This correction does not affect the number of lots or the street dedications. It is more of a housekeeping item. The report recommends approval. Historv On August 4, 2003, the City Council adopted Resolution 03-136 approving the final plat known as Windsor Estates. The plat consisted of 10 acres, to be developed with 22 single family homes. The final plat documents were signed and recorded. Current Circumstances The surveyor recently discovered an error in the dedication section of the plat. This section lists the developer, Windsor Development, as a Minnesota Corporation rather than as a Minnesota Limited Liability Company. To correct this error, the surveyor is requesting the City sign a Certificate of Correction to the plat. This certificate specifically corrects the errors. It does not change any of the dimensions of the lots. The Certificate of Correction is the proper way to correct the errors on the recorded plat. The certificate does not affect the plat as approved by the City Council. The required developer improvements were included under the final plat, so no Letter of Credit is necessary. In addition, the City fees normally associated with a final plat have been collected. A copy of the Certificate of Correction and the plat is attached to this report. There is no financial impact as a result of this action. 1. Adopt a motion authorizing the Mayor to sign the attached Certificate of Correction. 2. Defer this item and provide staff with specific direction. A motion and second authorizing the Mayor to sign the Certificate of Correction to the plat of Windsor Estates is required.
