October 7, 2019
CALL TO ORDER
Mayor Briggs called the meeting to order at 7:00 p.m. Present were Councilors Thompson,
Burkart, Braid, and Erickson. None were absent. Also, in attendance were Interim City Manager
Olson, City Attorney Schwarzhoff, Police Chief Frazer, Fire Chief Steinhaus, Public Works
Director/City Engineer Brotzler and City Clerk Orlofsky.
PUBLIC FORUM
Briggs: Reviewed the process for the public forum and explained that items scheduled for public
hearing or items for which a public hearing has been held but no final action is taken are not eligi-
ble for discussion on the public forum.

Chief Frazer introduced Stephanie Smith from Southern Valley Alliance for Battered Women.
Ms. Smith thanked the City Council for their continued support towards Domestic Violence
Awareness.

Schwarzhoff: Read into the record an appeal from property owner Ben Schmidt, PID’s
253900020 & 253900010 that was received via email today. Mr. Smith specifically questioned
whether wetlands were excluded from the calculation or not.
Mr. Cook, 14260 Fountain Hills Court, the assessment doesn’t seem fair for the property owners
in this community. His property is only seeing a partial benefit from the project. He believes the
benefits should be taken into account. There are a number of units in Fountain Hills being as-
sessed that have an indirect benefit.

Monserud: Explained that the assessment policy states that the City will assess for the first
public street that would lead to your home. In this specific instance, Fountain Hills Court is the
public street that leads to those properties and so all those properties were assessed. This is in
accordance with the policies. All the properties were assessed.
Monserud: Addressed whether the property was assessed a net acreage or were the wetlands
included. Monserud explained that the wetlands should not be included, and he would like to
verify that since the property owner did object. If the property did include the wetlands by mis-
take staff would bring back a revised assessment for that particular property to the City Council.
Erickson: Explained the benefits between the private streets and the public streets. Erickson
added that he has always been against private streets. He added that the Assessment Policy
has created a formula to help pay for the public streets that lead to these private streets. It is an
unfortunate situation, but he hopes the City Council does not approve private streets in the fu-
ture.
Braid: Added that he understands completely and that he has lived on private streets in other
communities; however, this is the policy that the City has adopted to help pay for improvements
to public roads.

the property owner does not feel there is a benefit to the property, so they are objecting to the
assessment in its entirety.

requested to have a hearing on it.

Monserud: Explained that assessment policy assesses based on acreage, not on the frontage.
Schwarzhoff: Added that the City Council could adopt a different assessment tonight than the
staff has proposed. Once the City Council adopts the assessment this evening Mr. Freier would
need to file an appeal if he did not agree with the amount the City Council determines tonight.

9A. Approval of Resolution No. 19-113 Authorizing the Execution of an Employment Agreement
with Jason Wedel to serve as the City Manager of Prior Lake effective October 14, 2019.
Olson: Provided the background information on the execution of an Employment Agreement
with Jason Wedel.
Braid: Stated that he was supportive of the new City Manager Wedel and is confident he will do
a great job for the residents and staff.

LUTION AUTHORIZING THE EXECUTION OF AN EMPLOYMENT AGREEMENT WITH JA-

14, 2019.
Burkart: Is very pleased to have Jason Wedel start with the City and join the team. He was also
pleased with the agreement that was negotiated, as it was very transparent.
