Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT MARCH 20, 2006 5G JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1091 (CREEKSIDE CONDOMINIUM) FIRST SUPPLEMENTAL CIC PLAT Introduction Eagle Creek Development is requesting approval of a Common Interest Condominium plat for the second, 24-unit building located at 16520 Tranquility Court in the Creekside Estates development. The staff recommends approval of this CIC plat as part of the consent agenda. Historv On December 18, 2000, the City Council adopted Resolution 00-128 approving the final plat for Creekside Estates. The final plat consisted of 12.7 acres to be developed with 3 lots for a total of 108 units in 3 buildings. This final plat included all of the proposed lots. The last of these three buildings was constructed in 2005. Current Circumstances The purpose of a CIC plat is to allow the subdivision of townhouse or condominium units into lots for each individual unit for sale to individual owners. Essentially, the plat creates a lot around the four walls of an individual unit. CIC plats are typically done following the actual construction of the buildings in question. This is the second of the Creekside Estates CIC plats. It includes 24 units. The CIC plat does not change the number of units or the density of the development. Staff has reviewed the CIC plat and finds it consistent with the approved preliminary and final plat. CIC plats do not require a development contract. The required developer improvements were included under a previous final plat, so a Letter of Credit is not necessary. In addition, the City fees normally associated with a final plat were collected under the previous Development Contract for the Creekside Estates final plat. There are no budget impacts with the approval of this CIC plat since the building has already been built. The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1091 (Creekside Condominiums) First Supplemental CIC Plat. 2. RECOMMENDED MOTION: A motion and second to adopt a resolution approving the Common Interest Community Number 1091 (Creekside Condominiums) First Supplemental CIC Plat and authorizing the Mayor and City Manager to sign the CIC plat documents is required. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The City Council approves the Common Interest Community Number 1091 (Creekside Condominiums) First Supplemental CIC Plat. 3. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by May 20, 2006, will render the CIC plat null and void. 4. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
