HomeMy WebLinkAbout4A 07 15 2019 City Council Minutes 1 4646 Dakota Street SE Prior Lake, MN 55372 REGULAR CITY COUNCIL MEETING MINUTES JULY 15, 2019 CALL TO ORDER Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Burkart, Braid, Erickson, and Thompson. None were Absent. Also, in attendance were City Manager Plante, City Attorney Schwarzhoff, Finance Director Erickson, Police Chief Frazer, Fire Chief Steinhaus, Community Development Director McCabe, Public Works Director/City Engineer Brotzler, Assistant City Engineer Monserud and City Clerk Orlofsky. PUBLIC FORUM Briggs: Reviewed the process for the public forum and explained that items scheduled for public hearing or items for which a public hearing has been held but no final action taken, are not eligible for discussion on the public forum. Briggs: Shared a summary of information that the City Council has collected on the Spring Lake Ridge Concept Plan: 1) Proposed access to the development is a concern and an alternative added access should be addressed with the formal application. 2) Water quality needs to be fully addressed as Spring Lake is an impaired body of water. A study will need to be completed to determine the impact this development has on the lake. 3) Environmental concerns on the impact to the aquatic plant life and the wetland habitat on the southwest corner of Spring Lake. A study should be done to address those impacts. 4) Recreational safety. Concerns of the significant boat slip size will have a negative impact on boating the lake given the size and shape of Spring Lake along with the loss of naviga- ble area given the required area as a dock system as proposed. 5) Character of the lake will be negatively impacted with the proposed dock size. Practical challenges including winter storage of the dock system would present significant challenges. This will need to be addressed with the formal application. 6) What is done here will have precedent not only here on Spring Lake but also with any fu- ture developments in Prior Lake. 7) The proposed boat slip number is significantly greater than what is acceptable for this area. 2 DRAFT 07 15 2019 City Council Meeting Minutes Christian Morkenberg, 17556 Vergus Avenue, addressed the City Council. Mr. Morkenberg ex- pressed his concerns about the all clean-up work that has been done on Spring Lake and he is concerned that this development will take the environmental efforts backwards. He would like to the City Council to keep that in consideration when the application comes forward. Lisa Quinn, 1796 Spring Lake Circle, addressed the City Council. Ms. Quinn asked for clarification on the boat deck facility that is being proposed? Is it a dock, mooring facility, or a marina? Are they planning to take it in and out every year? Tom Quinn, 1796 Spring Lake Circle, explained that this lake is an environmentally sensitive lake. Specifically, the area where the docks are located is very shallow. He is concerned with the envi- ronmental issues and making sure that everything is carefully assessed with this application. Kelly Charles, 17081 Sunset Avenue, notified the City Council that the residents of Spring Lake have started a petition and they have gained 650 signatures in less than 36 hours. The residents are passionate about this area. He is also concerned about the Sunset parking area. Craig Thornton, 17540 Vergus Avenue, he is very concerned about the environmental concerns. Will there be an environmental assessment with this application? Chris Handler,17271 Sunset Avenue, the width of the street is not wide enough for a school bus how will it handle the new development. This road will become a parking lot and no room for vehicles to travel on this road. Lauren Peters, 2650 South Shore Drive, spoke as a realtor and understands what a deeded ac- cess is, and that deed access can be very broad. However, he believes that adding another 100 slips on Spring Lake seems a little absurd. Jim Wemingler, 2591 Spring Lake Road, expressed his concerns about environmental impact of the lake. He is also concerned about the substandard lots that were proposed. Liz Etinger, 2591 Spring Lake Road, stated that she does not understand how they can add that many docks on the lakeshore. Kristine Bachman, 17311 Sunset Avenue, stated she is one of the youngest families on Sunset Avenue. They agree with all the points that have already been made. BURKART: Requested that staff provide all claims including payroll. BRIGGS: Noted Item 5G Grants and Donations brought forward some significant donations for the City, SMSC donated $150,000 to the Prior Lake Police, Lions Club donated $3,500 for AV equipment for Club Prior, and Prior Lake Optimists donated $2,000 in scholarships. PRESENTATIONS 6A. Spring Lake Ridge Concept Plan Matzke: Provided the background information on the proposed Spring Lake Ridge Concept Plan. Thompson: Asked what the density would be of this proposed development. Matzke: Explained that density is based on the net acreage for an R-1 zoning area. Thompson: Asked how much lake frontage Spring Lake Estates had compared to this property. Matzke: Explained that Spring Lake Estates has 950 ft. And, this property has 1875 – 1900 ft of shoreline. Briggs: Asked what other agencies would participate in this application when it is submitted. Matzke: Explained that the County would work with the City on the County road, the DNR will comment on through the process, the Prior Lake- Spring Lake Watershed District will comment on the application and the Army Core of Engineers will also comment as well as Spring Lake Town- ships because it is on the border of the Township. Thompson: The light blue area on the lake shore is on the wetlands area. Matzke: Explained that the DNR would best be able to comment on that. John Anderson, from Winkler Development: The developer as seen all the petitions and news- paper articles about this proposed development. He feels there is a misunderstanding and he would like to clarify that the developer has not proposed any docking system or number of slips. The concept plan is conceptual in nature and they have not yet done their research to see what is even functionable on this lakeshore before they submit an application. They have not created any docks or slips for this parcel. The developer explained the proposed development. Braid: Stated that he local Developer should understand that they need to work with the neigh- bors and use the Laker Spirit. He shares Erickson’s concerns that another access to this location is needed. He asked the developer how he arrives at the number of vehicles and parking would add to Sunset Avenue. Anderson: Explained at this time they don’t have that information available that will be something they study before submitting the application. Braid: Explained he would like to see a full environmental impact study done before he could vote on how many dock slips should be in that location. Struggling to find the public benefit in the pub- lic trail as then the City would be responsible for maintaining it. He would struggle supporting this concept as is with the traffic issues, lack of connections and the number of parking and boat slips. Burkart: No questions at this time. Thompson: She has lived in Prior Lake for 30 years. She is also a liaison to the Prior Lake – Spring Lake Watershed District and the money that has been spent on cleaning up the lakes has 5 DRAFT 07 15 2019 City Council Meeting Minutes been huge. With both Upper and Lower Prior Lake on the impaired waters list she is concerned about how this will impact all those efforts. She is also concerned about the boating safety on this lake and the lack of access to the development. Briggs: Reiterated the seven areas of extreme community interest. He would like to see them ad- dressed with the application. Burkart: Thanked all the concerned residents for showing up this evening. He added that he has lived here all of his life. He suspects that very few on the Council are comfortable with 100 boat slips. He stated that he is in favor of property rights, and as a Council we owe it to the residents to provide good public policy. He appreciates that the Developer has submitted a concept plan for public comments to try and work with the neighborhood and Council prior to application. Some negatives for this concept plan are the idea of proposing 100 boat slips, the lake traffic, and lake safety. This Council is sensitive to public trails being a benefit to the public because of the future maintenance. He would like to see the developer carry the water and sewer down Marshall further so that the City can cross at Langford and stub those areas in. RECESS Briggs: Called a recess at 9:04 p.m. allowing for residents to clear out of the Council Chambers. RECONVENE Briggs: Reconvened the meeting at 9:06 p.m. 6B. Faith Lutheran Church Concept Matzke: Provided the background information on Faith Lutheran Church’s Concept. Brian Olson: Owner of New Creation childcare addressed the City Council. Braid: Added that the buffer to the neighborhoods is important to him and he thanked the devel- oper for taking the public feedback.
