RE: Pike Lake Ponds Development
Mr. Boyles:
I was contacted a few months back by Manley Development. Discussed with me was
the need for a construction easement on my property in order to make road improvements
to Pike Lake Trail. Manley Development wants to make these road improvements from
County Road 42 down to their proposed development, known as Pike Lake Ponds, which
is approximately ~ mile north of County Road 42. Only a portion of the roadway will
iriclude curb and gutter, however, the entire length of the road will be tar.
The proposed improvements would result in the absence of a roadway easement
between my property and the road. Manley Development explained that whoever
develops our property would be responsible for providing an easement.
I have several concerns regarding the proposed roadway improvements. Manley
Development was to address my concerns with the appropriate people and get back to
me. I have not received that information as oftoday. My concerns are as follows:
. If there isn't an easement where would the small utilities run?
. Without an easement, where will the city put the plowed snow in the winter months?
. How would the natural drainage off my property be affected?
. Under normal farming practices, it is impossible to keep the road free of mud. I do
my best to keep the roadway clear of mud and clean it off as needed, but it will be
harder to do so if this road becomes tar.
. I currently have 6 accesses onto my property from Pike Lake Trail that I will continue
to use. Any roadway improvements need to allow for me to retain all 6 accesses.
· Is the road being elevated? If so, it will change the slope onto my property and will
bring more runoff onto my property. Have the impacts of any slope changes been
studied?
· When Toll Brothers wanted to develop the same piece of property now being
considered as Pike Lake Ponds, they too wanted to make roadway improvements.
Toll Brothers was told that they needed to construct a holding pond somewhere along
the roadway. Manley seems not to be aware of this requirement. Is Manley required
to construct a holding pond? If so, where is this pond to be located?
· Who is responsible for maintaining the road since this will not be a city funded
roadway?
· It is our understanding that when we develop our property north of County Road 42,
the city's plan is to vacate Pike Lake Trail and bring in a new road east of Pike Lake
Trail. If that is the case, who is responsible for removing the tar that will come with
these proposed Pike Lake Trail improvements? If Pike Lake Trail is to remain where
it currently is, who will be responsible for putting in the curb and gutter in the areas
where Manley is not required to do so?
· Manley stated that some of our trees would have to be removed to make way for
roadway improvements. Who is going to compensate us for the loss of these trees?
· It is unfair to the Vierlings and any potential developers of the property to be required
to provide an easement when it really is Manley's responsibility.
The City Council should address all of these concerns before the Pike Lake Ponds project
is approved. I invite you and anyone on your staff or the City Council to visit with me at
the farm so you can have a better understanding of how these improvements will impact
