolitan Community Development Committee of the Metropolitan
Council voted to recommend approval of Prior Lake's Comprehensive
Plan Amendment. The following residents spoke on the issue,
directed questions to staff, and complimented the developer on
the redesign:

Extensive discussion occurred on the placement of sidewalks and
brick pavers, drainage, access to undeveloped land and trailways
to the parks. Extensive discussion occurred on the Wetland
Management Act and the Metropolitan Council Review Process.
Further discussion occurred on the Comprehensive Plan and zoning
concepts. A reguest was made on behalf of the residents by
Maryanne K. Whiting that the City consider implementing an
environmental task force and hold town meetings on the
Comprehensive Plan in order to obtain citizen input.

east/west roadway in the plat to be paid for by the

southerly east/west roadway in the plat to be paid for
by the developer.

The applicant receive all necessary state agency
permits.
A planting plan acceptable to staff be submitted to
screen the lots in the northwest part of the plat from
County Road 21. The planting plan will be implemented
via the Prior Lake developer's agreement. In the event
County Road 21 has not been upgraded when the phase of
development occurs which includes the lots in the
northwest part of the plat, then the estimated cost of
landscaping shall be placed in escrow. The planting
~lan shall be implemented shortly after the roadway is
implemented.
That brick pavers be introduced where trails cross
streets and at all park entrances.
Further discussion occurred regarding sidewalks on the
north/south collector street. Mr. Israelson commented on this
issue. Planner Graser discussed the criteria for the
establishment of sidewalks and recommended crosswalks delineated
by brick pavers at all intersections instead of a sidewalk on the
north/south street. Councilmember Fitzgerald reguested that
prior to another subdivision request for consideration, that the
City Council have clear guidelines with respect to the location
of sidewalks. Council concurred. City Manager Unmacht asked
for a clarification as to the placement of the brick pavers in
Carriage Hills.

television franchise transfer process in the City of Savage.
HRA's $1.00 HUD Program - Council directed City Manager
Unmacht to check with Bill Jaffa to find out whether this
program will allow homes to be removed from the tax rolls.
Aerial survey of the lake by the DNR to spot eurasian
milfoil. Staff reported that the DNR will conduct an aerial
survey with infrared detection cameras. This method is
expected to produce a clearer picture as to the extent of
milfoil infestation in the lake.

INTRODUCTION:
BACKGROUND:
This is the second consideration of Ordinance
92-06 amending city Code section 9-2-3 (C) to
be consistent with the park curfew (Section
9-2-7 (B)). Section 9-2-3 (C) currently reads
as follows:
"It shall be unlawful for any person to
consume any alcoholic beverage, whether
"intoxicating liquor" or "nonintoxicating
liquor" in a park after eight o'clock (8:00)
P.M. and before the park is open the following
day".
As amended 9-2-3 (C) is recommended to read as
follows:
"It shall be unlawful for any person to
consume any alcoholic beverage, whether
"intoxicating liquor" or "nonintoxicating
liquor", in any park between the hours of ten
o'clock (10:00) P.M. and five o'clock (5:00)
A.M. with the exception of City scheduled
activities or with the written permission of
the Parks and Recreation Director".
The amended ordinance will allow for the legal
consumption of alcoholic beverages in the park
during normal park hours (5:00 A.M. to 10:00
P.M.). With the previous ordinance, many
adults participating in athletic activities
(softball and baseball for example) were in
violation of the ordinance if they were to
drink an alcoholic beverage after 8:00 P.M.
RECOMMENDATION:
Staff would recommend that Ordinance
be approved and published in the Prior
American on Monday, June 22, 1992.

BACKGROUND:

BUDGET IMPACT:
Representatives from eight (8) south suburban
municipalities plus Faribault and Northfield
have been meeting the last few months to
address drinking water quality issues. The
City of Prior Lake is a member of this
informal group. The attached Joint Powers
Agreement is a result of the efforts of the
group. The Agreement sets out an arrangement
to provide for utilization of one common
laboratory to perform analysis of our drinking
water quality samples.
Since June, 1977, on a monthly basis the City
of Prior Lake and all other public water
supplies in Minnesota have been required to
submit drinking water samples for
bacteriological analysis. We have used the
services of Serco Laboratories in Roseville
for most of our analysis. Their current
charge of $20.00 per sample results in a total
yearly cost of $2,160.00 for nine (9) samples
each month. In addition, one (1) additional
sample is sent monthly to the Minnesota
Department of Health. Later this year we will
begin a sampling program to test the water for
lead and copper amounts at taps in sixty (60)
homes. These same homes will also be sampled
twice in 1993. The results of this lead and
cop~er sampling will determine if additional
monitoring and treatment will be required.
Due to the monitoring requirements already in
place and the new regulations forthcoming, the
Joint Powers Group of municipalities was
formed to address our needs.
Staff recommends that the City of Prior Lake
enter into the Joint Powers Agreement because
of the potential cost savings for water sample
analysis and the advantage of having samples
picked up in Prior Lake by the laboratory
personnel at a very reasonable charge.

vendors. Minnesota Valley Testing Laboratory
(MVTL) has been selected as having the quote
which best serves the needs of the grgup.
Their prices will result in a yearly savings
of $1,404.00 for bacteriological analysis for
the City of Prior Lake, with the total yearly
cost being $756.00. The cost for lead and
copper analysis are not known since the
Minnesota Department of Health is still
negotiating the details of the program.
Approval by the Mayor and City Council for the
Mayor and City Manager to enter into the
attached Water Quality Testing Joint Powers
Agreement. After the other municipalities
have signed on, we will officially enter into
the proposal for services with MVTL.

RECITALS
This agreement is made pursuant to the authority conferred
upon the parties pursuant to Minnesota Statutes 471.59.
The purpose of this agreement is to provide for the joint
contracting of laboratory services for the cities of Burnsville,
Apple Valley, Eagan, Faribault, Farmington, Lakeville, Northfield,
Prior Lake, Rosemount and Savage. The intent is to utilize one
common laboratory to perform analysis of our water quality testing
programs. This agreement pertains to test requirements mandated by
the Minnesota Health Department, Federal Environmental Protection
Agency, and the Safe Drinking Water Act.
NOW, THEREFORE, the parties agree as follows:
1. Subject to the other provisions of this

shall award the contract pursuant to state law.

4. Each City shall be responsible for:
° Establishing their own sampling points
° Collecting their own samples
° Maintaining their own recQrd system and reporting
results to the designated agencies
° Transporting their samples to the laboratory or common
collection point of pick up
5. In accordance with the agreement the laboratory will
submit an itemize4 invoice to each city separately for the work
performed for each city. Upon approval of the invoice by the
respective city, that city will remit the approved invoice amount
directly to the laboratory.
6. It is agreed that the Cities of Apple Valley, Eagan,
Faribault, Farmington, Lakeville, Northfield, Prior Lake,
~Rosemount, and Savage and each of them, indemnify, save, and hold
harmless the City of Burnsville and all of its agents and employees
from any and all claims, demands, actions, or causes of action, for
whatever nature, arising out of the contracting procedure by reason
of the execution or performance of the work purchased for each
respective city under this agreement, and that the cities of Apple
Valley, Eagan, Faribault, Farmington, Lakeville, Northfield, Prior
Lake, Rosemount, and Savage further agree to defend, at their sole
cost and expense, any actions or proceedings commenced against
their respectiYe cities for the purposes of asserting any claim of
whatsoever character arising hereunder.
7. This agreement can be terminated on the part of any
individual city by giving sixty (60) days written notice to all of
the other cities involved in the agreement, otherwise the agreement
will automatically renew on January 1, 1993 and January 1, 1994 to
coincide with terms of the laboratory contract.

PRIOR LAKE LIQUOR COMMITTEE MEETING
MINUTES FROM JUNE 16, 1992 MEETING
The meeting was called to order by City Manager Unmacht at
6:30pm. Present at the meeting were Mayor Lee Andren, City
Manager Dave Unmacht, City Attorney Glenn Kessel and Police
Sergeant Rob Boe (attending for Chief Powell). The meeting was
held in the second floor conference room at the Prior Lake City
Hall.

There was discussion of a letter to the Council from Shelly Armit
of the O'Malley's on Main Bar. (Copy attached). Armit has been
remodeling the the former B and D Bar and had hoped to open the
bar on May 15, 1992. The Council had allowed her to pay a pro
rated fee for the license to cover from May 15 to the renewal
date of July 1, 1992. Armit had not completed the remodeling and
the bar had not opened. She requested that the pro rated fee be
applied to the new license.
Unmacht informed the committee that T.J. Hooligan's bar and the
Prior Place had paid their license fee but had not paid the
recent $300 increase in the fee. The fee increase was enacted
after their money had been received.
Boe reviewed the last years police calls involving the on and off
sale businesses.
Unmacht moved that the on sale license applications be
recommended for council approval with the stipulation that the
Prior Place and T. J. Hooligans pay the additional $300 fee and
that O'Malley's on Main be credited with the amount they had paid
for the pro rated license. The motion was seconded by Andren.
The motion carried on an unanimous vote.
There was a motion by Andren that the on sale Sunday liquor
licenses be recommend for council approval. The motion was
seconded by Kessel. The motion carried unanimously.
There was discussion of a letter that had been received from
Kevin Bresnahan the owner of Dakota Liquors requesting a change
in the off sale liquor ordinance. (See attached). Bresnahan was
requesting an ordinance that would ~rohibit an off sale license
from being issued within one mile of another off sale liquor
facility. It was the consensuses of the committee to not
recommend any change at this time.
There was.a motion by Kessel to recommend ~ouncil approval of the
off sale Intoxicating liquor license ap~llcations. The motion
was seconded by Andren. The motion carried unanimously.
There was discussion that the E Z Stop convenience store was not
in c~mpliance with the city's sign.ordinance despite repeated
notifications to meet the requirements
There was a motion by Andren to recommend council approval of the
off sale non intoxicating liquor licenses for Tom Thumb, Holiday,
Express Ga~ and Grocery, PDt. and.not to recommend.approval o~ the
E Z Stop llcense due to their failure to comply w~th the C~ty's
sign ordinance and a liquor sales violation that occurred on
3-12-92. The motion was seconded by Kessel. The motion passed
unanimously.
There was a motion by Unmacht to recommend for council approval
the on sale non ~ntoxicating liquor license for the Lone Pine
Golf Course. The motion was seconded by Kessel and passed
unanimously.
There was no other business.
The meeting was adjourned at 6:58pm.

Dear Sir:
My request to change the off-sale liquor ordinance is as follows:
No off-sale intoxicating liquor license shall be issued for a premise that is
within one (1) mile of another off-sale intoxicating liquor facility. Facilities
operating on the effective date of this chapter may continue to operate
whether or not they are within one (1) mile of another facility.
