Introduction of Bill Dilks, Watershed District
Staff Coordinator - Mr. Dilks has asked to attend
the City Council meeting to meet the Prior Lake
City Councilmembers. Mr. Dilks assumed the Staff
Coordinator position for the Watershed District on
May 5, 1992. Mr. Dilks will be highlighting the
issues for the Watershed District, including lake
levels and lake quality.
Staff Presentation on the City's
Inflow/Infiltration (I/I) Reduction Program - Over
the last two (2) years, the City has undertaken a
program to identify the sanitary sewer
inflow/infiltration problem _ areas and pipe
conditions by televising the lines. Part of the
program is to cgrrect major problem areas once
they have hee~ identified by.s~aling the pipes .or
manholes. This program was initiated in 1991 with
43,000 lineal feet of sanitary sewer pipe
televised, sixteen manholes sealed, and 1,000
lineal feet of sewermain pipe joints sealed to
reduce inflow/infiltration. In 1992, Staff had
52,000 lineal feet of pipe televised, eight (8)
manholes sealed, and has scheduled 1,149 lineal
feet of pipe joints to be sealed. Staff's
presentation will include a videotape sharing the
various problems identified by sanitary sewer
televising and how these problems are being handled
by the Public Works Department. This item is for
Council's information, no action is required.

MINUTES OF THE CITY COUNCIL
November 2, 1992
The Common Council of the City of Prior Lake met in regular
session on Monday, November 2, 1992 at 7:30 p.m. in the City
Council Chambers. Present were Ma~or Andren, Councilmembers
Fitzger91d, Scott, White, Acting Czty Manager Kuhlmann, Public
Works Director Anderson, Planning Director Graser, City Attorney
Kessel and Recording Secretary Birch.
Mayor Andren called the meeting to order and asked everyone to
rise for the pledge of allegiance.
The minutes of the October 19, 1992 Council meeting were reviewed
by Council. Councilmember Scott noted on page 2 that consent
agenda i~em (a! encompassed both.the ~eptember 30 and the October
12 Special C~ty Council Meeting M~nutes and only one vote was
taken, however the minutes reflected that two votes had
occurred.
MOTION MADE BY SCOTT, SECONDED BY WHITE, TO APPROVE THE OCTOBER
19, 1992 COUNCIL MINUTES AS AMENDED.
Upon a ¥ote taken, ayes by Andren, Fitzgerald, Scott and White,
the motion passed unanimously.
Councilmember Kedrowski arrived at 7:38 p.m.

The next order of business was: Consider Approval of
Proclamation For Minnesota Health #eek. Loren Norsk, Che~aical
Health Coordinator for School District 719, and Angel O'Laughlin,
representative for Mothers Against Drunk Driving and Students
Against Drunk Driving, were present to promote Minnesota Chemical
Health ~eek. Mayor Andren presented 3Mr. Novak with a
Proclamation declaring the week of November I - 20, 1992 as
Minnesota Chemical Health Week in the City of Prior Lake.
The next order of business was Presentation from Bill Rudnicki,
Mdewakanton Sioux Community Engineer. However, due to the fact
that Mr. Rudnicki was not present the next order of business was:
Consider.Harold Bohlen Variance Appeal. City Planner Graser
presen=ea an overhead of the area and reviewed details of the
application. Mr. Graser noted that the Planning Commission had
granted Mr. Bohlen a variance to allow one additional residential
unit. Mr. Bohlen addressed the Council and explained his
reasons for requesting a density variance to develop four
additional units for his 26 acre site. Extensive discussion
occurred on lot sizes, Metropolitan Council restrictions in a
rural service area, size of the.proposed lots, precedence setting
and other pertinent facts associated with the request.
MOTION MADE BY KEDROWSKI, SECONDED BY FITZGERALD, TO UPHOLD THE
PLANNING COMMISSION'S FINDING OF FACT AND VARIANCE DENIAL FOR
HAROLD AND JUDY BOHLEN'S REQUEST TO DEVELOP FOUR ADDITIONAL
RESIDENTIAL UNITS ON THE 26 ACRE PARCEL.
Upon a vote taken, ayes by Andren, Fitzgerald, Kedrowski,
and White, the motion passed unanimously.

The next order of business was: Presentation from Bill Rudnicki,
Shakopee Mdewakanton Sioux Community (SMSC) Engineer, Regarding
The SMSC's Plans for Sewer Extension and Construction of a
Fitness and Recreational Center. Mr. Rudnicki presented a model
of the SMSC's proposed Fitness and Recreational Center and
discussed concepts for sewer and water connection to the
facility. Extensive discussion followed regarding SAC unit
availability and allocation, the City's policy regarding sewer
and water cgnnections ou~ of the City's.jurisdiction and other
details relating to the project. Mr. Rudnlcki stated that the
SMSC Council is currently discus~ing the p!an and he will convey
a proposal to the Prior Lake City_ Council when appropriate.
Councllmembers concurred that additional information will be
necessary regarding the entire project before further discussion
can be held.
A short recess was called .
The meeting reconvened at 9:10 p.m.
The next order of business was: Discuss 1993 Projects:

Consider approval of Resolution 92-36 - Authorizing
Preparation of Feasibility StUdy for 1993 Projects.
Acting City Manager Kuhlmann discussed the process and
stated that the purpose of the discussion was to solicit
direction from the Council. Public Works Director
Anderson presented the PrOPosed 1993 Capital Projects
and briefly reviewed the individual projects for Council
discussion. Issues such as priority status, financing,

community benefit and other items regarding each Droject
were discussed. Following the discussion, the Resolution
was amended to reflect the City Council's priorities.
Anderson will redraft the Resolution to reflect the
changes as directed by Council.
MOTION MADE BY KEDROWSKI, SECONDED BY WHITE, TO APPROVE
RESOLUTION 92-36 AS AMENDED ORDERING PREPARATION OF REPORT ON
1993 CAPITOL IMPROVEMENT PROJECTS.
Upon a vote taken, ayes byAndren, Fitzgerald, Kedrowski, Scott
and White, the motion passed unanimously.
B. Discussion of Inspections By Developers - Public Works
DirectorAnderson discussed the City's current policy of
911owing developers to provid? their own engineering
inspection services on their projects. Anderson
expressed concern about the quality of work under the
current policy. Anderson recommended that City staff
(or a consultant hired by the City) perform the
inspection and testing to ensure compliance, and charge
the developer for the costs incurred. Discussion
occurred rega~din~ the use of a consultant versus City
staff. Council d~rected staff to make the necessary
changes in the Developers Agreement to allow either City
staff or a Consultant to perform inspections, research
cost of using a consultant versus a staff person, and
place on the agenda in the near future.
C. Consider Soliciting Consulting Engineer's Service - The
purpose of this item was to present staff's request for
approval to solicit proposals for Engineering services
to supplement City staff. Anderson discussed staff
workload and resources in relation to the proposed 1993
Capital Projects. After discussion, Council directed
Anderson to interview several consulting firms and
place staff's recommendation on a future Council
agenda.
Topics discussed under Other Business were as follows:
-- Acting City Manager Kuhlmann discussed two upcoming
workshops: (1) The Shoreland Management Workshop on
November 12, 1992 at 5=30 and (2) The Budget Workshop on
Monday, November 23 also beginning at 5:30 p.m. A short
discussion occurred on the budget process.

Manager Search being conducted by the. Br~m~yer Group, Inc.
Discussion occurred on the candidate interview schedule date.
T~e dates of Janugry 22 and 23 or January. 29 a~d 30 were
discussed. Council agreed to explore the 1ssue wlth Brimeyer
at the November 16 Council meeting.

Handouts regarding a League of Minnesota Cities 1993 Policy
Adoption Conference and Legislative Policies Meeting were
distributed by Kay Kuhlmann. A~yone wishing to attend the
meeting scheduled for Thursday, November 19 at the Decathlon
Club should contact Dee Birch no later than November 10.
Discussion occurred with regard to a salary adjustment on a
temporary basis for Acting City Manager Kay Kuhlmann. The
salary adjustment would be retroactive to October 26 until
such time a City Manager is hired. Th? salary suggested would
be the beginning of the scale fgr a City Manager during the
period Ms. Kuhlmann is Acting City Manager. General Council
consensus was that staff should provide the necessary salary
information and place on the November 16 consent agenda.
Discussion occurred on Resolution 92-34 Approving the
Memorandum of Understanding Between the Metropolitan Council
and the City of Prior Lake. Councilmembers expressed concern
over several sections of the Resolution in that the
Resolution should better reDresent the fact that the City in
no way suggests it acted ~nappropriately in the Negative
Declaration of the EIS. Acting City Manager Kuhlmann was
directed to contact Attorney. Bob Hoffman regarding the
suggested changes. The Resolution will be brought back to
the Council for further consideration.
The next Council meeting will be Monday, November 16, 1992 at
7:30 p.m.
There being no further business, the meeting adjourned at ll:lO
p.m. by general consent of the Council.

At the November 2, 1992, City Council meeting,
the Council discussed a salary adjustment for
Acting City Manager Kuhlmann during the
absence of a City Manager. The Council
requeste~ staff prepare data to assist in
determining the amount of the compensation.
The City Manager salary range iS currently
established in the overall city salary
structure. The Manager's salary is provided
foF in a range with 3 zones within the range.
Th~s system is used for all employees as
required.by the Minnesota Comparable Worth
Legislation.
The salary range for the City Manager in 1992
is $3,931 - $5,895 monthly compensation. The
C%ty Manager's actual salary at the time of
h~s resignation was $4,520 monthly
compensation. The actual salary for the
Assistant City Manager in 1992 is$3,346. The
Council did discuss compensation equal to the
minimum of the City Manager's salary range.
The City will realize a savings in funds due
to Mr. Unmacht's resignation. Approximately
$12,000 in salary and car reimbursement will
be unspent in 1992. However a severance
package was provided to Mr. Unmacht. The
unspent funds or difference between the
$12,000 figure and the severance package will
more than cover the cost of the compensation
if the minimum is agreed upon.
Approval of the Consent Agenda will constitute
a monthly salary adjustment of $585, bringing
the Acting City Manager's salary to ~3,931. or
the minimum of the City Manager s salary
range.

DISCUSSION:
The Economic Development Committee currently
has eight (8) members on the Committee and one
ex-officio member from School District .#719.
The EDC has authority in their bylaws for
eleven (11) members. This agenda item is
being presented to request approval for Bob
Underferth to be appointed to the EDC.
The EDC membership has fluctuated in size
over the years from f%ve (5) to eleven. (11)
members. At this point, the membership is
eight (8), three short of our full authority.
Mr. Underferth has been recommended to be
considered for appointment to the EDC by Mayor
Andren and Tom Kedrowsk~ who interviewed Mr.
Underferth as part of the Planning Commission
appointment process.
Mr. Underferth is an active member of the
Prior Lake Community serving on the Centennial
Committee for three years, the Lions Club, and
St. Michael's Church. Mr. Underferth is also
active in the Prior Lake Business Community as
the owner and operator of Prior Lake Rental
from 1987 - present and a member of the Prior
Lake area Chamber of Commerce.
Mr. Underferth is interested in Prior Lake's
growth and committed to the Prior Lake
community.
The EDC voted on October 27, 1992 to recommend
approval of Mr. Underferth on the EDC to the
Council.
Mr. Underferth's appointment will be effective
on November 16 1992. The current term
expiration date ~ill be July, 1994 at which
time he may request reappointment to the EDC.

First Consideration of Ordinance 92-12
Amending Prior Lake Code Section 5-2-1 and
Zoning Ordinance 83-6 for Beaudette Lot Split

INTRODUCTION:
BACKGROUND:
The Planning Department received a request
from Bertha Beaudette for a lot split. Prior
to the lot split request being processed, the
Council must consider for approval a rezoning
for the land. On November 5, 1992, the
Planning Commission approved a request from
Bertha Beaudette to rezone the site from C-1
Conservation to R-1 Urban Residential. Prior
Lake City Council is being asked to consider
Ordinance No. 92-12 amending the ordinance to
reflect the proposed rezoning.
The Beaudette. request cf~r a lot division
cannot occur within the - District because
of the 10 acre lot size minimum. An amendment
to the zoning code is necessary to change the
C-1 zone to R-1. The subject site is 1.3
acres currently zoned C-1, but abutting R-l,
R-2 and C-1 zoning. See attached Zoning Map.
The two lots which make up the parcel are lots
of record purchased in the late 1940's and
early 1950's. The westerly parcel cogtains
approximately one half acre and is the site of
the applicant's home. The home is located
17.3 feet from the front property line, but is
considered a legal non-conforming setback
because ~t was in existence prior to the
adoption of the Prior Lake Zoning Ordinance.
The abutting easterly parcel contains .8
acres, a storage shed, and a shrine. For all
intents and purposes, it is a vacant lot.
The Conservation Zoning District is a broad
holding zone and is typically refined in the
subdivision process. It is generally
reflective of public land uses such as
schools, churches, and parks. Staff believes

the land characteristics of the subject site
are more reflective of an R-1 zone than the
C-1 zone. The site does not have unstable
so~ls, s~gn~f~=ant natural fea~ure~, and se~ep
slopes as defined by Conservation Zoning
Districts and does not provide public land Use
as referenced above. The only natural feature
is a ravine which does not necessitate a C-1
zone. Excluding ~he ravine, the lot contains
approximately 24,000 square feet (sf) of lot
area which is over twice the minimum lot area
for single family lots and dwellings in an R-1
District.
DISCUSSION:
The Planning Commission approved the request
for rezonin~. If Council ap?r?val is made,
staff will process the land division under the
Admlnistrative Land Division process. The
Administrative Land Division application is
included for reference.
To date the only inquirSes_have been regarding
the uses permitted within the R-1 zoning
district. The primary concern was if multiple
family or commercial uses were allowed. When
residents were informed the proposed zone was
for single family residential dwellings, no
objections were voiced.
Staff regards the rezo~ing as a refinement _of
the Conservation District zone. Both the City
and the applicant would benefit from allowing
the zoning to change to RTl. It would allow
the applicant to more easily sell the property
as it would not be such a large parcel. Also
the City would gain tax revenue from another
home on the vacant lot.
COMPREHENSIVE
PLAN IMPACT:
ALTERNATIVES:
The underlying Comprehensive _Plan Land Use
designation is for iow .density residential
development, single family dwellings? The
rezOning land use is therefore conforming to
the intent of the Comprehensive Plan Land Use
designation.
There are three alternatives available:
1) Approve the rezoning as proposed.
2) Deny the rezoning as proposed.
3) Table the application to request
information.

Staff recommends Alternative 1, approving the
application as submitted.
ACTION REQUIRED:
Motion to approve the Rezoning _Application,
and recommend adoption of Ordinance 92-12
which will implement the rezoning and provide

SITE ANALYSIS
HISTORY/BACKGROUND:
The subject site is a 1.3 acre parcel which contains two lots of
record. A rezoning is proposed from C-1 Conservation to R-1
Urban Residential (Single family dwellings). The lots have been
in the same ownership since their purchase in the late 1940's and
early 1950's. They are not part of any subdivision, but they
have frontage on Credit River Road and St. Paul Avenue, border
another residential lot and the school district property.
PREVIOUS PROPOSALS:
There are no previous proposals for the subject site on record at
City Hall.
PHYSIOGRAPHY:
Both lots are predominantly flat, but have a ravine along the
northern portion of the lot abu~tin~ the school district
property. In staff's opinion the ravine is not a large enough
factor to prohibit the change in zoning. The .8 acre lot which
will presumably be built upon has approximately 24,000 square
feet (sf) of area excluding the ravine area. This is over twice
the amount of sf required for a single family lot in an R-1 zone.
Some significant trees occupy this lot and, depending upon house
placement, may be lost during construction.
ADJACENT USES:
North of the site and abutting it is the Independent
Consolidated School District 719 property. To the east and west
are single family homes in established residential neighborhoods.
Across County Road 21 to the south of the site is open space
zoned R-3 Multiple Residential.
EXISTING CONDITIONS:
The subject site contains a single family dwelling which occupies

the westerly parcel and approximately one half an acre in area.
According to the submitted survey, the southwesterly cgrner' of
the house is 17.3 feet from the northerly line of Credit River
Road as traveled. Although the front yard setback for new
construction is twenty five (25) feet, this situation is viewed
as a legal nonconforming setback not subject to variances.
For all intents and purposes the easterly ~arce% is vacgnt. It
does contain a 14 x 16 foot storage shed which is cantilevered
out over the ravine bank, but it is no longer safe and will
probably be remoyed when the site is.developed. The site also
contains a shrine with. the Virgin Mary set in a masonry
structure. These two items do not significantly impact
development on the site. Trees are scattered randomly about the
property and range from small to significant.
The northerly ~igh~y (80) feet of the property is part of a
ravine which begins in the west and gets deeper to the east. It
is the recipient of yard waste and miscellaneous litter, but
nothing significant enough to cause concern,
NEIGHBORHOOD ISSUES/IMPACT/CONCERNS:
The Plann%ng Department received several phone calls regarding
the rezonlng. Mostly the callers were concerned about multlple
family or commercial uses. Neither uses would be acceptable.
The rezoning is based on the underlying Comprehensive Plan Land
Use designation which is low density residential (s~ngle family
dwellings). Staff believes the 9rea was mistaken~ included in
the Conservation Zone. The rezon~ng would be a rez~nemen= oz the
Conservation District.
The purpose of the Conservation District is to identify vital
environmental resources of the community such as stgep slopes,
wetlands, and unstable soil conditions. Development is allowed
only after careful analysis. The rezoning would not impact the
steep slope which is located on the northern portion of the
property. A substantial building envelope exists which would
allow development to occur without disturbing the slope area.
RECOMMENDATION:
When considering the underlying Comprehensive Plan Land Use
Designation, the justification for Conservation Zoning, and the
adjacent land use, staff recommends approval of the rezoning as
requested by the applicant. There is justification when all
aspects of the request are ?onsi~ere~. The rezoning would be a
refinement of the Conservation D~str~ct.

NOTICE OF PROPOSED ADMINISTRATIVE LAND DIVISION
DATE MAILED: OCTOBER 10, 1992
The Prior Lake Planning Department has received an application
from BERTHA BEAUDETTE of 5086 CREDIT RIVER ROAD to consider an
administrative land division within the area indicated on the
attached ma~ of Prior Lake. The proposal is to divide the 1.3
acre parcel into .5 and .8 acre lots as per attached survey.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the
City Manager or representative to authorize subdivision approval
without a public hearing under the following circumstances:
1. The division of property will not result in more than three
parcels.
2. The property to be subdivided is a lot of record in
office of the County Recorder of Scott County.
3.
The resultSng.parcels generally conform to the shape
area of existing or anticipated land subdivisions in
the

surrounding areas.
4. The division will not cause any structure to be in violation
of setbacks.
5. Any easements which may be required by the City must be
granted.
6. The owners of land contiguous to the parcel must be notified
in writing and no written objection received within ten days
followinq notification.
7. Any wr%tten objection shall constitute an appegl. Such an
ob3ect~on shall be forwarded to the City Council who shall
hear the objection and decide the matter.
A copy of the proposed administrative land division and location

ob]ectlons regarding this matter should be submitted to the
Planning Department by OCTOBER 26, 1992. If the Planning
Department receives no written objections, this proposal will be
processed with the Rezonlng application.
In addition to the Administrative Land Division a Rezoning
a~plication has been filed. They will be considered
simultaneously, but due to notification deadlines and
requirements two processes are used. The subject site is
currently zoned C-% Conservation and the req~.est is to rezone it
R-1 Residential (s~ngle family). Single family residential is a

permitted use in the Conservation District. However the minimum
lot size is ten (10) acres. The existing house was built prior
to the adoption of the Prior Lake Zoning Ordinance and is
therefore exempt from the minimum lot size. With the request
for the Administrative Land Division, the new lot must conform
to the standards of the zoning district. There is no basis for
the subject site to be zoned C-1 Conservation. It was
inadvertently included in the C-1 zone. It is more suited for
R-1 Residential. Conservation zoning is for areas with steep
slopes (over 20%), unstable soils, or exceptional natural
resources. The site has none of those characteristics.
What the entire process will do is enable the applicant to split
1.3 acres into .5 and .8 acre lots and be in compliance with the
Zoning.Ordinance to build a single family house 9n the newly
establIshed parcel. The Planning Commission w~ll hear the
Rezonin~ proposal Thursday November 5, 1992. If the Planning
Commission approves.the request, it will be forwarded to the City
Council who makes the final decision on November 16, 1992. If
the City Council approves the rezoning,.t~e~ will then consider
the Administrative Land Division. Land d~vls~ons are generally
approved unless there is written opposition from contiguous land
owners. The land division cannot be approved unless the site is

DISCUSSION:
Jim Brimeyer of the Brimeyer Group, Inc., was
hired on October 19, 1992 to conduct the search
for the City Manager position. This agenda item
has been placed on the agenda to update the City
Council on the search progress and to review for
approval a draft of the Position Profile.
The City has contracted with Mr. Brimeyer to
p~ovide search expertise in replacing former
City Manager David Unmacht. The timetable
provided by Mr. Brimeyer clearly delineates the
steps necessary to accomplish the goal by a
target date of February, 1992.
Mr. Brimeyer has accomplished the first step of
the t%metable by gathering informa~ion for the
Positlon Profile. The information used to
prepare the profile came from a variety of
sources including personal Council interviews,
staff interviews and discussions with key
community leaders.
A draft Position Profile has been attached for
Council review. Mr. Brimeyer will be re~uesting

input and making any necessary modificat at
the November 16 Council meeting. The Posit~on
Profile will then be used to provide information
to all interested candidates.
In addition to the Position Profile, Mr.
Brimeyer will be presenting the announcement for
the position to the C~ty Council and addressing
any questions the Council may have regarding the
process.
Staff encourages.the City Council to determine
a date for candidate interviews in order to
avoid a possible conflict of dates.

Dear City Administrator, Mayor and members of the Council,
I am unable to attend the budget hearing scheduled for this evening. I have
therefore, prepared this memo to state my position on the proposed budget
for 1993.
I do not feel you are being fiscally responsible by increasing the budget
16.4% over last year. A 16.4% increase over 1992 far exceeds inflation
and increases in personal income. Increases of this magnitude are
irresponsible. You, as our representative and employees have to develop
the courage to hold spending in check. My family and I do without in our
personal spending because of limited income. We cannot increase our
personal income 16.4% without taking on a second job. Our choice is to
live within our income. I expect the city to do the same. Yes, I like nice
parks, clean roads, and a fancy bridge over Prior Lake. But, I am also
willing to sacrifice if it means the City of Pdor Lake must spend beyond
its means.
