CITY OF PRIOR LAKE FOR PUBLIC PURPOSE

DISCUSSION: Introduction
This agenda report recommends the City Council authorize a request to convey two
tax forfeited properties to the City of Prior Lake via purchase for public purpose.
History
The City of Prior Lake received a list of non-conservation lands located within the
City that have been forfeited to the State of Minnesota due to non-payment of
property taxes. As required under Minnesota Statue 282.01, Scott County is
requesting the city approve the parcels for public auction, auction to adjacent
owners, or request a sale or conveyance to the City of Prior Lake.
Current Circumstances
The two parcels being considered for conveyance to the City of Prior Lake are
described as Outlot A, Jeffers Pond 7th Addition (PID 255010240) and Outlot B,
Jeffers Pond 7th Addition (PID 255010250). Each parcel is 0.04 acres and provides
public trail access from Shore Crest Drive NW to the public trail around Jeffers Pond
and the Jeffers Pond neighborhood park.
City staff is recommending the city purchase the parcels for public purpose. The
cost to acquire each parcel is $400.65, for a total acquisition cost of $801.30. Parcel
acquisition cost includes purchase price ($100), state deed tax ($1.65), conservation
fee ($5), county recording fee ($46), county admin fee ($150), Sheriff fee ($70), state
assurance fee ($3), and state deed fee ($25).
ISSUES: To claim title to these parcels, the City must have a specified public purpose. The
public purpose is both outlots provide trail access to a public trail and the City should
maintain this access.
FINANCIAL
IMPACT:
Conveyance of the two parcels can be completed at a total cost of $801.30. The
funding source for this conveyance will be the Revolving Park Equipment Fund.
ALTERNATIVES: 1. Motion and Second, as part of the consent agenda, approving a resolution
requesting the conveyance of tax forfeited properties by purchase to the City of
Prior Lake for public purpose.
2. Remove this item from the consent agenda for additional discussion.

A RESOLUTION REQUESTING THE CONVEYANCE OF TAX FORFEITED PROPERTIES
BY PURCHASE TO THE CITY OF PRIOR LAKE FOR PUBLIC PURPOSE

WHEREAS, The City of Prior Lake has received notice of non-conservation lands located within
the City that have been forfeited to the State of Minnesota due to non-payment of
property taxes; and
WHEREAS, As required under Minnesota Statue 282.01, Scott County has requested the City of
Prior Lake approve the parcels for public auction, auction to adjacent owners, or
request a sale or conveyance to the City of Prior Lake; and
WHEREAS, Minnesota Statutes 282.01 1.a. allows the Commissioner of Revenue to convey tax-
forfeited parcels to the City for an authorized public purpose; and
WHEREAS, The City of Prior Lake has identified a public purpose for each of the tax-forfeited
parcels.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The City has identified public trail as the public purpose for each of the following two
parcels:
a. Outlot A, Jeffers Pond 7th Addition (PID 255010240)
b. Outlot B, Jeffers Pond 7th Addition (PID 255010250)
3. Funding for conveyance of the two parcels in the total amount of $801.30 will be provided by
the Revolving Park Equipment Fund (430) from Department 45200.00-55530.00.
Passed and adopted by the Prior Lake City Council this 5th day of August 2019.
