DISCUSSION: Introduction The purpose of this agenda item is to consider a request by Parkhaven Holdings LLC to extend the deadline for submitting a Final Plat and Final Planned Unit Development (PUD) Plan for the Parkhaven development. The site is located north of CSAH 42, east of CSAH 21, and west of Pike Lake. History On May 21, 2018 the City Council approved Resolution 18-095 approving the Preliminary Plat and Preliminary PUD for Parkhaven as a 70-unit low density PUD. On May 6, 2019 the City Council approved Resolution 19- 054 allowing the final plat application submittal deadline to be extended until November 21, 2019. Current Circumstances In accordance with Subsection 1102.206 “once a preliminary plat is approved by the City Council, a subdivider must submit an application for a final plat within twelve (12) months after approval of the preliminary plat.” The City Council can, however, allow by resolution an extension of this submittal deadline as long as such a request by the subdivider is received 30 days prior to the expiration of the 12-month period. Parkhaven Holdings LLC, the developer, is requesting an extension of the deadline for submitting the final plat for Parkhaven until May 21, 2020. Conclusion City Staff believes the request to extend the submittal deadline for a period of 6 months appears reasonable in this case. The developer continues to seek builders for the project and has been in contact recently with City Staff regarding further progress and review of the project. 2 ISSUES: The purpose of the requested Final Plat submittal deadline extension is to allow the developer additional time to seek builders for the potential development. If the developer fails to meet this extended deadline, the Preliminary Plat approval will become null and void. FINANCIAL IMPACT: This action has no direct financial impact; however, the successful marketing of the development will result in the construction of additional housing units within the City. ALTERNATIVES: 1. Motion and a second, as part of the consent agenda, to approve a resolution approving the request to extend the deadline for submission of the Parkhaven Final Plat until May 21, 2020 as requested. 2. Remove this item from the consent agenda for additional discussion. RECOMMENDED MOTION: Staff recommends Alternative #1. ATTACHMENTS: 1. WHEREAS, Parkhaven Holdings LLC, the applicant/developer, has submitted a request to extend the recording deadline to May 21, 2020; and WHEREAS, Parkhaven Holdings LLC has requested the extension of the deadline to allow time to seek builders for the development project. AND The East 586.01 feet (as measured along the north and east lines) of the Southwest Quarter of the Southwest Quarter of Section 23, Township 115, Range 22, Scott County, Minnesota, excepting the South 641.72 feet thereof; and together with the East 66.0 feet of said Southwest Quarter of the Southwest Quarter. The developer shall revise the plans according to the May 7, 2018 City Engineering & Public Works Dept. Memorandum. b. The developer shall revise the plans according to the May 4, 2018 City Community & Economic Development Dept. Memorandum. c. The developer shall obtain a grading permit from the City Engineering Department prior to any grading or tree removal on the site. d. The Developer shall obtain the required permits from other state or local agencies prior to applicable on the site. 3. Presently, the Final Plat recording deadline is set for November 21, 2019. Therefore, pursuant to email conversations with Jeff Matzke, on behalf of Parkhaven Holdings LLC, I hereby formally request of the City of Prior Lake, a Six-month Extension of the Preliminary Plat/PUD Approval for Parkhaven at Pike Lake. Please place this request on the City Council consent agenda for November 18, 2019. As previously discussed, we understand the Parkhaven at Pike Lake Preliminary Plat was approved under a previous development fee structure in early 2018. We understand there have been some recent changes to how the City can fund regional infrastructure. We acknowledge the City has regional street infrastructure improvement needs and that since Parkhaven at Pike Lake may have direct impacts to some of the improvement needs, we’re willing to discuss reasonable options to assist in addressing the costs of those street infrastructure improvements. As you have suggested, please place this request on the City Council consent agenda for November 18, 2019. Thank you again for your support.
