CONSIDER APPROVAL OF A RESOLUTION APPROVING THE
COOPERATIVE AGREEMENT WITH SCOTT COUNTY FOR CR 82
RECONSTRUCTION
Introduction
The purpose of this agenda item is for the City Council to approve a
Cooperative Agreement with Scott County for the reconstruction of CR 82.
Historv
The City, County and Shakopee Mdewakanton Sioux Community (SMSC)
have been working together for several years to facilitate the reconstruction of
CR 82 between CR 21 and CR 17.
On February 2, 2004 the City Council approved the alignment and geometric
layout for CR 82. Based on that approval the County proceeded with final plan
design and right-of-way/easement acquisition.
Current Circumstances
The City, County and SMSC have agreed upon a tentative construction
schedule for the project. The following is the proposed schedule:
August 7,2006 - November 2006 .
Construction on CR 21 from Jeffers
Pass to Highland Avenue
Construction on CR 82 from CR 21
to Majestic Lane
Project suspended for winter, both
CR21 and CR 82 fully open
Construction on CR 82 from
Majestic Lane to Glynwater Trail
(west)
Construction on CR 82 from Mystic
Lake Blvd to CR 17

Prior to bidding the project the County requires that the City approve a
Cooperative Agreement that details the estimated costs that the City will be
responsible for. A separate maintenance agreement will be entered into in the
future to determine responsibility for various items such as trails and
stormwater ponds.
The Cooperative Agreement is in a standardized form previously reviewed and
approved by the City Attorney for the CR 12 project.

ISSUES:
The proposed final design is consistent with the alignment and geometric
approval granted in 2004 by the City Council. There are no outstanding issues
that staff is aware of at this time.

The total project cost is estimated to be $17.3 million.

ALTERNATIVES:
Funding for this project has been identified in the CIP previously. The Finance
Director has reviewed the proposed amounts and verified that the funding
sources are available. The City Council previously elected not to complete a
neighborhood reconstruction project in 2006 as it was determined that the
bonding the City typically does for those projects would be needed to fund the
CR 82 project.
Scott County and the SMSC will be contributing $11,750,000.00 and
$1,400,000.00 respectively to the project. In addition the SMSC are donating
right-of-way and easements valued at more than $750,000.00.
The Council should be aware that the above numbers are only estimates and
the final cost share will be determined by the bids and actual construction
costs. If those costs vary substantially from the above estimates staff will bring
them back to the City Council for review.
1. Authorize the Mayor and City Manager to enter into a Cooperative
Agreement with Scott County for the reconstruction of CR 82.
2. Deny this agenda item for a specific reason and provide staff with
direction.
3. Table this item to a certain date in the future.

WHEREAS, On February 4, 2004 the City Council approved the alignment and geometric layout for
the CR 82 project; and
WHEREAS, Scott County has designed the project and acquired right-of-way and easements
consistent with that approval; and
WHEREAS, Prior to proceeding with project bidding the County requires the City to enter into a
Cooperative Agreement for funding of the project; and
WHEREAS, The City's costs are estimated to be as follows:

1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are authorized to enter into a Cooperative Agreement with Scott
County for the reconstruction of CR 82.
