CONSIDER APPROVAL ENTERPOINT ENERGY AGREEMENT FOR
INSTALLATION OF GAS MAIN AND/OR GAS SERVICES FOR PRIOR LAKE
CITY HALL AND FIRE STATION.
Introduction
The purpose of this agenda item is to request approval of two agreements with
CenterPoint Energy regarding the Police Station and City Hall project.
Historv
In order to install temporary and permanent gas meters and services to the
new City Hall and Police Station, CenterPoint Energy requires the execution of
certain agreements.
Current Circumstances
The City Attorney has reviewed each of the proposed agreements. Her
modifications have been included in the documents by CenterPoint Energy.
Conclusion
The Council should consider adoption of these agreements as part of the
consent agenda.
A number of minor revisions were made to the documents. We asked that
each document specifically identify the building for future reference purposes.
Additional changes are included in paragraphs 3, 6, 9 and 10.

AGREEMENT
This Agreement is made this 10th day of February, 2006, between CenterPoint Energy, a division of
CenterPoint Energy Resources Corp., d/b/a CenterPoint Energy Minnesota Gas, and its successors,
("CenterPoint Energy"), and City of Prior Lake, and it successors, (the "Owner").
The Owner is developing property in Prior Lake and desires to have natural gas main and/or services installed.
CenterPoint Energy is a natural gas public utility that desires to serve this area.
Therefore, the parties agree as follows:
1. CenterPoint Energy agrees to install natural gas main andlor services to serve the area described on
Attachment A and incorporated herein by reference, Prior lake City Hall (4646 Dakota) - 39578219 (''The
Project"). The Owner represents and warrants to CenterPoint Energy that it is the owner, or authorized
agent of the same, of all property within the Project. Therefore, in consideration of CenterPoint Energy
agreeing to design and install the natural gas main and/or services described above, the Owner grants
CenterPoint Energy the exclusive right to transport natural gas to all residential andlor commercial
structures ("Structures") within the Project. If another entity transports natural gas to any Structures within
the Project, then the Owner will reimburse CenterPoint Energy for CenterPoint Energy's costs in the design
and installation of its natural gas main and services, in addition to any other remedies CenterPoint Energy
may have against the Owner. The Owner represents and warrants that the initial purchaser or lessor of
land andlor Structures from the Owner within the Project will use natural gas transported by CenterPoint
Energy for space heating and water heating.
2. The Owner agrees to abide by installation requirements on Attachment B.
3. All natural gas mains and/or services installed by CenterPoint Energy shall be and remain the property of
CenterPoint Energy, and the Owner shall acquire no right, title or interest in any gas main andlor services
installed under this Agreement. The Owner will grant to CenterPoint Energy all easements necessary or
desirable for the installation and operation of all natural gas mains and other facilities related to providing
service to the project as requested by CenterPoint Energy.
4. The parties warrant that each has full right, power and authority, and has received all required approvals to
enter into this Agreement and to perform fully its obligations hereunder.
5. The Owner may not assign this Agreement. This is the complete Agreement between the Owner and
CenterPoint Energy and it may not be changed except in writing and signed by both parties. Minnesota law
governs this Agreement.
6. The term of this Agreement is five years or until the construction of all structures in this Project is complete.
7. The Owner agrees to clearly mark all privately-owned underground facilities including but not limited to:
septic tanks, drain fields, sewer lines, sump pump extensions, water wells, sprinkler systems, invisible
fences, electric lines, and pipelines. CenterPoint Energy and its representatives are not responsible for
damage to these items if they are not clearly marked at time of installation.
8. The Owner is responsible for extra-ordinary construction charges including: the use of directional boring
equipment and hand digging expense due to obstructions on the property, special permit fees, and charges
associated with SWPPP compliance and custom fabrication if required. The Developer is responsible for all
restoration after gas instal/.
9. Meter locations will be determined by CenterPoint Energy, based on written request from Owner, cost of
installation, code compliance, and safety. Should there be a request to move the meter after initial install, it
will be at the cost of the Owner.
10. The Owner agrees to pay Out of Season Charges (if applicable) for installations between December 1st and
March 31st. See enclosed Out of Season flyer for more details.

Energy
Location requirements for natural gas installations
Plan for utilities at the design stage.
To avoid construction delays. plan for utilities during the design stage
and use the following guidelines.
Natural gas meter requirements
May vary by city
· 3' from fresh air intake or any opening to building
· 3' from doors or operating windows
· 3' from water spigots
· 3' from any ignition source
· Away from driveway or vehicle traffic
· Avoid locations directly below roof valleys, water
downspouts, decks, stairs, or partial overhangs
· Banked meters are preferable for townhouse buildings
· Regulator and relief valve must be located where gas can
escape freely away from any opening into the building.
· Must have all exterior walls framed before meter can be
installed. If changes are made after meter installation and
meter no longer meets codes, you will be charged to move
the meter.
Natural gas service line requirements
· Minimum of 3' from property line (unless easement exists)
· 6' from building structure, if line will be parallel to it
· Approximately 8' from buried fuel tanks (varies by
municipality)
· 10' from wells and septic tanks
· Installed in a straight line perpendicular to main
· Conduit crossings must be installed prior to service
line installation (if applicable)
Meter protection - guard posts
Meter sets should be located away from potential damage
from vehicles. Guard posts must be installed if meters may
be exposed to vehicle damage. Guard posts must be:
· 4" diameter steel posts filled with concrete
· On a 15" diameter concrete footing, 3' deep and
3' above grade
· Placed no greater than 4' apart and not closer than
3' from meter set
Cost for installation
4 posts - $650, 3 posts - $630, 2 posts - $500, 1 post - $250
Installation requirements
· Site must be within 6" of final grade
· Clear path from the gas main to service entrance
· Request 7" we or 2 psi delivery pressure
· Clearly mark the location of private underground facilities*
such as:
- Sewer lines
- Invisible fences
- Electric lines
- Septic systems
- Sump pump extensions
- Drain fields
- Water wells - Buried fuel lines
- Underground sprinkler systems
