DISCUSSION: Introduction
Alan Iverson, the property owner, is requesting to subdivide a residential
parcel located at 15930 Sunfish Trail SE. The subject property is located
east of Hwy 21, south of Quincy Street and is in the Shoreland Overlay
District of Lower Prior Lake. The property at 15930 Sunfish Trail consists of
two separate pieces of land divided by a public street. On one side of the
street is a single-family residence and on the other side is a detached
accessory structure.
History
The properties are zoned Low Density Residential in Shoreland (R-1 SD)
and are designated as Urban Low Density (R-LD) on the 2030
Comprehensive Plan Land Use Map. The current structures on the site were
constructed in the early 1900s.
Current Circumstances
The property at 15930 Sunfish Trail contains a single-family residence and
a detached accessory structure on two separate pieces of land divided by a
public street. The lots are joined under a single Property Identification
Number and tax number (PID 250430080). The applicant requests the
subdivision of the lots along the public street, allowing for 2 separate PID
numbers to arrange for the potential sale of the properties separately. The
area was originally designed to accommodate 2 separate buildable lots and
has public utilities (sewer/water) for both the house lot and the accessory
structure lot areas. The property is in the Sunfish Bay development and is
subject to the Council’s dock permit issued this summer to Sunfish Bay.
When staff prepared the dock resolution, staff considered the possibility that
this property would be split into two lots and therefore counted it as 2 lots for
purposes of the permit.
Conclusion
The applicant is requesting approval of the subdivision of the property at
15930 Sunfish Trail SE. City Code Section 1006 sets out the procedural
requirements for a lot subdivision. However, Subsection 1006.106 allows the
Council to waive the requirements when they will create an unnecessary
hardship and failure to comply will not interfere with the purposes of the
Section. In this case, compliance with the subdivision and platting
requirements would create an unnecessary hardship and failure to comply
will not interfere with the purposes of those requirements due to the fact that
the proposed lots were initially platted as separate lots, are both served by
City utilities, and are divided by a public street.
Staff recommends that the Council approve the subdivision and waive the
subdivision and platting requirements. Staff recommends the following
conditions of approval:
• The property owner submits deeds to the City describing the newly
created parcels and records those deeds at the Scott County
Recorder’s Office.
• The existing accessory structure located on Lot 26 shall be removed
within 18 months of approval of the lot subdivision unless a primary
structure is established on the lot.
ISSUES: This request does not create any new lots that were not previously created
as buildable and legal lots of record.
FINANCIAL
IMPACT:
There is no budget impact as a result of this proposal
ALTERNATIVES: 1. Motion and a second, as part of the Consent Agenda, to adopt a
resolution to approve the subdivision of a property located at 15930
Sunfish Trail SE.
2. Remove this item from the Consent Agenda for additional discussion.

A RESOLUTION TO APPROVE THE SUBDIVISION OF PROPERTIES LOCATED AT 15930
SUNFISH TRAIL SE

WHEREAS,
Alan Iverson, the property owner of 15930 Sunfish Trail SE (“Property”), has requested
the City Council allow for the Property to be subdivided into separate buildable lots;
and
WHEREAS, The Property consists of two separate pieces of land divided by a public street. On one
side of the street is a single-family residence and on the other side is a detached
accessory structure; and
WHEREAS, The property was initially platted as two separate lots, both are served by City utilities,
and they are separated by a public street; and
WHEREAS, The City Council has found pursuant to City Code Subsection 1006.106 that
compliance with the restrictions set forth in Sections 1006 of the Subdivision Code will
create an unnecessary hardship and failure to comply will not interfere with the purpose
of the Subdivision Code.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. Pursuant to City Code Section 1006.106, the subdivision and platting requirements are hereby
waived.
3. The property owners may subdivide the Property into two separate Parcels as follows:
a) Parcel 1: Lot 26, Sunfish Bay, Scott County, Minnesota.
b) Parcel 2: Lot 12 and the north half of Lot 13, Sunfish Bay, Scott County, Minnesota.
4. Subdivision of this property is subject to the conditions that the property owner submits deeds to the
City describing the newly created parcels and records those deeds at the Scott County Recorder’s
Office.
5. The existing accessory structure located on Lot 26 shall be removed within 18 months of approval of
the lot subdivision unless a primary structure is established on the lot.
