History Minnesota Statues Section 473.864 requires each local governmental unit to review and, if necessary, amend its entire comprehensive plan, fiscal devices and official controls at least once every ten years to ensure its comprehensive plan conforms to metropolitan system plans and ensure its fiscal devices and official controls do not conflict with the comprehensive plan or permit activities that conflict with metropolitan system plans. Current Circumstances Minnesota Statutes and the Metropolitan Council specify the content guidelines and requirements for comprehensive plans. In general, comprehensive plans contain objectives, policies, standards and programs to guide public and private land use, development, redevelopment and preservation for all lands and waters within the City. The comprehensive plan specifies expected industrial and commercial development, planned population distribution and local public facility capacities upon which the plan is based. Finally, the plan contains a discussion of the use of the public facilities specified in the Metropolitan Systems Statement which is information regarding the City's relationship to the Metropolitan Systems (transportation, transit, airports, sewers, and regional parks). The City Council, Planning Commission and City Staff have been working for almost two years on the 2040 Comprehensive Plan Update. The plan, which includes the following chapters, is intended to meet the requirements of the Metropolitan Land Planning Act and Metropolitan Council guidelines and procedures. Chapter 1 – Introduction Chapter 2 – Goals & Policies Chapter 3 – Land Use Chapter 4 – Housing Chapter 5 – Transportation Chapter 6 – Parks & Trails Chapter 7 – Surface Water Chapter 8 – Wastewater Chapter 9 – Water Supply Chapter 10 – Economic Competitiveness Chapter 11 – Resilience Chapter 12 – Implementation Individual Comprehensive Plan chapters can be viewed here: https://www.cityofpriorlake.com/comp_plan_2040.php Conclusion Subsection 1108.804 of Prior Lake City Code states, the Planning Commission shall review all requests for an amendment to the Comprehensive Plan or the Comprehensive Plan Land Use Map at a public hearing and shall report its findings and recommendations to the City Council. The Planning Commission held a public hearing on the 2040 Comprehensive Plan Update on May 13, 2019 and recommended the City Council approve a resolution approving the 2040 Comprehensive Plan Update and authorizing staff to submit the plan to adjacent and affected jurisdictions and the Metropolitan Council for review and comment. Staff is recommending the City Council approve the resolution approving the 2040 Comprehensive Plan Update and authorize staff to submit the plan for review. ISSUES: The Prior Lake Planning Commission previously held a public hearing on February 25, 2019 to consider the Surface Water and Water Supply chapters of the 2040 Comprehensive Plan, which were both recommended for approval by the Planning Commission and approved by the City Council on March 4, 2019. ALTERNATIVES: 1. Motion and a second to approve a resolution approving the 2040 Comprehensive Plan Update and authorizing staff to submit the plan to adjacent and affected jurisdictions and the Metropolitan Council for review and comment. 2. Motion and a second to table or continue discussion of the item for a specific purpose as directed by the Planning Commission. RECOMMENDED MOTION: Alternative #1 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 19-___ A RESOLUTION APPROVING THE DRAFT 2040 COMPREHENSIVE PLAN UPDATE AND AUTHORIZING STAFF TO SUBMIT THE PLAN TO ADJACENT AND AFFECTED JURISDICTIONS AND THE METROPOLITAN COUNCIL FOR REVIEW AND COMMENT Motion By: Second By: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, Minnesota Statutes section 473.864 requires each local governmental unit to review and, if necessary, amend its entire comprehensive plan and its fiscal devices and official controls at least once every ten years to ensure its comprehensive plan conforms to metropolitan system plans and ensure its fiscal devices and official controls do not conflict with the comprehensive plan or permit activities that conflict with metropolitan system plans; and the City Council, Planning Commission, and the City Staff have prepared a proposed Comprehensive Plan intended to meet the requirements of the Metropolitan Land Planning Act and Metropolitan Council guidelines and procedures; and pursuant to Minnesota Statutes section 473.858, the proposed Comprehensive Plan will be submitted to adjacent governmental units and affected special districts and school districts for review and comment on May 21, 2019; and the Planning Commission has considered the proposed Comprehensive Plan and all public comments, and thereafter submitted its recommendations to this Council; and the City conducted public hearing(s) on February 25, 2019 and May 13, 2019 relative to the adoption of the proposed Comprehensive Plan; and the City Council has reviewed the proposed Comprehensive Plan and those recommendations and public comments; and Minnesota Statutes section 473.858 requires a local governmental unit to submit its proposed comprehensive plan to the Metropolitan Council following recommendation by the planning commission and after consideration but before final approval by the governing body of the local governmental unit. based on its review of the proposed Comprehensive Plan and Planning Commission and staff recommendations, the City Council is ready to submit its proposed plan to the Metropolitan Council for review pursuant to Minnesota Statutes section 473.864. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2.
