Encourage development and preservation of quality life-cycle residential housing options. DISCUSSION: Introduction Roman Postle and Corey Goracke-Postle have applied for the approval of a registered land survey on approximately 20,300 square feet of land to combine a portion of dedicated “Waterfront” area with a residential lot area. The property is located at 4322 Bass Street SE on the shore of Lower Prior Lake, north of CSAH 21 and east of Sunfish Trail. History On April 16, 2019 an Order and Decree of Registration was filed in district court which stipulates that the Postles are now the fee owners of not only the residential lot area at 4322 Bass Street SE but also the “Waterfront” area adjacent to their residential lot as well. The order and decree also indicate that the common easement claims to joint use of the “Waterfront” area that lies between the Postle property and Lower Prior Lake have been terminated. The court order directed the Postles to apply for a registered land survey to combine the property area into one parcel. On August 12, 2019 the Planning Commission held a public hearing to consider the request and on a vote of 5-0, recommended the City Council approve the Registered Land Survey. Current Circumstances A Registered Land Survey is a survey performed for the identification of registered (or Torrens) lands in accordance with the requirements of Minnesota Statutes. The following paragraphs outline the physical characteristics of the existing site, the Comprehensive Plan and zoning designations, and a description of some of the specifics of the site. PHYSICAL SITE CHARACTERISTICS: Total Site Area: The total site area consists of approximately 20,300 square feet. The current property contains one single family home. Wetlands: No wetlands are located on the properties. Access: Access to the property is currently from Bass Street. 2030 Comprehensive Plan Designation: The property is designated R-LD for Urban Low-Density Residential uses on the 2030 Comprehensive Plan Land Use Map. Zoning: The property is located within the R-1 Zoning District (Low Density Residential). The R-1 district is consistent with the proposed R-LD designation. This district permits a maximum density of 4.0 units per acre. Shoreland: The property is located within the Shoreland District of Prior Lake and are subject to the City’s Shoreland Ordinance. PROPOSED PLAN Lots: The proposed registered land survey consists of 1 lot. Tract A is 20,300 square feet, 115 feet wide, and contains the existing house. The minimum required lot area for the R-1 District is 12,000 square feet and minimum lot width is 86 feet. Streets: The proposed lot has current frontage on existing Bass Street. Sanitary Sewer/Water Utilities: Lateral sanitary sewer and water utilities are in place for the property. Shoreland Ordinance: The proposed registered land survey is located within the Shoreland District for Prior Lake and therefore the properties are required to meet the requirements of the Shoreland Ordinance including but not limited to a maximum impervious surface area of no more than 30% of the total lot area. The current impervious surface is approximately 23%. Conclusion Prior Lake City Code Subsection 1006.103 states, all registered land surveys in the City shall be processed in the same manner as a combined preliminary and final plat application. In accordance with the standards set forth in the Subdivision Code for combined preliminary plat and final plat applications, the Planning Commission shall first approve the arrangement, sizes and relationships of proposed tracts in such registered land surveys, and tracts to be used as easements or roads should be so indicated. Unless a recommendation and approval have been obtained from the Planning Commission and City Council respectively, in accordance with the standards set forth in the Subdivision Code, building permits will be withheld for buildings on tracts which have been so subdivided by registered land surveys and the City may refuse to take over tracts as streets or roads or to improve, repair or maintain any such tracts unless so approved. The applicants proposed to combine a portion of dedicated waterfront area with a residential lot area according to the court order land registration. All the properties will meet the City lot area and width requirements for the R-1 Zoning District. The proposed registered land survey will comply with all relevant ordinance provisions and City standards, provided all the conditions of approval are met. Therefore, City Staff recommends approval of the registered land survey with the following conditions of approval: 1. The registered land survey shall be recorded at Scott County within 90 days of approval by the City Council. ALTERNATIVES: 1. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2.
