Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: ISSUES: ALTERNATIVES: RECOMMENDED MOTION: CITY COUNCIL AGENDA REPORT JUNE 5,2006 51 JANET RINGBERG, LICENSE CLERK CONSIDER APPROVAL OF A RESOLUTION APPROVING THE 2006-2007 LIQUOR LICENSE RENEWALS The Prior Lake City Code provides that the City Council must approve the renewal of On-Sale Intoxicating, Sunday Liquor, Off-Sale Intoxicating, Off-Sale 3.2 Malt Liquor, On-Sale Intoxicating, and Club Licenses. All of the licenses expire on June 30 of each year. Attached is a list of the establishments requesting renewal of their liquor licenses. The Prior Lake Police Department has completed a background check for each of the licensees and has reported that in the past year Holiday Station on Fountain Hills Drive was cited for selling alcohol to minors on May 19, 2005, and Village Liquor and T J Hooligan's were both cited August 2, 2005 for selling alcohol to minors. The civil penalty for all three establishments was a three day suspension of which all will have completed by the end of June 2006. All applicants have provided the City with renewal applications, fees and proof of liquor liability insurance. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises for which taxes, assessments or other financial claims of the city are delinquent or unpaid. The Scott County Treasurer's records show that property taxes for Narayan Gas & Groceries, 16176 Main Avenue are past due. The liquor license for Narayan Gas & Groceries will be pending until property taxes are current. If taxes are not paid by June 30, 2006 their liquor license will expire. All other applicants are current on their property taxes. The City Council has the following alternatives: 1. Adopt a resolution as part of the consent agenda approving the renewal of the liquor licenses listed on Exhibit A for 2006- 2007 . 2. Remove this item from the consent agenda for further discussion. 3. Deny the renewals. Staff recommends Council approve the 2006-2007 liquor license renewals. Prior Lake, MN 55372-1714 RESOLUTION 06-xx A RESOLUTION TO APPROVE LIQUOR LICENSE RENEWALS FOR 2006 - 2007 Motion By: Second By: Minnesota Statutes Chapter 340A authorizes the City to issue on and off sale liquor and 3.2 licenses, Sunday licenses, and club licenses, and Prior lake City Code sets forth the application process for such licenses, and Applicants have submitted liquor license applications as set forth in Exhibit A, and Each of the liquor licenses has been investigated and approved by the Prior lake Police Department, and Pursuant to the Prior lake City Code section 301.600, "no license shall be granted for operation on any premises on which taxes, assessments or other financial claims of the City are delinquent or unpaid. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein 2. Exhibit A referenced above are incorporated herein if fully set forth, 3. The liquor licenses for the premises set forth in Exhibit A are hereby approved for the period July 1, 2006 to June 30, 2007 and, 4.
