Maintain quality local street system based on a financially stable plan that meets Overall Condition targets. 2. Support complete street designs that ensure pedestrian mobility and multi- modal transportation options. DISCUSSION: Introduction This agenda item is necessary to adopt the assessment roll for the Fish Point Road Reclamation Project. History The City uses the Five-Year Capital Improvement Program and its Pavement Management program to plan its infrastructure improvements and the financing for capital improvements. The section of Fish Point Road from County Road 21 south to Fawn Meadows Curve is part of the plan for a full depth reclamation in 2019. At its October 15, 2018 meeting the City Council adopted Resolution 18- 166 accepting the Feasibility Report for the Fish Point Road Reclamation Project as outlined in the CIP. The M.S. Chapter 429 process applies to all projects that will be financed in whole or part through special assessments or bond proceeds. The Fish Point Reclamation Project includes improvements from County Road 21 south to Fawn Meadows Curve located in Section 1, Township 114, Range 22. This segment of Fish Point Road was built in 1994. The proposed improvements include full depth pavement reclamation, spot curb replacement, replacement of the existing bituminous trail, and ADA improvements at the existing curb ramps. Current Circumstances The project is substantially complete. Punchlist items remain. ISSUES: The Assessment Review Committee has reviewed and agrees with the assess- ment map, assessment rate, and method of assessment. The area method for the assessment is used due to the various property sizes within the project area. 2 The estimated assessment rate per the Feasibility Report and limited appraisal completed for the project is proposed at $6,496.61/acre. FINANCIAL IMPACT: The Fish Point Road Reclamation Project has been proposed to be financed by a combination of funding sources as shown below: Special Assessments $ 123,010.00 Tax Levy $ 322,800.00 Total $ 445,810.00 Total Special Assessments $123,010 Area to be Assessed 18.93 acres Assessment Rate $6,496.61 per acre ALTERNA- TIVES: 1. Conduct a public hearing and if no substantive information is offered, approve a resolution adopting the assessment roll as submitted for the Fish Point Road Reclamation Project (TRN19-000003). 2. Deny this item for a specific reason and provide staff with direction. RECOM- MENDED MO- TION: Motion and second for approval of alternative #1. 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 19-116 A RESOLUTION ADOPTING ASSESSMENTS FOR THE FISH POINT ROAD RECLAMATION PROJECT #TRN19-000003 Motion By: Second By: WHEREAS, Pursuant to proper notice duly given as required by law, the Council has met and heard and passed upon all objections to the proposed assessments for the Fish Point Road Reclamation Project, Project #TRN19-000003. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. The proposed assessment for the Fish Point Road Reclamation Project, Project #TRN19-000003, a copy of which is attached hereto and made part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 3. The portion of the cost of such improvements to be paid by the City is hereby declared to be $322,800, and the portion of the cost to be assessed against benefited property owners is declared to be $123,010. 4. Assessments shall be payable on an equal principal installment method extending over a period of 10 years for street improvements. The first installment shall be the annual principal plus interest calculated from the public hearing date to the end of this year plus twelve months of the next year and shall bear interest at the rate of 4.04% per annum from the date of the adoption of the assessment resolution. 5. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Finance Director, except that no interest will be charged if the entire assessment is paid within 30 days from the adoption of the assessment. The owner may, at any time, thereafter, pay to the City Finance Director the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 7 or interest will be charged through December 31 of the succeeding year. 6. The Finance Director shall forthwith transit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of Scott County. Such assessments shall be collected and paid to the City in the same manner as other municipal taxes. PASSED AND ADOPTED THIS 7th DAY OF OCTOBER 2019.
