CONSIDER APPROVAL OF A RESOLUTION APPROVING THE HA-
VEN RIDGE THIRD ADDITION FINAL PLAT AND DEVELOPMENT
AGREEMENT
DISCUSSION: Introduction
M/I Homes, on behalf of the property owner, has applied for approval of
a Final Plat known as Haven Ridge Third Addition, to be developed as a
27 lot, low density residential subdivision. The subject site is located
north of County Highway 42 and east of County Highway 18.
History
On September 18, 2017 the City Council approved the entire Haven
Ridge Planned Unit Development (PUD) along with the final plat of the
first phase of the Haven Ridge development.
Current Circumstances
This third phase of the Haven Ridge PUD development proposes 27 sin-
gle family residential lots. The development totals 11.3 acres, with 8.368
acres being developable. A fourth phase of the development is planned
in the upcoming one to two years. The area encompasses land with
wooded and open areas, large electric and natural gas utility easements
and wetlands.
Staff has reviewed the final plat and finds it to be in substantial compli-
ance with the approved preliminary plat and subsequent final plats.
Conclusion
The platting of this property will allow the construction of the second
phase of 27 residential units and outlots for future development and open
space/storm water management. The City Staff recommends approval
of the final plat and the corresponding development agreement.
ISSUES: The principal requirements for final plat approval include an agreement
as a Development Agreement that specifies the development fees and
other requirements for the platted lot(s). Since the Haven Ridge Devel-
opment was approved in 2017 under the conditions of a Street Oversize
Fee, the developer has agreed to pay the former fee rate of $6,549 per
developable acre for a total amount of $54,802.00 as listed in the Devel-
opment Agreement. The City Attorney has drafted a separate agreement

detailing the street oversize fee (see attached) of which the developer
has agreed to as well.

MOTION:
1. Motion and a second, as part of the consent agenda, to approve a
resolution approving the Haven Ridge Third Addition Final Plat and
Development Agreement.
2. Remove this item from the consent agenda for additional discussion.

RESOLUTION 19-XXX
A RESOLUTION APPROVING THE HAVEN RIDGE THIRD ADDITION FINAL PLAT
AND DEVELOPMENT AGREEMENT

WHEREAS,
M/I Homes of Minneapolis Inc. (the “Developer”), has submitted an application to
the City of Prior Lake for approval of a Final Plat for Haven Ridge Third Addition;
and
WHEREAS, The City Council has found that the final plat of Haven Ridge Third Addition is in
substantial compliance with the approved preliminary plat of Haven Ridge.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. The final plat of Haven Ridge Third Addition is approved subject to the following conditions,
which shall be met by the Developer prior to release and recording of the final plat:
a. A current title opinion or commitment of title insurance is submitted acceptable to the City
Attorney.
b. Payment of all fees identified in Exhibit B of the Development Agreement prior to release
of the final plat mylars.
c. Reductions of the entire final plat be submitted, to the following scales: 1” = 200’; and one
reduction at no scale which fits onto an 8 1/2” x 11” sheet of paper.
d. Three mylar sets of the final plat with all required signatures are submitted.
e. The final plat and all pertinent documents must be filed with Scott County within 90 days
from the date of final plat approval. Failure to record the documents by November 3, 2019,
will render the final plat null and void.
3. The Mayor and City Manager are hereby authorized to execute the Development Agreement
on behalf of the City.
