Provide clean and safe drinking water for the community and protect drinking water resources. Introduction The purpose of this resolution is to authorize the Mayor and City Manager to exe- cute an amendment to the City’s Standardized Professional Services Contract for the Well No. 6 watermain project. The scope of services necessary for the pro- ject have been expanded due to additional requirements imposed by Scott County, so the contract needs to be amended to account for the additional work. History The City Council approved a water purchase and facility expansion agreement between the City of Prior Lake and the SMSC on November 20, 2017. As part of that agreement, the City committed to extend watermain from Well No. 6 to the new joint Water Treatment Plant (WTP). The new WTP is anticipated to be com- pleted in late 2019 and it is therefore necessary to complete the extension of the watermain from Well No. 6 to the WTP this year. As part of a previous agenda item the City Council approved a Cooperative Agreement with the SMSC for the construction of the raw watermain from the new WTP to the southeast corner of CR82 and Bobcat Trail. That work was completed last fall. It is the City’s responsibility to construct the raw watermain north across CR82 and connect it to Well No. 6. Current Circumstances The engineering department does not have the staff available to design the pro- posed watermain improvements. The City therefore asked WSB to provide a proposal for completing the design as well as provide construction observation and testing for the project. The proposal from WSB was for $65,455. As part of the design it is necessary to obtain a permit from Scott County for the portion of the watermain crossing beneath County Road 82. The County design standards require that utility crossings of the roadways be at a 90-degree angle. Unfortunately, it is not possible for the proposed watermain to cross County Road 82 at a 90-dgree angle without completely digging up the entrance to the Shakopee Mdewakanton Sioux Community’s Tewapa subdivision located on the 2 south side of County Road 82, directly across from Bobcat Trail. This is the only entrance into the Tewapa subdivision. After speaking with the SMSC it was con- firmed that they would not allow the excavation to occur in their entrance due to access and safety concerns as well as the fact that the street is brand new and they did not want it dug up. The engineers at WSB were required by the County to evaluate multiple alterna- tives for the crossing to determine if there was any way to meet the 90-degree crossing requirement. After multiple design iterations it was determined and agreed to by Scott County that there was no way for the watermain to cross at a 90-degree angle and they would allow the crossing to proceed at the proposed 79-degree angle. Scott County has also required that a traffic control plan be prepared and ac- cepted prior to approving the plans. For these types of projects it is typical for the specifications to state that the contractor is responsible for preparing a traffic control plan and submitting it to the County for approval. Preparation of a traffic control plan was therefore not part of the original WSB scope of services. The multiple iterations of the watermain crossing as well as the addition of a traf- fic control plan has increased the scope of services. WSB is therefore request- ing an amendment to their contract. Conclusion City Staff recommends approving the amendment to WSB’s contract for comple- tion of the design and specifications for the Well No. 6 Raw Watermain Project. ISSUES: In order to deliver this project for 2019 construction, the design must be com- pleted soon. WSB has been working diligently to complete the plans and specifi- cations per their original contract. County requirements have increased their scope of services and an amendment is justified. FINANCIAL IMPACT: As part of the City’s 2019 Capital Improvement Plan the estimated cost for this project is $1,300,000 which includes engineering costs. The City Council approved an original contract amount of $65,455 with WSB for the preparation of plans and specifications for this project. WSB is requesting an amendment amount of $9,472 to account for the additional scope of work that was required by Scott County. The revised total contract amount would therefore be $74,927. ALTERNATIVES: 1. Motion and second as part of the consent agenda to approve a resolution au- thorizing the Mayor and City Manager to execute an amendment to the Pro- fessional Services Contract with WSB for the Well No. 6 Raw Watermain Im- provement Project. 2. Motion and second to remove this item from the consent agenda for addi- tional discussion. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The Mayor and City Manager are authorized to execute an amendment to the City’s Standardized Professional Services Contract with WSB & Associates on behalf of the City for the Well No. 6 Raw Watermain Improvement Project in the amount of $9,472. 3. Funding for these engineering services will be drawn from the Trunk Water Fund (502- 80000.00-59203.00) and transferred to the Water Fund (F601-80000.00-39203.00) PASSED AND ADOPTED THIS 4th DAY OF MARCH 2019. WSB did experience a change in the work scope of services for the preparation of plans and specifications. The areas where we experienced additional costs are related to permitting with Scott County and comments received from the Shakopee Mdewakanton Sioux Community (SMSC). WSB studied and prepared various design alternatives to satisfy the requirements of both Scott County and SMSC while also evaluating the options from a constructability standpoint. WSB based our original fee on the alignment of the watermain crossing County Road 82 being preapproved as shown in the as-built plans as a future watermain extension. However, comments received from Scott County permitting staff indicated that an alternative alignment should be considered. We respectfully request the city consider allowing WSB to exceed the original estimated fee by $9,472 to finalize plans and specifications, prepare a traffic control plan, obtain permitting from Scott County, obtain approval from SMSC, and perform bidding administration services. This would put the design fee at approximately 6.6% of the engineer’s opinion of probable construction cost. A typical design fee would be around 10% of the construction cost for a project of this nature. Thank you for your time and we appreciate you considering our request.
