COUNTY ROAD 82 FUNDING
PRESENTATION:
The purpose of this agenda item is to provide a status report on County Road
82 funding.
County Road 82 reconstruction from CSAH 21 to CSAH 17 is a very important
project for numerous reasons. Among them are:
. The current County Road 82 is worn out.
. The road's current capacity to carry traffic safely is in question.
. The road does not have capacity to meet future traffic demands.
. Development will add traffic to this roadway.
. The roadway is key to implementation of the annexation agreement to
provide both traffic and utility service.
. Area businesses, and particularly the SMSC businesses, rely upon this
roadway.
This road improvement has a significant cost presently estimated at $17
million. The funding for the project is from the County, City and SMSC. Up
until 60 days ago, the SMSC funding portion was in question.
Mayor Haugen wrote a letter to the Tribal Council about a month ago setting
forth the importance of this roadway and their participation in the project. The
SMSC Tribal Council considered the issue and have agreed to support the
project financially and through the conveyance of needed right-of-way. The
County has approved the SMSC offer and the project will now move forward.
This effort is a reaffirmation of the importance of the partnerships between the
County, City and SMSC. Attached is a press release on the subject.

CR 82 project moving forward as Prior Lake,
Scott Co. and SMSC strike cost-sharing deal
Representatives of the City of Prior Lake, Scott County and the Shakopee Mdewakanton Sioux
Community (SMSC) have agreed to the terms of a cost-sharing agreement that will allow the County
Road 82 reconstruction project to proceed as planned this year.
The agreement speaks volumes not only about the significance of CR 82 but also the ability of
these elected leaders to rise above their different viewpoints on the tribe's fee-to-trust application and
work together for the betterment of the constituents they represent.
CR 82 is rapidly becoming one of the most traveled roads in all of Scott County. In fact, the busiest
stretch of the road - from County Road 21 west to County Road 83 - is expected to experience a
doubling in its traffic load over the next 25 years, according to a recent Scott County traffic study. That
study projected the number of daily trips to climb to 20,500 by the year 2030. Today, that same stretch
of road supports about 9,800 daily trips.
As part of the reconstruction, CR 82 will expand from two lanes to four from CR 21 to CR 17 and
fully controlled intersections will exist at CR 21 and CR 83.
For the City of Prior Lake, the significance of this cannot be overstated. The city's 2030 Vision
calls for "transportation systems that keep residents within easy reach of the cultural and
entertainment opportunities located throughout the Twin Cities area," and the reconstruction of CR 82
is one of the short-term objectives outlined in that important document.
The city has been including the CR 82 project in its long-range capital planning document, the
Capital Improvement Program, since 2003. The road lies in one of the most rapidly-developing areas
of the city, which is home to the Glynwater, Wilds and Fairway Heights developments. Additionally, the
reconstruction of the road is also an essential piece of the 3,OOO-acre orderly annexation agreement
between the City of Prior Lake and Spring Lake Township.
For Scott County, the improvement project represents yet another significant step as it continues
to make upgrades to its transportation system. Scott County's commitment to addressing its
infrastructure needs is among the many reasons the county has remained among the fastest growing
counties in the entire nation, with recent census estimates ranking it 15th in the nation.
And for the SMSC, the new four-lane road will improve access to its enterprises such as Mystic
Lake Casino, The Meadows at Mystic Lake Golf Course, Playworks and Dakotah! Sport and Fitness.
The agreement
Under the terms of the agreement, this $17 million project involves cost commitments from Scott
County, the City of Prior Lake, and the SMSC. Scott County will pay $12.4 million.
For its part, the SMSC will commit $1.4 million along with approximately eleven acres of land
(valued at approximately $600,000) needed for right-of-way purposes. Five of those acres would be
turned over permanently, the remainder as a temporary construction easement. While the SMSC is
not legally required to pay for improvements to the system of roads and highways that lead to its
reservation, it agreed to support the project and help pave the way for this mutually beneficial project
to proceed as planned in 2006.
"This is another example of how the SMSC works with other governments to improve life for Scott
County residents. Good relationships can build roads," said SMSC Tribal Chairman Stanley R.
Crooks. "As a sovereign nation, the SMSC provides infrastructure in the form of roads, water and
sewer, fire protection and other services. If we can't provide them, then it is our practice to negotiate
with local governments for additional services."
The City of Prior Lake's share would be $3.34 million, which includes 100 percent of the sewer and
water extension work, for which the city has already obtained right-of-way easements from the
Glynwater and Wilds developments through the platting process.
"This just reaffirms the value of the partnerships we have with the county and the SMSC," said
Prior Lake Mayor Jack Haugen. "I am excited to see this project moving forward. This is a critical
roadway that impacts traffic flow to neighborhoods and various SMSC enterprises, and it's critical as
we move forward with the implementation of our orderly annexation agreement with Spring Lake
Township."
Prior Lake Public Works Director/City Engineer Steve Albrecht said the county is planning to start
work on CR 82 in July or August of this year. Construction will likely occur in multiple phases and
could take up to two years to complete.
