Call to Order and Pledge of Allegiance: Commissioner Fleming called the Monday, August 12, 2019 Prior Lake Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Bryan Fleming, Dave Tieman, William Kallberg, Dan Ringstad, Jason Tschetter and Liaison Zach Braid. Also present were Community Development Director Casey McCabe and Community Development Services Assistant Sandra Peppin. 2. Approval of Agenda: MOTION BY KALLBERG, SECONDED BY RINGSTAD, TO APPROVE THE MONDAY, AUGUST 12, 2019 PRIOR LAKE PLANNING COMMISSION AGENDA. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter. The Motion carried. 3. Approval of Monday, July 8, 2019 Meeting Minutes: MOTION BY TSCHETTER, SECONDED BY TIEMAN, TO APPROVE THE MONDAY, JULY 8, 2019 PRIOR LAKE PLANNING COMMISSION MEETING MINUTES. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter. The Motion carried. 4. Public Hearings: A. DEV 19-000021 – 4322 Bass Street SE – Registered Land Survey (RLS) – Consider a request by the property owners for approval of a Registered Land Survey at 4322 Bass Street Se within the R-1 SD (Low Density Shoreland) Zoning District to combine a portion of dedicated waterfront area with a lot area. The request proposal reflects a recent court order approval in the land registration proceedings. Director McCabe: Introduced a consideration of a recommendation of approval for a Registered Land Survey at 4322 Bass Street SE. The homeowners, Roman Postle and Corey Goracke-Postle have applied for the approval of a registered land survey on approximately 20,300 square feet of land to combine a portion of dedicated “Waterfront” area with a residential lot area. The property is located at 4322 Bass Street SE on the shore of Lower Prior Lake, north of CSAH 21 and east of Sunfish trail. Commission Comments/Questions: Ringstad: Questioned the court order and the Commissioners choice at this point. Director McCabe: Explained any concerns identified tonight from the Commissioners or members in the audience would be reviewed with the with the City Attorney. He commented on the strength of the court order to register this property and stated the property being proposed already meets the cities minimum requirements. Ringstad: Said he doesn’t have any comment and stated he believes this is just a little bit more than housekeeping tonight, considering the approval. Director McCabe: Concurred. Kallberg: Asked for clarification on the utility easement shown on the survey and if it is vacated. Director McCabe: Explained the utility previously dedicated utility easements will all carry forward. Kallberg: Asked if the easements along the lake is in use. Director McCabe: Replied yes, the easement is in place and active. Kallberg: Asked if the Postles followed the proper process for registration of property, including notifying others who may have a claim to the land. 2 Director McCabe: Responded the Postles followed the appropriate process and explained the legal process involved which includes notification to adjacent property owners and any others that may have a claim. He stated that process ran its course and was decided in April of 2019. Applicant Corey Postle: Resides at 4322 Bass Street, Prior Lake. She said she doesn’t have anything to add at this point and is here to answer any questions. MOTION BY TSCHETTER, SECONDED BY TIEMAN, TO OPEN THE PUBLIC HEARING ON ITEM 4A AT 6:08 P.M. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter. The Motion carried. Public Comment: None. MOTION BY RINGSTAD, SECONDED BY TIEMAN, TO CLOSE THE PUBLIC HEARING ON ITEM 4A AT 6:09P.M. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter. The Motion carried. Commission Comments/Questions: Kallberg: Said nothing further. Tieman: Said no concerns. Fleming: Stated no concerns or additional questions. He said this seems to be straight forward order and will be supporting this agenda item. Ringstad: Agreed, no concerns. Tschetter: Stated nothing to debate. MOTION BY TSCHETTER, SECONDED BY RINGSTAD, TO APPROVE THE REGISTERED LAND SURVEY AS RECOMMENDED BY STAFF FOR 4322 BASS STREET SE WITHIN THE R1-SD LOW DENSITY SHORELAND ZONING DISTRICT TO THE CITY COUNCIL TO APPROVE THE REGISTERED LAND SURVEY VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter. The Motion carried. 5. Old Business: No Old Business. 6. New Business: No New Business. 7. Adjournment: MOTION BY RINGSTAD, SECONDED BY TIEMAN TO ADJORN THE MONDAY, AUGUST 12, 2019 PLANNING COMMISSION MEETING AT 6:11 P.M. VOTE: Ayes by Fleming, Tieman, Kallberg, Ringstad, and Tschetter.
