ORDINANCE NO. 120-03
AN ORDINANCE AMENDING SECTION 1101.700 OF PRIOR LAKE CITY CODE AND
THE OFFICIAL ZONING MAP FOR THE CITY OF PRIOR LAKE

WHEREAS: Winkler Land Company has submitted an application for a Planned Unit
Development to be known as Spring Lake Ridge; and
WHEREAS: The Prior Lake Planning Commission considered the proposed Planned
Unit Development at a public hearing on January 13, 2020; and
WHEREAS: Notice of the public hearing on said PUD has been duly published in
accordance with the applicable Prior Lake Ordinances; and
WHEREAS: The Planning Commission proceeded to hear all persons interested in this
issue and persons interested were afforded the opportunity to present
their views and objections related to the PUD; and
WHEREAS: The Prior Lake City Council considered the proposed PUD for Spring Lake
Ridge on March 2, 2020; and
WHEREAS: The City Council finds the PUD is compatible with the stated purposes
and intent of the Section 1106 Planned Unit Developments of the Zoning
Ordinance.
The City Council of the City of Prior Lake does hereby ordain:
1. The above recitals are herein fully incorporated herein as set forth above.
2. The Prior Lake Zoning Map, referred to in Prior Lake City Code Section 1101.700, is
hereby amended to designate the following legally described property as the Spring
Lake Ridge Planned Unit Development (PUD).
LEGAL DESCRIPTION:
Government Lots 1 and 2, Se ction B, Township 114, Range 22, EXCEPT the following
described parcels:
Sunrise View, according to the recorded plat thereof
AND EXCEPT
First Addition to Sunrise View, according to the recorded plat thereof
AND EXCEPT

That part of Government Lot 1, Se ction 8, Township 114, Range 22, lying Westerly of
the Westerly line of the plat of Sunrise View and Easterly and Northerly of the following
described line:
Commencing at the northwest corner of said Section 8; thence on an assumed bearing
of east along the North line of said Section 8 a distance of 2,630.15 feet to the point of
beginning of the line to be described; thence South 11 degrees 51 minutes 39 seconds
West a distance of 980.40 feet; thence North 79 degrees 27 minutes 47 seconds East a
distance of 735 feet more or less to said Westerly line of Sunrise View and there
terminating
AND EXCEPT
A tract of land in Government Lot 2, Section 8, Township 114, Range 22, described as
follows:
Beginning at the Southwest corner of First Addition to Sunrise Vi ew; thence South 4
degrees 19 minutes 30 seconds East 98.15 feet; thence North 83 degrees 19 minutes
30 second East 220 feet more or less to the shore of Spring Lake; thence Northerly
along the shore of Spring Lake to the intersection with the South line o f said First
Addition extended; thence South 80 degrees 05 minutes West 220 feet more or less to
the point of beginning, subject to a road easement over the Westerly 33 feet
AND EXCEPT
That part of Government Lot 1 and Government Lot 2, Section 8, Townshi p 114, Range
22 described as follows:
A strip of land 17.0 feet in width lying Westerly and adjacent to the Westerly boundary of
the plats of Sunrise View and First Addition to Sunrise View

3. The Spring Lake Ridge Planned Unit Development includes the following elements:
a. The PUD is a single-family development consisting of 99 lots for single family
homes.
b. As part of the park development, the developer is responsible for grading, topsoil,
turf establishment and construction of the trails /sidewalks to the specifications
provided by the City as indicated on the approved PUD plans.
c. The elements of the plan will be as shown on the plans dated January 27, 2020,
except for modifications approved as pa rt of the final PUD plan.
4. It hereby adopts the following findings:
a. Provides a flexible approach to development which is in harmony with the purpose
and intent of the City's Comprehensive Plan and Zoning Ordinance.
The proposed PUD is consistent with the Comprehensive Land Use Plan
designations on the entire site. The PUD approach allows the location of the
housing units in ways that preserve and enhance natural features of the site .
b. More creative, efficient and effective use of land, open space and public facilities
through mixing of land uses.
The proposed PUD plan clusters the residential areas and provides over 50% of
open space on the site.
c. Create a sense of place and provide more interaction among people;

The plan incorporates multiple sidewalk connections to the existing City and Scott
County trail and sidewalk network.
d. Increase transportation options, such as walking, biking or bussing;
The plan proposes a minor collector road through the area, pedestrian trails,
sidewalks, and a snowmobile road crossing as well as access through the
property.
e. Provide opportunities for life cycle housing to all ages.
This PUD does not provide a specific life cycle housing opportunity .
f. Provide more efficient and effective use of streets, utilities, and public fac ilities that
support high quality land use development at a lesser cost.
The minor collector road will provide an effective supporting street for County
Highway 17 in this development corridor.
g. Enhanced incorporation of recreational, public and open space components in the
development which may be made more useable and be more suitably located than
would otherwise be provided under conventional development procedures. The
PUD district also encourages the developer to convey property to the public, over
and above required dedications, by allowing a portion of the density to be
transferred to other parts of the site.
The PUD preserves a greater amount of open space and resulting tree
preservation as a result. The shoreline of Spring Lake within the developme nt will
be preserved in its natural state due to public dedication of the majority of the
lakeshore and surrounding wetland areas.
h. Preserves and enhances desirable site characteristics and open space, and
protection of sensitive environmental features including, but not limited to, steep
slopes, wetlands, and trees. Where applicable, the PUD should also encourage
historic preservation, re-use and redevelopment of existing buildings.
The plan includes the dedication of easements and public outlots around the
wetland areas to protect these sensitive natural features .
i. High quality of design compatible with surrounding land uses, including both
existing and planned.
The proposed design is compatible with the surrounding low density residential
land uses.
5. Final plans for the Spring Lake Ridge Planned Unit Development are subject to the
following conditions:
a. The developer shall revise the plans according to the February 11, 2020 C ity
Engineering & Public Works Dept. Memorandum
b. The developer shall revise the plans according to the February 14, 2020 City
Community & Economic Development Dept. Memorandum
c. The developer shall obtain a grading permit from the City Engineering Department
prior to any grading or tree removal on the site.
d. The Developer shall obtain the required permits from other state or local agencies
prior to applicable on the site .

PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) PLAN

SUMMARY: The Ordinance amends the Official Zoning Map for the City of Prior Lake by
amending the Zoning Use District from R-1 (Low Density Residential) to PUD (Planned Unit
Development) for the following parcel identification numbers (PIDs):
PID 259080022, 259080010
This ordinance shall become effective from and after its passage and publication.
