PROCEDURE FOR APPROV AL OF A
REGISTERED LAND SURVEY (RLS)
In accordance with the provisions of Section 1006.103 of the City of Prior Lake Subdivision Ordinance, all
registered land surveys in the City shall be processed in the same manner as a combined preliminary and final plat
application.
Plannine Commission Action: Upon receipt of a complete application, the Planning staff will schedule a public
hearing before the City of Prior Lake Planning Commission. This requires a notice published in the official
newspaper and mailed notice to owners of property within 500' of the site. The Planning Commission will
cot#uct a public hearing and make a recommendation to the City Council within 60 days of receipt of a complete
application.
Citv Council Action: The combined preliminary and final plat and a signed development contract will be
submitted to the City Council, along with the Planning Commission recommendation. Once the City Council has
approved a Final Plat and development contract, the subdivider has sixty (60) days from the date of final City
Council approval to record the Final Plat and relevant documents with Scott County, or the Final Plat approval
shall become null and void. The City Council may extend the recording time for sixty (60) days upon written
request by the subdivider. The developer shall provide evidence of recording with Scott County of the Final Plat
and all other pertinent documents. Evidence of recording shall constitute the return of one signed mylar sheet and
one certified copy of all other pertinent documents to the Planning Department.
APPLICATION INSTRUCTIONS
. Application Fee: Check payable to the "City of Prior Lake". The non-refundable filing fee for a Combined
Preliminary and Final Plat is $500.00 plus $10.00 per lot.
. Signed Application: Include authorization from the property owner on the application form or by attached
letter of authorization if an agent signs the application.
. Application Checklist: The submittal requirements for a combined preliminary and final plat application
include all of the information required for a preliminary plat (Section 1003.200) and all of the information
required for a final plat (Section 1003.300). The attached checklist identifies the necessary information.
Please indicate where you have provided the required information (such as Sheet #, narrative, or attached
report, etc.) and check the box verifying it as being provided to the City with the application. Failure to
provide any of the required information will result in an incomplete application. The Application Checklist
will expedite the review of your application. Attach the checklist with the application materials.

COMBINED PRELIMINARY AND FINAL PLAT APPLICATION CHECKLIST

1. A complete land Subdivision Application form, signed by the
applicant and the fee owner of the property.
2. A radius map and a list and 2 sets of labels of the names and
addresses of the owners of property located within 500' of the
subject site. These shall be obtained from and certified by an
abstract company.
3. The required filing fee of $660.00" plus $10.00 per lot (including

4. A copy of the Watershed District permit application. including
verification by the Watershed District of the date of receipt of that
application.
5. Ten (10) full-scale copies of the plat and supporting data and one
11 "X 17" reduction of each sheet.
6. A title report prepared by a title company indicating owners and
encumbrances on the property and a statement as to which parts
of the property are registered (Torrens).

1. The proposed name of the subdivision.
2. Boundary line survey and legal description in accordance with
applicable state statutes.
3. The location of monuments shall be shown and described on the
final plat. Locations of such monuments shall be shown in
reference to existing official monuments on the nearest
established street lines, including true angles and distances to
such reference points or monuments.
4. Location of lots, streets, public highways, alleys, parks and other
features, with accurate dimensions in feet and decimals of feet,
with the length of radii and/or arcs of all curves, and with all other
information necessary to reproduce the plat on the ground shall
be shown. Dimensions shall be shown from all angle points of
curve to lot lines.
5. Lots and outlots shall be numbered clearly. Blocks are to be
numbered, with numbers shown clearly in the center of the block.
6. The exact locations, widths and names of all streets to be
dedicated.
7. Location and width of all easements to be dedicated.
8. The names and addresses of all persons having an interest in the
property, the developer, the designer and the surveyor, including
registration numbers.
9. A Statement dedicating all easements as follows: "Easements for
installation and maintenance of utilities and drainage facilities are
reserved over, under and along the strips marked drainage and
utility easements".

10. A Statement dedicating all streets, alleys and other public areas
not previously dedicated as follows: "Streets, alleys, and other
public areas shown on this plat and not heretofore dedicated to
public use are hereby so dedicated".
11. Graphic scale of the plat, not less than 1" = 1 00'.
12. Date and north arrow.
13. Identify the portions of the property that are registered (Torrens).
1. Boundary lines and total acreage of proposed plat.
2. Existing Comprehensive Plan and Zoning classifications, including
Shoreland District boundaries.
3. Location, widths and names of all existing or previously platted
streets or other public ways, showing type, width and condition of
improvements, if any, railroad and utility rights of way, parks and
other public open spaces, permanent buildings and structures,
easements and section and corporate lines within the tract and to
a distance of two hundred feet (200') beyond the tract.
4. Boundary lines of adjoining unsubdivided or subdivided land,
within two hundred feet (200'), identified by name and ownership,
including all contiguous land owned or controlled by the
subdivider.
5. Any other information the City finds necessary to determine the
impact the proposed subdivision will have on the health, safety
and welfare of property in the City and City residents.

1. Layout of proposed streets showing the right-of-way widths,
center line gradients, typical street sections, and proposed names
of streets. The name of any street heretofore used in the City or
its environs shall not be used unless the proposed street is a
logical extension of an already named street, in which event the
same name shall be used.
2. Locations and widths of proposed alleys and pedestrian ways.
3. Location, dimension and purpose of all easements.
4. Layout, numbers, lot areas and preliminary dimensions of lots and
blocks.
5. Net lot area, exclusive of road right-of-way and wetland and
drainage easements.
6. Minimum front and side street building setback lines. When lots
are located on a curve, the width of the lot at the required front
yard setback must be identified.
7. Areas, other than streets, alleys, pedestrian ways, and utility
easements, intended to be dedicated or reserved for public use,
including the size of such area or areas in acres.
1. Proposed restrictive covenants.
2. A geotechnical report of the land within the subdivision prepared
by a qualified person.
3. Statement of the proposed use of lots stating type of buildings
with number of proposed dwelling units or type of business or
industry, so as to reveal the effect of the development on traffic,
fire hazards and congestion of population.
4. Where structures are to be placed on lots, which are subject to
potential replat, the preliminary plat shall indicate a logical way in
which the lots could possibly be resubdivided in the future.

Preservation Plan as required by Section 1107.2100 of the Zoning
Ordinance.
2. Lot and block numbers, house pad location, home style and
proposed building pad elevations at garage slab and lowest floor
for each lot.
3. Topography in two foot (2') contour intervals with existing
contours shown as dashed lines and proposed contours as solid
lines. Existing topography shall extend a minimum of two hundred
feet (200') outside of the tract to be subdivided or outside of the
contributing drainage area, whichever is greater.
4. Location of all natural features on the property. Natural features
include, but are not limited to, the following: tree lines, wetlands,
ponds, lakes, streams, drainage channels, bluffs, steep slopes,
etc.
5. Location of all existing storm sewer facilities, including pipes,
manholes, catch basins, ponds, swales, and drainage channels
within two hundred feet (200') of the tract. Existing and proposed
pipe grades, rim and invert elevations, and normal and high water
elevations must be included.
6. If the plat is located within or adjacent to a 100-year flood plain,
flood elevations and locations must be clearly shown on the plan.
7. Spot elevations at drainage break points and directional arrows
indicating site, swaJe and lot drainage.
5. Where irregular shaped lots have been proposed, house plans
shall be submitted which demonstrate such lots are buildable and
the resulting structure compatible in size and character to the
surrounding area.
6. A comprehensive screening plan that identifies all proposed
buffering and screening in both plan and sectional view.

2. Underground Facilities:
a. Water: All mains, hydrants, valves and services.
b. Sanitary Sewer: All facilities including mains, manholes, lift
stations, and services with invert and top of casting elevations.
c. Storm Drainage: All facilities including all piping, culverts,
catch basins, manholes, lift stations and ponds with invert and
top of casting elevations, and hydrologic calculations in
accordance with the Public Works Design Manual.
d. Private Utilities: All gas, electric, cable and
telecommunication facilities.
Locations, grades, rim and invert elevations of all storm sewer
facilities, including ponds, proposed to serve the tract.
9. Locations and elevations of all street high and low points.
10. Street grades, with a maximum permissible grade of eight percent
(8%) and a minimum of one percent (1%) or as otherwise
provided by the City.
11. Phasing of grading.
12. The location of all easements and right-of-way.
13. All soil erosion and sedif\lent control measures to be incorporated
during and after construction must be shown. Locations and
standard detail plates for each measure must be included on the
plan.
14. All revegetation measures proposed for the property, including
seed and mulch types and application rates must be included on
the plan.
15. A Tree Preservation Plan as required by Section 1107.2100 of the
Zoning Ordinance.

e. Existing wells and septic systems.
3. Any other information the City finds necessary to determine the
impact the proposed subdivision will have on the health, safety
and welfare of property in the City and its residents.
11. Four (4) complete sets of mylar copies of the entire plat with all signatures.

names and addresses of the property owners. This list must be prepared and certified by a

INTRODUCTION:
The purpose of this public hearing is to consider an application for a Registered Land
Survey (RLS) of the lots originally platted as Lot 17, 20 and part of 21, Inguadona Beach.
ANALYSIS:

16502 Inguadona Beach. This property is located
north, south and west of Inguadona Beach Circle.
Existing Site Conditions:
There is an existing single family dwelling located
on the site. The applicant is in the process of
removing the existing structure and rebuilding a new
home.
Zoning and Land Use
Designation:
The property is zoned R-1SD (Low Density
Residential Shoreland District). The 2020
Comprehensive Plan identifies this property as R-
L/MD (Low to Medium Density Residential).
Proposed Development:
The proposed RLS does not change the lot area. The
purpose of the RLS is to fonnalize the combination
of the existing lots.
Streets/Access/Circulation:
There are no new streets located within this plat.

Grading/Erosion Control:
There will be no additional grading on this site.
Sanitary Sewer and
Watermain:
Sanitary sewer service and water service are located
in the existing private street. No additional utilities
are required.
Parkland Dedication:
This property has been previously platted. Park
dedication requirements for this subdivision do not
apply.
Finance/Assessment Fee
Review:
This subdivision is not subject to any additional fees.
The property has previously been assessed for street
ant utility improvements. There are no outstanding
special assessments. Tax status is current.
ANALYSIS:
Dennis and Karen Perrier are in the process of removing the existing home and rebuilding
a new home on the property located at 16502 Inguadona Beach Circle. In order to do so,
the applicants were required to combine all of their lots into a single parcel. As a part of
this process, the applicants also negotiated a land swap with the homeowners association.
This swap enabled the Perrier's to acquire a portion ofthe private drive on the east side of
their property in exchange for a piece of Lot 20, which is the physical location of
Inguadona Beach Circle. The City staff approved an administrative lot combination for
this site; however, Scott County determined a Registered Land Survey was required. The
purpose of an RLS is generally to simplify the description and recording for Torrens
Land. The County is responsible for determining whether an RLS is required, under the
provisions of Minnesota Statutes ~508.47.
A registered land survey is processed in the same manner as a combined preliminary and
final plat. This process requires a public hearing before the Planning Commission and
approval by the City Council. The difference is that the Planning Commission and the
City Council are simultaneously reviewing both the preliminary and final pat.
The proposed RLS includes 3 tracts. Tracts A and B are owned by the Perrier's. Tract C
is the physical location of the private street, and will be deeded to the homeowners'
association. There are also existing utilities located within Tract C and across the south
end of Tract A. Easements will be necessary in order to maintain these utilities. Since
easements cannot be shown on an RLS, the applicant must dedicate the easements with a
separate document.
The proposed RLS generally meets the standards of the Subdivision Ordinance and
Zoning Ordinance. The Planning staff recommends approval of this RLS subject to the
following conditions:

I. Drainage and utility easements must be provided for Tract C and the south portion of
Tract A. The easements must be recorded with the RLS.
2. Tract C must be deeded to the homeowners' association.
ALTERNATIVES:
1. Recommend the Council approve the RLS as presented, or with specific changes
directed by the Planning Commission.
2. Table or continue the public hearing to a date and time certain and provide the
developer with a detailed list of items or information to be provided for future
Planning Commission review.
3. Recommend denial of the application based upon specific findings of fact.
RECOMMENDATION:
Staff recommends Alternative #1
ACTION REQUIRED:
A motion recommending approval of the Registered Land Survey, subject to the listed
conditions is required.

Dear Ms. Kansier:
With reference to the proposed R.L.S. plat, CenterPoint Energy Minnegasco does have
an existing gas main in the north half of Inguadona Beach Circle.
After review of this plat I see no reference to retention of right of way in Tract A. The
legal description references "together with that part of the 20.00 foot driveway as
shown on the plat of Inguadona Beach, Scott County, Minnesota, adjacent to Lot
17...."
To date I have not received a vacation proposal. If one is forthcoming, please reserve
an easement to CenterPoint Energy Minnegasco, created by and within the document
establishing the street vacation and filed with the Scott County Recorders office, over
the following area of the proposed street vacation:
That part of Inguadona Beach Circle to be vacated which lies southerly of a line
described as beginning at the Southwest corner of Lot 1 7, according to the plat
of Inguadona Beach; thence South 730 42' 47" East, assumed bearing, along
the Southerly line of said Lot 1 7 and its easterly extension to the intersection
with the centerline of the north-south 20.00 foot driveway, and said line there
terminating.
OR
Create a utility easement on the new R.L.S. plat as described above.
Please send me a copy of the final action on this proposed vacation.

DISCUSSION:
History: The purpose of this item is to consider an application for a
Registered Land Survey (RLS) of the lots originally platted as Lots 17,
20 and part of 21, Inguadona Beach. The RLS formalizes an
administrative lot combination of these lots.
This property is located at 16502 Inguadona Beach. This property is
located north, south and west of Inguadona Beach Circle. It is zoned
R-l SD. There is an existing single family dwelling located on the
site. The applicant is in the process of removing the existing structure
and rebuilding a new home. In order to do so, the applicants were
required to combine all of their lots into a single parcel. As a part of
this process, the applicants also negotiated a land swap with the
homeowners association. This swap enabled the Perrier's to acquire a
portion of the private drive on the east side of their property in
exchange for a piece of Lot 20, which is the physical location of
Inguadona Beach Circle. The City staff approved an administrative lot
combination for this site; however, Scott County determined a
Registered Land Survey was required. The purpose of an RLS is
generally to simplify the description and recording for Torrens Land.
The County is responsible for determining whether an RLS is required,
under the provisions of Minnesota Statutes ~508.47.
The proposed RLS includes 3 tracts. Tracts A and B are owned by the
Perrier's. Tract C is the physical location of the private street, and will
be deeded to the homeowners' association. There are also existing
utilities located within Tract C and across the south end of Tract A.
Easements will be necessary in order to maintain these utilities. Since
easements cannot be shown on an RLS, the applicant must dedicate the
easements with a separate document.

The proposed RLS does not include any new streets or public utilities.
In addition, there is no additional parkland dedication required, nor is
the subdivision subject to any additional fees.
Current Circumstances: A registered land survey is processed in the
same manner as a combined preliminary and final plat. This process
requires a public hearing before the Planning Commission and
approval by the City Council. The difference is that the Planning
Commission and the City Council are simultaneously reviewing both
the preliminary and final pat.
The Planning Commission considered this RLS at a public hearing on
October 13,2003. The Planning Commission found the RLS to be
consistent with the standards of the Zoning and Subdivision
Ordinance. The Planning Commission recommended approval of the
RLS subject to the following conditions:
1. Drainage and utility easements must be provided for Tract C and
the south portion of Tract A. The easements must be recorded with
the RLS.
2. Tract C must be deeded to the homeowners' association.
The Issues: The proposed RLS meets the standards of the Subdivision
Ordinance and Zoning Ordinance. Because there are no public
improvements or development fees associated with this plat, no
development contract is required.
Conclusion: The staff and the Planning Commission recommend
approval of the RLS subject to the listed conditions.
Budget Impact: There is no budget impact as a result of this action.
The townhouse units have already been built. No additional units are
proposed.
The City Council has three alternatives:
1. Adopt a resolution approving the Registered Land Survey.
2. Deny the resolution approving the Registered Land Survey.
3. Defer this item and provide staff with specific direction.

to create a single parcel for the property located at 16502 Inguadona Beach Circle.
Planning Coordinator Jane Kansier presented the Planning Report dated October 13,
2003, on file in the office of the City Planning Department.
Dennis and Karen Perrier are in the process of removing the existing home and rebuilding
a new home on the property located at 16502 Inguadona Beach Circle. In order to do so,
the applicants were required to combine all of their lots into a single parcel. As a part of
this process, the applicants also negotiated a land swap with the homeowners association.
This swap enabled the Perrier's to acquire a portion of the private drive on the east side
of their property in exchange for a piece of Lot 20, which is the physical location of
Inguadona Beach Circle. The City staff approved an administrative lot combination for
this site; however, Scott County determined a Registered Land Survey was required. The
purpose of an RLS is generally to simplify the description and recording for Torrens

provisions of Minnesota Statutes 9508.47.

The Prior Lake Planning Commission conducted a public hearing on October 13, 2003, to consider an
application for the Registered Land Survey (RLS) for Lots 17, 20 and part of 21,Inguadona Beach,
legally described as follows

thereof on file and of record in the Office of the Register Deeds, Scott County, Minnesota, together with

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. The RLS for the above described property is approved subject to the following conditions:
a. Drainage and utility easements must be provided for Tract C and the south portion of Tract A. The easements must
be recorded with the RLS.
b. Tract C must be deeded to the homeowners' association.
c. The RLS and all pertinent documents must be filed with Scott County within 90 days from the date of final plat

Beginning at a point on the west line of said Tract A, distant 6.00 feet northerly of the
southwest comer of said Tract A~ thence southeasterly to a point on the east line of said
Tract A, distant 4.00 feet northerly of the southeast corner of said Tract A, and there
tenninating.
Said easement containing 490.2 sq. ft.
Together with an easement for public utility purposes over, under and across, that part of

Commencing at the southwest comer of said Tract B; thence on an assumed bearing of

With reference to the proposed R.L.S. plat, CenterPoint Energy Minnegasco does have
an existing gas main in the north half of Inguadona Beach Circle.
After review of this plat I see no reference to retention of right of way in Tract A. The
legal description references "together with that part of the 20.00 foot driveway as
shown on the plat of Inguadona Beach, Scott County, Minnesota, adjacent to lot
17.... "
To date I have not received a vacation proposal. If one is forthcoming, please reserve
an easement to CenterPoint Energy Minnegasco, created by and within the document
establishing the street vacation and filed with the Scott County Recorders office, over
the following area of the proposed street vacation:
That part of Inguadona Beach Circle to be vacated which lies southerly of a line
described as beginning at the Southwest corner of lot 1 7, according to the plat
of Inguadona Beach; thence South 730 42' 47" East, assumed bearing, along
the Southerly line of said lot 1 7 and its easterly extension to the intersection
with the centerline of the north-south 20.00 foot driveway, and said line there
terminating.
OR
Create a utility easement on the new R.L.S. plat as described above.
Please send me a copy of the final action on this proposed vacation.

On September 11, 2003 the City of Prior lake determined all of the necessary submittals
for the above application have been received. This letter serves as your official
notification that the application is now complete.
The DRC will now begin formal review of this request. At this time, you are tentatively
scheduled for the October 13, 2003, Planning Commission meeting. I will notify you of
any changes to that date.
The City review process can be substantially less than 120 days, and we intend to move
this matter through the process in a timely manner that provides a complete, professional
review. Occasionally, however, due to meeting schedules, it is sometimes necessary to
extend the 60-day review period. This letter also serves as your official notice that the
City is extending the 60-day deadline for an additional 60 days from November 11, 2003
to January 11, 2004.
