Grow collaborations to provide efficient and cost-effective services to the community. DISCUSSION: Introduction The Prior Lake VFW and staff have worked together to develop the attached agreement for the provision and installation of banners in the downtown to honor military personnel from Prior Lake. The terms of the attached agreement include the following: • Banners consistent with city standard sizing will be provided by the Prior Lake VFW for installation on street light poles by the city along Main Avenue between Pleasant Avenue and 160th Street. • The agreement allows for at least 12 banners to be initially displayed with the ability to expand to a maximum of 25 banners. • Banners will be displayed between Memorial Day and Labor Day. • Following the display of banners, the banners will be returned to the Prior Lake VFW. • Brackets for the installation of the banners will be donated by the Prior Lake VFW to the city. The donation of brackets by the Prior Lake VFW will allow existing brackets to be repurposed with city banners on additional street light poles. The Prior Lake VFW intends to begin promoting this opportunity for recognition of Prior Lake military personnel prior to Veteran’s Day on November 11. The attached draft information prepared by the Prior Lake VFW highlights this recognition program. FINANCIAL IMPACT: City staff time for the installation and removal of banners concurrently with annual operations for banner installation and removal in the downtown. ALTERNATIVES: 1. Motion and second as part of the consent agenda to approve a participation and donation agreement between the City of Prior Lake and the Prior Lake VFW and authorize the Mayor and City Manager to execute the agreement. 2. Motion and second to remove the claims list from the consent agenda for additional discussion. VOTE Briggs Thompson Burkart Braid Erickson Aye ☐ ☐ ☐ ☐ ☐ Nay ☐ ☐ ☐ ☐ ☐ Abstain ☐ ☐ ☐ ☐ ☐ Absent ☐ ☐ ☐ ☐ ☐ ______________________________ Jason Wedel, City Manager PARTICIPATION AND DONATION AGREEMENT BETWEEN THE CITY OF PRIOR LAKE AND THE PRIOR LAKE VFW THIS PARTICIPATION AND DONATION AGREEMENT (“Agreement”) is between the City of Prior Lake (“City”) and the Prior Lake VFW (“VFW”). WHEREAS, the VFW has offered to provide banners of military personnel for installation on City light poles and donate brackets for the installation of those banners; WHEREAS, the City has agreed to install the brackets and banners as set forth in this Agreement; NOW THEREFORE, in consideration of the mutual promises and covenants contained in this Agreement, the City and VFW agree as follows: 1. Banners and Brackets. The VFW will provide banners of active military personnel to the City. The banners will be of the same size, style and theme as existing City banners. The VFW will also provide at least 12 brackets to City specifications for the installation of those banners. The number of banners and brackets shall be reviewed annually by the City and VFW and the number may be increased or decreased upon agreement of both parties up to a maximum of 25. If either the banners or brackets are not acceptable the City shall have no obligation to accept or hang the banners. 2. Installation and Maintenance. The City will install and maintain the banners on the City light poles along Main Avenue between Pleasant Avenue and 160th St. The City shall have final discretion as to the location of the brackets and banners. The City will install the banners prior to Memorial Day and not remove them until after Labor Day. The City will maintain and store the banners and brackets when not installed on City light poles, except that the City will return to the banners to the VFW upon the VFW’s request. 3. Repair and Replacement. If any of the banners and/or brackets requires repair or replacement, the VFW may choose to repair or replace the banners and/or brackets. The City may choose not to install any or all of the brackets and banners until all have been repaired or replaced to the City’s satisfaction. 4. Donation. The City will identify the banners and brackets as a donation from the VFW in its quarterly donation acceptance resolution. 5. Term. This Agreement shall continue until terminated by either of the parties on 30 days written notice. On termination the City shall return any remaining banners to the VFW but the brackets shall remain the property of the City.
